  4. Yes I was thinking that about the lawyers, really annoying considering how much I paid them… there are instructions buried deep on the USCIS website that specifically explain what to get in terms of my Australian police report and I didn’t read them properly but yeh kinda annoyed about that.
  5. yes true…. I’m so frustrated at myself that I added 2 extra months for missing a simple document. It’s such a first world problem but y’all get it!
  6. the only thing that’s been weird is they initially told me I hadn’t completed my DS260, which I had, and then in October told me I had an incorrect document, and they received the correct one October 30. Otherwise it’s a very straightforward case. If theyre now reviewing docs from Nov 8 surely it has to come very soon… I feel like I’m losing my mind!
  7. Where did you get the 25 days for DQ thing? NVC received all my docs end of august and then took until mid October to tell me one of my docs was wrong. Resent that which was received about 3 weeks ago. This is all for EB1 According to NVC timelines they’re looking at docs that they got after they got my docs. I’m not sure what that means though, like if they’re looking at docs from nov 8 does that mean they’re done looking at docs they received the week before? Im not sure why it’s taking so long… I’m now coming up to 2.5 months total now waiting for DQ, I’m not sure if that’s normal or not… I think I’m just losing my mind a bit. Getting a bit antsy because I was really hoping to be back in the US in Jan or Feb so I can start working again as I have been out of a job for 6mo and can’t apply For many jobs until I’m back on the ground.

(U) As a general rule, an applicant in the United States should apply for a visa at the post in the consular district of the applicant’s last foreign residence. That is the only consular section required to accept the case for processing, although another consular section might do so as a matter of discretion. b. (U) You must, however, accept an IV application from any applicant who is a citizen or a national of the consular district, regardless of the applicant’s last residence abroad, when directed to do so by the Department. c. (U) The assignment of an IV petition to a consular section by the IV processing center in the United States will constitute such a direction by the Department. I think, as usual, it comes down to the person at the consulate on the day.

I’m not sure how to answer this, because there is no specific information on any official website that refers to how people going through consular processing use their residency status to figure out where their consular interview should be. Like many things with USCIS, there are only vague guidelines. You apply in your “home country” but what if your home country has been the USA for the last 5 years? People currently living in the US are able to go through either consular processing OR adjustment of status, but there are no clear guidelines on what, therefore, is your “home country” if you have more than one citizenship. But the IRS and USCIS use the substantial presence test to determine your residency for certain purposes. For example you are a “resident alien” for tax purposes if you’ve been in the country for 183 days or more. USCIS uses the 183 day definition for their continuous presence test when going from Green Card to Citizen.
  10. But I don’t live in Mexico, I’m there for a couple of months on a tourist visa. I don’t have an official address there, or in the UK or in Australia. My address is in Los Angeles where I’ve been living for 3 years. It’s not about wanting to complicate things, my situation is actually complicated. Most people who reside in the US when going through the green card process they do adjustment of status and remain in the US and wait for EAD and travel auth. I happened to lose my nonimmigrant visa at the same time as my I-140 was approved. Can’t remain in US and do AOS, I have to do consular processing. Residency is where you have been for for the majority of the last 12 months and for me that is the US so my lawyer said that my choices are UK or Australia because that’s where I have citizenship. It definitely is not supposed to be Mexico. The question I now have is whether it is supposed to be Australia. But when would that come up? At DQing? At the interview?
  11. I guess I should. I’m just not sure where else I would go as I’m not a resident of Australia or any other country ☹️ I even asked my lawyer if they need a UK address as I could give my friends and they said it’s not necessary
  12. I think if you’re not a resident of the UK you would have to at least be a citizen, as is my case, so perhaps not just anyone can move their case there. I think also because I’m technically a resident of USA (not immigration wise but in the sense it’s been my place of residence for 5 years) and I’m not a currently resident of Australia where I used to live or Mexico where I will be temporarily staying (I’m only going to be there about 3 months and it wouldn’t be enough time to even establish residency there), I have no choice but to go to with my country of citizenship in order to choose a consulate.
  13. I’ve never lived in London, I’m a citizen of the Uk and apparently it’s enough. I triple checked it w my lawyer though, and my friend who is also an immigration attorney. I asked them are you sure it’s okay that I won’t be giving them my UK passport for the stamp, and is it okay that my country of chargeability is Australia even though I’m doing this in London and is it okay that I’m not going to have a UK police check, even though this is in London, because I’ve never lived in London. Apparently all okay 🤷🏼‍♀️ My address is my US address actually.
  14. Oh my lawyer told me I could only do Australia or London which is where I have citizenship. However I still think London is faster than Australia and definitely Mexico which is where I have to bide my time. I’m was doing a police check from Australia as it’s where I grew up and I choose the police check for foreign visa as opposed to immigration / citizenship (I thought it was for Australian citizenship). i was working in the US for 5 years but was laid off in June, literally a week before my I140 was approved phew. Therefore I chose to go consulate route. But that means im just bouncing between my home in LA and Mexico City (it’s close and easy to take my dog) until the GC comes through. But I can’t apply for jobs, unless they’re remote which there aren’t many these days in my field, can’t go back to Australia or London as it’s too far for me to bring my dog, so I’m losing my mind a bit
  15. London is quick, anecdotally speaking, which is why I chose London over Australia (I am a citizen of both countries). I think they just have more staff and resources. At this rate by the time my new certificate is sent in (annoying how we have to mail in and not upload for EB1/EB2) - I’ll hopefully….HOPEFULLY get DQd in the next month and if it goes smoothly, and then I can cross fingers for something in January. That’s how it’s gone anecdotally for london folk so far who have current PDs I imagine Rio is a little more backed up just due to it not being as robust a consulate as London. The wait is stressful, can’t plan anything until we get that IL
  16. I got a note from NVC saying I submitted the wrong police report, which I did, SIGH!!!!!! I guess once I get the new one in a few days it'll have to be snail-mailed back in. This could potentially delay a number of weeks I feel like I want to cry (even though this is my fault haha). I just want an interview date!
  17. No. I think the reply I did get wasn’t an auto reply like I thought, it was saying that they have received mail for my case and I think i just have to wait for the DQ which may just take longer than it has been taking.

  22. Hope so - it was confusing coz they sent me an email saying I hadn’t submitted a DS260 form when I had. I assume it’s just an error on their end. Sigh. Can’t wait for this to all be over!
  23. well I got a reply and all it said was “we have received mail for this case” - didn’t actually refer to my question which about the supposedly missing DS260 🤦🏼‍♀️ I don’t know if this means I’m DQd or what lol - very confusing. But I assume the DS260 is fine.
  24. I will message them. The Public Inquiry Form is best for that right? https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/ask-nvc.html I'm confused because it asks for both petitioner and principal applicant, and I think I'm both on EB1? TY!
  25. I haven't. Docs were submitted end of August, so was waiting on DQ. This is the first correspondence I've had since docs were submitted.
