    I really wouldn’t apply by yourself. I don’t think an EB2 NIW is a DIY application personally, and certainly not if you’ve already had a refusal. But it doesn’t sound like your lawyer put forward a compelling case either. How much experience doing EB2 NIW’s do they have? Happy to share the name of our (excellent) lawyers if it helps - I’m EB1 but I know they do EB2 as well. Just message me if you want their details.

    OK, so there's no 'next step' yet, as there's no visa available for him anyway, his PD isn't current. He just needs to sit tight and wait but it'll be at least another year as a rough guess. https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2023/visa-bulletin-for-july-2023.html And from what you've said he's applied via consular processing, so should expect to be interviewed at his home country consulate when it is current.

    Being scheduled doesn't mean anything if there isn't a visa number available for him, it just means he's in the queue for an interview. But he could still be waiting years yet if his PD isn't current.

    Yes, but the whole section about the petitioner isn’t relevant to you, as you’re self petitioning. That’s for those being sponsored by family etc.

    Not needed. Have you had your welcome letter yet? It tells you what’s needed in that. Worth filling in your timeline by the way, so people can see exactly what stage you’re at.

    Affidavit is not required for employment based apps. Would be worth you finding specific EB2 threads, this one is just for those that submitted their docs to NVC back in April. There’s an EB1/EB2 thread that’s current.

    When can your wife apply for citizenship? Unfortunately permanent residents can't sponsor parents.

    Really odd. So Visa Medicals told you you needed it ahead of your appointment?

    We had our medicals a couple of weeks ago and didn't get given TB jabs. I'm not sure why @NasUK did? It's not even on the list they gave us of possible options for them to give which is odd.

It's updated every Monday so keep an eye on that for an idea of when you'll get DQ'ed if all is correct. HTH, good luck.

    It may not be easier but can certainly be quicker - I don't understand why spousal/fiancee visas can't apply under Premium Processing like employment based IV's can, but it cuts the processing time considerably. Assuming all is ok at our interview in a couple of weeks, our total processing time will be under 6 months for EB1 immigrant visas. Our I-140 was approved in 8 days versus the year or so the I-130 takes for spousal apps. Whether the OP's fiancée qualifies for an employed based IV is another matter though……….

    Another forum I'm on has a timeline thread, seems to be about 4-6 months from interview to passport back. HTH.

    It’s long unfortunately. CR1 applicants DQ’ed in Sept 2021 have just received interview dates for August.
