Family got a reaction from Pens in VAWA, Part 25
I just looked at the excellent timeline and clear outline of the filings and am wondering if the I-485 receipt ( May 2021 , same day as a court hearing) is perhaps just a 42-B filling since you were IN REMOVAL and could not file w USCIS. https://www.justice.gov/sites/default/files/pages/attachments/2015/07/24/eoir42b.pdf
Though it says “I-485 “ it is not for the $1,225 filing fee and I assume you do not have a copy of completed (I-485/approved or new I-130 / I-864 and supporting docs (?)..not because attorney failed to do /file those ..simply because that is NOT where u were at that stage …link will show what I assume was properly filed.

Your attorney advised you to take Termination and Run.. don’t look a gift horse in the mouth , and good advice.

NOW,  it seems after Termination, you just filed I-765/I-131 and are anxious to travel and expedite..I also assume you DID that without your attorney ( DIY) and are relying on various well wishers advice for next steps.

My 3 cents on YOUR situation is :
Look at your “I-485 Receipt “ and if it is what I described…DO not travel before u fix it….cause IF the I-485 gets denied while u are out…you won’t be allowed back in , no matter how pretty that I-131 looks.
How to fix it will probably take patience:
    1. File a new I-485 w copy of approved or new I-130 , whatever applies to u ALONG w I-765I- 131 / I 864  supporting docs and copy of IJ termination order…after receipts DO THE RECOMMENDED steps by VJ member @Demise to expedite

    2. Prepare I 485 ( include the $1,225 fee or copy of receipt if it was paid )  I 864 forms , along with copies of supporting docs , termination, copies of pending I-765/I-131  and most important copy of previously approved I-130 ..IF that is basis of adjustment… Write Supplemental Filing to Pending I-485 ( from may 2021))))))THEN WAIT before traveling ..cause u don’t want to be out and have a denial

Here is the proof of what I’m talking about. I basically submitted a request on 03/21/2022 saying that approval notice not received, 2 days later I’m approved. But I was actually still in normal processing times.

Never give up. Don’t let anyone tell you that your case won’t be approved, even your lawyer . Fight for your case until you get approved. My case can be an encouragement to someone, I am in immigration proceedings since 2017, got 204 c fraud on my I-130, I-360 office sent me a 7 pages NOID which was my only hope, responded to NOID January 31. I worked on it with my lawyer and provided new proofs and my case is approved  in less than 2 months. Can’t wait to get my green card finally.
Thanks to this forum, many people helped me here how to write a winning personal declaration. Thank you all. To God all the glory Case Was Approved
On March 23, 2022, we approved your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, Receipt Number EACxxxxxxxxxxx. We sent you an approval notice. Yes ..and most people don’t know/remember or have copies of Petitions they have done 15 years back ( let’s say for a brother or sister)…so putting in “ UKN = unknown is perfectly ok.  That applies to every question pretty much.
    Good Luck

A simple, short letter to Atty by certified mail “ I request my file and no longer want you to represent me effective immediately. I am asking you to immediately withdraw your G-28 from my case and provide me with a copy as sent to USCIS..”
    You “ cannot WITHDRAW a G.28 “ , atty has to.
And if you “fire “ your attorney in writing, trust me , he  will pay attention.

    1. USCIS summarily rejected your packet because you were missing the I-129 F approval (?).

    2. Look at the VISA page in your passport..it should have a long number like WACxxxxx .( I believe it is the same number as was your case# on the I-129 F.

    3. Go to USCIS/ CASE status and put in that number. If it works it will say something like “ your I-129 F was approved on xx date. Print that out and put it on top of your packet and you are good to go.

    4.  If #2 fails …call USCIS or NVC and ask for your I-129 F case # , then do step #3 above and you are good to go. No explanation letter by required …

AR-11 to Vermont will not change your address, a written request with a “ safe mailing address “ seems to have worked for some.. but my hands on filing experience was hit or miss and mostly no .

If you no longer want the attorney to get anything and stop representing you , then you need to fire him. You can go in person to their office ( get your file , sign something terminating their services) and ask for a copy of letter they need to send to Vermont USCIS that states they are withdrawing G-28 AND provide your safe address mailing address. You then include a copy of firing your attorney along with your request to get all correspondence to your “ safe mailing address “.

Make sure attorney has your address , in case they still get anything from USCIS.

