    You are not getting I-765 based on the I-130 but based on the “ pending I-485”…even though it is concurrently filed.

    The I-765  and category C 09 is based on “ Pending I-485/ IR spouse of USC” is what you need to write in….but since you have already received that advice or have come across it without being convinced…know that ANYTHING you write in is OK…so you can put your mind mildly at ease..

    Intent to get married is perfectly fine and legal. Thousands have come to the US, gotten married and departed to their countries to complete consular processing. What is not allowed is intent to adjust status when you’re coming on a non-immigrant visa.

    There is nothing illegal about having the intent to marry inside the US.  It is illegal to enter the US as a visitor with the intent to stay and adjust status.

    I had a friend do this, I think as long as your intent of your trip wasn't too get married and the CBP is aware of that, then you should be fine. Life happens, things happen. I wish you good luck on your future endeavors!

    You're good as your husband is a USC. I went through the same with my husband last year/this year. Just have a read of the guides on VJ as well as the USCIS guidance for each petition and then file the 485/130 (and also 131/765 for work and potential out of the country travel in case the GC takes forever). It's really not too difficult overall as long as you follow the above.
     
    We got married a few days before my I-94 expired and then filed for everything about 6 weeks later. No lawyer, just meticulously organised everything ourselves. The forum here and also some fb groups and/or reddit are really useful resources in case you do run into any issues - most questions have honestly been answered over and over so you'd be able to search for it, unless you situation is something incredibly specific.

    Some good news: USCIS Announces New Actions to Reduce Backlogs, Expand Premium Processing, and Provide Relief to Work Permit Holders | USCIS
     
    We are about 2.5 months into (since we recieved initial NOA) the same process (ESTA -> AOS) and my wife has already recieved her work permit. We are in the Portland, Oregon jurisdiction. I hope that you two are fortunate enough to have a similiar timeline. It seems that USCIS has seperated the work permit and travel permit and put focus on the work permits. Still no word on the travel permit, our fingers are crossed.

    That makes it sound like you had planned to marry and adjust status……
     
    you will want to educate yourselves on the process of adjusting status, EAD/AP, and the sponsorship requirements.   It will be up to 8 months before you can work or travel, and since your I-94 is expired, you will not be able to get an SSN until you are in status.

    No problem 🙂 Yes, thats true, dont worry at all 🙂 I had one dose for varicella vaccine and got the sealed form. For covid you will need all doses. For other incomplete vaccine, doctor will mark on “insufficient time interval” box. Actually, my doctor marked complete for varicella, I had to tell her to please mark in the “insufficient time interval” box, lol

    You should be fine, things change sometimes! So no worries there.
     
    The HUGE downfall of adjusting status (which is what you are doing now) is that you will not be able to leave the US for 6-9 months (so if there is an emergency 'back home', or a wedding, or even if you get a little homesick, you will not be able to leave) and you will also not be able to work either. 
     
    I know that this may not seem like a big deal now but just be prepared that this can get tough. Wishing you all the best!

    Thank you so much! Yes I heard about that vaccine for Hepatitis B and I called Doctor office where I make an appointment for Medical Exam, they told me that For all vaccines requiring a series, only a single dose is required for immigration purposes, except for the COVID-19 vaccine .So they will give me first one and complete the Form, and I can get the rest later...Hope that's true

    Hi, I submitted I-693 form together with I-485 on June 3rd with the expiration date. USCIS mentions on the instruction that which edition date form can be used so even if the form is expired doesn’t matter. If some officer just randomly sends RFE for the expired form then in that case nobody can’t really do anything, we will have to just send the form again. The form available in USCIS website is the latest form that we can use. For your peace of mind, you can read the instructions and edition date that they mention for the specific form. Don’t worry, you will be fine. Also, Hepatitis B vaccine is now required through 59 years old so if your civil surgeon is unware about the change then you can inform the doctor.

    That is the OMB expiration date, which is internal to the federal government and irrelevant to AOS applicants.  As mentioned above, what matters is the edition date, which can be found on the bottom left corner of the form.  As of today, the latest version of the I-693 is edition 09/13/21.
