    That sucks to hear! I hope it's just a mistake and you don't actually have to fly to Azores...
     
    The doctor I met with in Lisbon was Marta Monteiro at Clínica Campo Grande - Hospital St Louis. The email is clinica@hslouis.pt and their phone number is 210405500.
     
    I don't have the doctor's contact information because we did everything through the clinic's scheduling system. I'd give them a call to ask if the doctor is still working there and is still approved by the embassy.
     
    If that doesn't work, maybe contact the US Embassy in Lisbon as a last resort? Good luck.

    For my IR1 case, I only submitted 1 year of tax transcript and supporting W2s. But I also uploaded 3 of my most recent pay stubs. On the I 864 form I did write down what my income was for the 3 previous yrs, but only submitted my most recent tax transcript.  I was approved by NVC with no issues or delays.

    We got an email on Friday the 14th saying that our case was being actively reviewed by USCIS
    On the 17th USCIS approved our case
    On the 20th NVC has received our case and emailed us!

    To anyone out there doubting - we also had all the "taking longer than expected" and thinking it would take until September but it suddenly all moved so fast!

    You are correct, but as a self employed person, your "current income" (today) comes from the total income line of your 2022 tax return.  Self employment income is not "income" until it appears on that line of a US Federal tax return.  This is because, until then, it is only "revenue".  Income is revenue minus the expenses you claim on your federal tax return.
     
    The the 60k number come from the "total income" line of your 2022 tax return, or just from the 1099?

    Current income matters for W2 employees. 
    Tax returns matter more for self employed workers. 
    As always rules are not hard and fast.

    I would do it anyway.  The petitioner is currently receiving a 1099, so is technically "self employed" not employed.  Gross revenue so far this year, would be irrelevant, as it has not appeared on a tax return yet.  If income from the "total income" line on the tax return (not the 1099) is not sufficient for the 2022 tax return then the income isn't enough.  I realize they have assets, but I would still include the intending immigrant's income an document the transfer to show the income that will continue once they immigrate.

    Yes, if you have proof her income will continue after immigrating, you can include her income if necessary.

    Just as a data point, our NOA 1 was dated 18 AUG 2022 from the Potomac Center. Our receipt number is IOE938.......
     
    Our VJ timeline is estimating the next notice between July and September, 2023.
    uscis.gov processing time says 16 months for 80% of cases complete, which would work out to November-ish.
    Obviously the former would be nice, but we're assuming the latter is far more likely (and even then hoping we're not in the slow 20%).
     
    We were assuming 18 months when we filed so even 16 months is an improvement (though moving from Thailand to Pittsburgh in winter may not be the nicest transition).
    Anyway, we're hanging in there. Stay strong - and good luck everyone.

    Pinching myself to make sure I am not dreaming, but pleased to say we have been approved on 06/24/23. Notice came from Potomac as expected. Case status still shows actively reviewed since 08/04/22, with the approval notice found in the document tab.

    No, the updated number is much more realistic. The previous number was very unrealistic and didn't seem to be based on anything.  Set your expectations for August at earliest so that you're not disappointed, trust me.

    Aug 2022 filer here too. my friend filed in January of 2023 and his case got approved in April.
    I just feel it's unfair. He is a doctor moving back to the US with his wife though. Wonder if it has anything to do with his occupation. h

    I really wish there was a premium processing option for marriage-based cases. I am an immigration attorney but I do mostly business cases, and its a much faster process to green card in some cases.

    Looks like your domicile evidence is OK.  The letter indicating your wife will be employed in the USA, is both domicile evidence, and what you need to state her USA income once transferred as her current income to qualify based on income.

    Hello,
     
    I live abroad with my wife. I work 100% remote for an American company. I filed the FEIE this year. Employment will continue once I move back however I don't know if I could get a letter to that effect. HR is very protectionist. My assets are well over the minimum requirement for sponsoring.

    What do I need to do to: 

    1) Show intent to establish domicile in the US
    2) Make sure my income / assets are sufficient for sponsorship

    Unfortunately, I have a lawyer but the original lawyer I hired who knew about FEIE became a federal judge and transferred the case to someone who's fresh out of law school. 
     
    Any help would be appreciated!!!!

    Unfortunately, she will not be authorized to work for 8-10 months after arriving on the K-1, even remotely.   That is the primary drawback of the K-1.
     
    Sounds like you already know you need a joint sponsor.  You also may want to look into the requirements for AOS, so that you're not blindsided by that.

    For couples already living together, the CR-1 is often the better choice.  Every couple has their own priorities, and each couple must decide which visa is better for their situation.
    K-1        
        More expensive than CR-1    
        Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
        Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)    
        Spouse can not work until she/he receives EAD (approx 6-8 months)    
        Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
        Spouse will not receive Green Card for many months after Adjustment of Status is filed.
        A denied K-1 is sent back to USCIS to expire
      
    CR-1
        Less expensive than K-1    
        No Adjustment of Status(I-485, I-131, I-765) required.    
        Spouse can immediately travel outside the US    
        Spouse is authorized to work immediately upon arrival.    
        Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
        Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
        Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

    I had read it and wanted to clarify on my Tax Documents since I would be "self-employed" up until I am in the US.

    Thank you also for that document talking about the inability to work... we are looking into it as our situation juuust changed.

    @Boiler Our situation juuuust changed right now as the K1-Visa interview was approved yesterday after applying 1 year ago with USCIS. We were both students at the time. I just so happened to get a job based in the US in this last month, and she just so happened to get accepted for a position with her company also.

    Is there another recommendation that you have? Or a reason the K1 visa is not the option to go?

    Anyways - we have just gotten a bit lost recently as things have taken so long and our situation as changed.

    Joint Sponsor seems a good idea in your circumstances, sounds like you are currently self employed.

    It does wonders to know you aren't alone in something, though I am so sorry for everyone else dealing with this situation & lack of contact from the U.S. Embassy in Paris. My fiancé had his interview nearly 3 months ago, and they took his passport & everything and were just waiting on the medical exam (which arrived no more than two weeks after his interview). We haven't heard anything from the Embassy since, though our case did get updated the other week to "Refused" for administrative processing (side note: who in the world decided to lump cases still undergoing admin processing in with the "refusal" category?!)
