Sounds like someone was caught with drugs in their system. They are submitting random testing and hes not allowed to enter for 1 year. Generally means he popped positive for drug useage.

Then don't expect a different result. The "how" is simple. You treat the relationship and marriage as a priority and he gets on a plane, comes to you and stays for a couple months. There's nothing complicated about that at all. It's about priorities. If the marriage isn't a priority, it isn't genuine enough to get an immigrant visa for the foreigner coming from Nigeria. Just another trip and a marriage certificate changes nothing about how a Consular Officer will view the relationship. Time spent together is what counts.

To be frank, it doesn't matter if you agree with the courts or not. It also doesn't matter if she will be happier in the US or have a better life. It doesn't matter if you, your fiancee, or anyone else thinks that the father has not been active enough in his daughter's life. This is about a parent's right to determine where his/her child will live. Once the child leaves for the US, it's highly unlikely that the father will be able to get a visitor visa to see her in the US.
In order for the US Embassy/Consulate to issue an immigration visa to a minor, both parents have to consent. Without the father's consent, your will need a court order allowing his daughter to immigrate to the US. The US will not assist one parent from depriving the non-immigrating parent access to their child by issuing an immigration visa.

Fanta, I have no opinion on this matter, but this is what I am asking of the posters (naysayers) since Fanta has no job, which generally means no income, how do you propose that he feed these two children? I am quite sure he would take donations if you'll would like to offer up some.
The mother would probably have a better chance of feeding and keeping her children safer back in her own home country where she has family and friends, than to be stuck here with no help. Before you'll continue to judge this poster about his decisions look at all of the facts. Yes, I am in agreement that a lot of facts have been left out, but that was the posters choice.

Who signed the ROC papers?
Nothing makes senses, his time lines is off. So, I would state that there are things in this post that is not accurate. Therefore it is hard to give correct advise, when their is doubt.
If I state all that is wrong, then the OP would only correct the post to match the correctness to get a positive response. Please give a detailed timeline.

What do you mean "she doesn't want to go back?" Without marriage, she has no option BUT to go back. If she overstays her I-94 without being married to you, she will be out-of-status and subject to deportation. Without adjusting her status to that of an LPR, she won't be able to work, drive or travel abroad. Live freely, in other words.
Apart from wishing her well, apologizing for the situation and giving her a ride to the airport, you have no other obligation. If you feel that marriage is not the right step for you at this time, do not be guilted or brow-beaten into it.

Fourth stop believing in that Tampos BS, you have been played.
Fifth, put one foot in front of the other and move forward, there is some sun light at the end of all of this darkness. Just believe it, and the light will start to appear.

The OP had a question. Wether it is his first second or third petition is no ones business but his alone, neither is the age difference or where he chooses to find a partner. Those are his choices. It was not him who was sarcastic but he received a sarcastic response with all the little hateful emoticons and critical remarks which was highly uncalled for. I would also withdraw versus letting it expire and include the reasons in a short letter.There are good people here you just have to weed the noise out. So sorry for your pain.
