    My wife’s AOS green card (k-1) interview was November 1st in Philadelphia, PA. The Interview only lasted maybe 15 minutes. It went well I think. The Lady said that we would have an answer in 30-60 days. We are on 80 days. We’ve emailed them and all they said is that they will check and we haven’t heard anything back. So frustrating and stressful. 
     
    we are all waiting. So I’m just curious whose in the same boat as me? Let me know how long you have been waiting and what location you interviewed at.

    If they told you to wait 30-60 days thn you should wait, it’s normal. I know people who waited like two months and they were approved and keep checking your status. The approved my case in a day, it also depends where are you living.

    IOs can't approve unless it ends up being a supervisor who interviews you.
    IOs will say they have approved you but they do not have the authority. They can only recommend you for approval.
    GC approval and issuance can take up to 120 days.

    Doesn't have to be a certified translator.  As long as someone knows the second language and can translate everything. You will be fine.

    I just followed the same format of my original BC. And put the certification in the bottom. The USCIS website has an example of this certification.

    My fiancé arrived on a k-1 visa. We got married within the 90 days but we are about to submit our I-485 for adjustment of status after the 90 days. Is she unlawfully staying?? I’m asking because I’m the AOS form. There’s a question that says “Have you ever violated the terms or conditions of your non immigrant status???

    The answer to that is technically "Yes" but answering "No" is not an issue since it's not a material misrepresentation.

    A pending I-485 would result in a period of stay authorized by the Secretary of Homeland Security.

    Overall, since you married within 90 days, and are now filing the AOS you are not violating the terms of the K1 visa.  There is no time limit to submit the AOS, and any overstay is forgiven for spouses of USC.

    Marriage certificate shows the name before the marriage, because that's what you must write on the marriage license. Some states allow the couple to write down the new name on the marriage license, but most don't have that. So she can literally sign with her new name and give her new name everywhere.
     
    Like Jorge dig said. There's no process to change the name besides filling out a marriage license and getting married. That's the name change document.
     
    Everything else you mentioned should be called UPDATING the name, on the IDs/SSC/job system, etc.

    There is no separate "name change" process (i.e. in the courts), when the change comes about via marriage.   The marriage certificate serves as the document for changing her name with agencies such as SSA, DMV, etc. 
     
    Yes, the marriage certificate shows her maiden name, but it also shows your surname.
     
    And yes, for the AOS forms (and any other), she simply uses her new name, and the marriage certificate serves as evidence.

    Her legal name change source document is the marriage certificate..  If she already has a Social Security card in her maiden name, then she will have to go to the SS office later.

    My wife arrived in november 2019 and we married within 90 days and sent AOS in august 2020. You should be fine if you marry in the 90 days as long as the immigrant is not caught between the end of the 90 days and receiving the NOA for the AOS. Obviously it is not advised because if the immigrant is caught (let's say pulled over in a car while driver is speeding or a similar situation) and has to prove identity or immigration status it could end badly for them. We never got pulled over or in trouble and stayed home for most of it and we are adjusting her status right now. My recommendation is to send off AOS asap, but don't stress too much and stay home and out of trouble as much as possible. The AOS paperwork was very difficult for us and we were confused about its requirements and dealing with many personal issues and COVID measures coming into place so ours took longer than it should have to send off.

    We have seen people submit the day after the 90 day limit up to a year and have not had a problem. I suggest you move this along to completion as soon as you have all your documents together for your final package. Be sure to make copies of everything before sending it off. BTW, you can send a copy of the marriage certificate whereupon have the original available at your AOS interview.

    Hi guys. Since the last time I was on here my fiancé arrived from Panama  and we are coming to the end of our 90 days. We were planning a big wedding but with covid back on the rise and my family getting hit with the big C. we were forced to change plans. Now we have only a week left for our 90 days. We are getting married in 2 days on Saturday 01/16/2021. Our 90 days is over on 01/23/2021. I’m assuming that we need a copy of our marriage certificate when filing for adjustment of status. I also know that it may take about 2 weeks to get our marriage certificate back in the mail. Will the USCIS give us a hard time since we are applying for the
    I-485(adjustment of status) after our 90 days???  Any info will help. Thank you

    They will have a copy of the I-129F in front of the CO officer either before or during the actual interview.

    As others have said, its not required, but its useful to have your own copies.
     
    You definitely need to start keeping good records of this sort of thing. I kept paper copies and electronic ones (in drop box). As you go through the immigration process there are times when you need to keep track of what you've sent previously - eg at interview they may ask you to bring originals of any copies you sent, etc. Life is much easier to keep all of this efficiently filed - avoids lots of problems and worries later. I imagine its also useful if you get an RFE - at least you can see exactly what you submitted.

    Yes. That question in relation to K visas is odd. It's more apt for other nonimmigrant visas. K visas are some of very few nonimmigrant visas that allow the traveler to have intention to stay indefinitely.

    Did you already fill out the DS-160? You have to provide the passport number, date of issuance and expiration. If you haven't filled it out yet, you are fine. 
     
    However, if you have already filled it out, you will need to submit a new one.
