Yes, they kept their original name.

Who knows, maybe he did a bond, eh?

So we should be treated based on our net worth? What's your net worth Mike? I'll need that info before I decide how to treat you.

Someone asked how Drumpf was tied to the immigration process.  The exact timeline is not publicly available info.

    M. Drumpf's parents were given citizenship in 2018.  As her husband, Drumpf was possibly on the I-864 form as part of her household in the LPR process.  "Trump on his federal tax returns declared negative income in 2015, 2016, 2017 and 2020, and that he paid a total of $1,500 in income taxes for the years 2016 and 2017."

Thanks for your thoughts and thanks for reposting.

I originally brought up the bond question because it seemed like an easy way to meet the support requirement.  Some of the other posters did not bother to see the entire video before commenting.  The lawyer does mention that you get the bond back at some point (e.g. like a loan).

There's been deleted posts and other comments, so I'll try to address everything:

    1) It's not a loophole if it is part of immigration rules and regs. It's a way to make things easier.
    2) I bring up Drumpf because whether you like him or not, he is a billionaire and was POTUS.  He has NEGATIVE AGI for many years.  So he would hypothetically have to fill out negative income on his affidavit of support.  Yes, a billionaire can "make less money" and pay less taxes than someone on minimum wage.  So if a billionaire can have negative AGI, so can a mid-level investor, especially a real estate investor.  That's the whole point of investing in real estate.
    3) You could be living abroad as a very successful corporate drone with a high salary - you could be the god-loving CEO of BMW and Tata.  But guess what?  Your US-based income is a big fat ZERO.  So that's what you put down for your income on the I-134.  Yes, less income than minimum wage.
    4) In regards to bringing in destitute people, I don't want to get too much into illegal immigration, but just watch the news to understand the status of our borders.
    5) There are arguments back and forth across this forum on whether asses with zero income would allow you to meet the support reqs.  Some people swear they have done it.  The naysayers have not tried it but swear that won't work.  See #1 - bond would make things easier.

Oh, so this is personal.  How is this a loophole?

I see you got your noa2 in 7 months. The wait time is double that now. You wouldn't want to find a legal way to speed things up?

You should think more and talk less. Keep the negatively to yourself

Lawyer did say in the video to file I-485 as well.  But that still takes time to approve right?  It would have to be approved before the visitor visa expires?

Immigration lawyer advises suing to speed up progress for k1 at the 12 month mark. But USCIS website says waiting time is 15.5 months. Can we really sue at 12 months or is lawyer just drumming up business? May be worth it saving 3.5 months. Backlog just keeps growing.

Lawyer talks about using a bond as a last resort if you can't get a joint sponsor.

The immigration officer handbook mentions this but it's unclear who requests to post the bond, the sponsor or immigration officer.  Has anyone used this?  Seems like an informal kind of deal, there doesn't appear to be any additional forms to fill out.

My first wife was from Colombia and I submitted dozens of pages of chat logs using these terms of endearment -

it’s normal in South America to use such terms of affection even though not real -  on paper 📑

using the term promatida  and promatido   is redundant here in Colombia.  If engaged you are now the esposo in Latino culture.

My first wife visa was approved no problem.

Now I’m waiting on my second K1 visa for my beautiful new wife and our chat logs contain the same words as you used -

mi esposa mi Esposo etc.   Relax - if your fiancée gets asked about it she will tell the immigration officer it’s a normal means of showing affection in Colombia 🇨🇴 Which it is - don’t sweat it ok -

I’ve been there and done that twice now 👌

Hey thanks for chiming in from Memphis!

I want the shortest AOS possible because fiance would not have health insurance until she gets her GC.  No insurance = no pregnancy.

But I know what you mean.  Need to consider other factors before moving.  Memphis is awesome.

She would not qualify for k1 if she marries you before getting the visa. You would have to refile with I-130 because she is no longer your fiance, she has become your wife.

have you filled out this form for waiting times outside the norm?

Verification done by healthcare.gov is different from what you went through with your state health marketplace.  Healthcare.gov will not require SSN (field is present but not mandatory).  But they do require upload of immigration documents from all non-USC applicants.

I know this a bit of an older post so idk if you found your answer, but I was able to create a healthcare.gov marketplace account for my husband and I (I’m the US citizen) once he had a SSN. After that, I was able to purchase us joint health insurance that was actually cheap and pretty amazing coverage because of the tax credits due to marriage and him not having income.  I am also self employed FWIW so this was our only option but it’s worked great. He had healthcare coverage before we ever even applied for AOS!

Also, all you need to get an SSN for her is to take her unexpired I-94 and marriage license after she crosses with her K1 visa. My husband actually got his before marriage even, but you probably would want to go after if she’s changing her last name.

The processing times on the USCIS website, New York City was 19 months when I applied last December, and now 15.5 months.

From start to finish for I-485 adjusting from K1 was only 7 months for us.

My US spouse luckily had insurance with employer and I was able to be added to that before getting green card. If self employed it’s not as simple as that but there are still plans out there, not always cheap. Even if your partner is not yet pregnant and is in the US, health insurance is still a necessity incase it’s needed for something else, otherwise you will find yourself hugely out of pocket. Insurance is expensive but It’ll cost a lot more if it’s needed and she doesn’t have any.

If you do want to wait until GC for pregnancy to get health insurance then of course that is your choice, and hope your petition doesn’t take long to process. Just make sure your case is very clear and organized, that’s all you can do. Every case is different so it’s hard to predict timelines accurately.

    Good luck with your journey!
