I would suggest you find a well-qualified joint sponsor.

TheAmelie reacted to powerpuff in How long did it take you to get an interview after rescheduling?
It’s good that your husband went to the field office. Otherwise they would have denied the case for no show

Rescheduling wait really depends on the field office and how busy they are. It could take a few months, hopefully less for you. Congrats on the baby!!

Just simply inform them that you are now married and thus no longer eligible for K-1.

Better to inform then so they don't waste hours working on the case when they could be working on someone else's.

Hours?  That's funny 😄 😆 🤣   you mean 1 minute.....  because,  the OP asked about notifying the embassy, which means the uscis has already approved.

At the embassy phase,  nobody touches the file unless an application is made.  No application,  no further work on the file.

Actually might cause more work by contacting them.

Thank you so much. I saw your replies on different topics about this kind of situation and I see you have a knowledge. Could you tell me what are the reasons people get denied at GC interview? Is there anything I should be worried in our situation?

Yes. You only need to send a copy to USCIS. Never send original unless asked. USCIS doesn't send anything back, hence the need to use copies

Until they fix the return, the total income on it is 44k. The 864 doesn't ask how much money he made last year, it asks what the Total Income line on the return shows.

USCIS is not going to ask IRS if the number is correct (which would be correct, since it was his mistake). They are only going to compare what you wrote on the form and what's on the transcript you gave them.

Let’s be honest, applying for a k1 visa is not a safe spot either. I’m on many k1 visa groups and I saw denials of visas or AoS after coming to the US on k1. I still remember some post that a man from Guatemala or Honduras, not sure which one, got denied AoS after coming on k1 because the officer didn’t believe the relationship was real, I saw people going to the interview and being denied for some reasons you wouldn’t think it’s a reason to be denied but turns out they couldn’t get this visa. We applied for k1 last December and there is no end in sight, I came here to visit my fiancé and his family an we’ve been talking about all our options. Also, I wouldn’t be so sure about Biden changing things right away, he has more important things to care about first. Travel ban might stay in place  till we all get vaccinated. We don’t know anything.

Im very thankful for all the VJ members who assured me that’s totally fine to adjust status after being literally roasted by some extremely rude people on Facebook.

Yes, but an informed decision is based on relevant facts not legally baseless fear mongering spread by the USCIS misinformation line.

That is the thing, every couple has to make their own decisions.  Not everyone can drop everything, move around the world and spend several months waiting for the slow USCIS processes.  Alternatively, people should be aware of all their legal options which is why a service like VJ with many experienced members have researched and witnessed the process.  Immigration in general is stressful especially when it is family based and deals with immediate relatives.  The simple fact is that immigration lawyers and USCIS phone reps are not the end all of the information out there.

Ask that attorney how many people have been denied adjustment of status or "booted out of the country" for applying for adjustment of status after entering the US via ESTA.  I have seen exactly ZERO here since 2016.  I'd say the risks are basically non-existent. In fact, the subject just doesn't come up during the interview.  There are many members here who have entered via ESTA and later successfully adjusted status after a change in circumstances.
It is true that adjustment is not allowed after entering via ESTA.....except it does not apply to immediate relatives of US citizens.

Im in the same boat too! Married after entering on ESTA visiting as a tourist and later changed our plans due to the current pandemic. We had even had a grant of satisfactory departure before we decided to change our plans as I wasn't feel well enough to travel. We also had pending K1's. Completely understand the stress and anxiety .. I know there's at least one friend on here that has felt my panic!!😂

I received my NOA's and feel a whole lot better as we filed after i94 expired. You guys and this website has definitely helped me from having a compete mental breakdown!! lol.

You can't fly directly. You have to go to unrestricted country (e.g. Mexico, Croatia, Serbia, Turkey, South Korea, etc.) for 14 days before attempting US entry.

If the fiance(e) entered the US with a K1 visa, they must marry before I-94 expires so the USC spouse won't need to submit an I-130 petition along with the I-485.

If they entered using ESTA then decide later to marry and adjust status, their spouse will need to file I-130 along with the I-485 regardless of when they get married.  Even so, it is still recommended to marry and file I-485 before I-94 expires, to minimize the time of unauthorized stay (i.e. reduce the risk of getting in trouble with ICE).