Your relationship is super documented , no worries there. Since you went to the trouble of adding each other the bank accounts, you can add whatever the bank gave you or a screenshot of online account ownership…but not required  . Most consular spouse case ARE not able to join accounts so do not worry.
A lengthy explanation of why you eloped is not required , you have the right to marry how you chose, so your choice.

I DID NOT see a copy of the Beneficiaries Birth Certificate, and that is required. Include you passport copy
    You are good to go!

If you have previously appeared for an in person interview ( and meet a few other criteria)  w USCIS, then your I-485 can be processed/approved without an interview, without a transfer….. otherwise your case is being sent to your local field office and you will be scheduled.

Family got a reaction from Ada Doan in IR-2 CATEGORY NEED SOMES ADVISE
    CSPA Coverage for Immediate Relatives
Immediate-relative children who were unmarried and under 21 at the time their U.S. citizen parent filed a Form I-130, Petition for Alien Relative, on their behalf are allowed to preserve their immediate relative status upon turning 21. Thus, they will never age out and are still eligible for the immigration benefit for which they applied. Under the prior law, they would have automatically moved into the first-preference category upon turning 21.

As long as you do not marry, you will not “age out”! Your age is “ frozen” so relax and Good Luck,

The airlines provide “ unaccompanied minor service” for a modest fee, so the children can board a flight and be looked after. You can have a relative pick them up on arrival in the Philippines. Listen to RN Jorgedig and give yourself a chance to fight…without delay or great risks of lengthy travel.

It seems you have a copy of your old expired green card and the old 797 Receipt…so the fastest way to renew would be online, pay the fee and print receipt.
Wait for Biometric/ fingerprint appointment ( or notice they’ll use old prints)
Try for an info pass , carry with you your passport,, copy of old green card , new receipt,  Doctors letter showing scheduled treatments , booked airline tickets and insist you require a document acceptable for reentry …usually a little sticker on the old green card.

I do hope you rethink your decision and immediately pick up your joint married life and move in together BEFORE he transitions from Residential to IOP.

Everything you may have “ saved” will probably go to getting some legal rep ASAP.

i wouldn’t recommend going at this on your own . You need help. Even what you consider an innocent/sincere statement “ I moved to save money” is a potential problem .. and could make you look like your in this marriage “ for the wrong reasons.

A good reason would be make  Your Husband’s  Well-being a priority and whatever problems BEFORE his treatment..stop /diminish during treatment. Additionally , treatment protocols involve family , as they have greater success rates.

Again, I hope others chime in and wish you the best of luck.

You go ahead w ur original plan to file I-130 for kids, apply for N-400 ( at same time if you can afford it). I suggested claiming old priority date only as a protection in case your N-400 gets delayed or Visa is not current or goes back..AND I suggested you SMILE and stay strong even though MAN who broke your heart AND seems to multiply faster than bees pollinate …is trying to block your childrens coming here. Good luck w getting custody for them .

That is a good pragmatic “ think outside the box” recommendation. Get to a POE ( by foot via a friendly country , not stuck in airport at the mercy of ..) and they must let you in ( he will prevail cause newborn/ moms health  / COVID and a super star Wife! NO MATTER what they put him through..secondary/ little pressure/ NTA )

I also agree w @milimeloinasmuch as Nairobi seems to only have geographic jurisdiction for Kenya and all others are permanently closed..but they list a phone number , so maybe try calling.

Filing another I-751 from outside and trying to board in an airport STILL puts you at the mercy of …see above).

The last page of the I-485 is blank and allows you to WRITE IN any additional information pertinent to your claimed eligibility. It insures a record is made for any number of issues , same applies to any other form.

I also encourage you to come up with more than just entry/ exit stamps for your physical presence spent back home. Each trip/ stay should have additional documentation of you being in that country

I meant write on the form itself on specified page. And in lieu of multiple cover letters , just do ONE for your packet .
It would really be good if you put effort into doing  a simple List / Contents of your packet:
    *Forms : I-485/ 1-130/….
    * Check for $
    * 2 passport style photos of Applicant and USC Spouse
    * Birth Cert of Applicant
    * US Passport of USC Spouse
    * Marriage Certificate
    * I-94 / passport copy for Applicant’s most recent date of entry ( it will show ur F-1 so don’t load all ur I 20s)
    *** Evidence of Joint Life
List all yout stuff one by one w SHORT DESCRIPTION
    * DMV license for Applicant w shared address
*DMV license for USC Spouse w shared address
    and so forth

*** Evidence of  2 yrs Physical Presence in Other Country after Xxx
