You could ask your senator or congressman to follow up with USCIS if they received it. USCIS doesn't give any acknowledgement for RFEs aside the status getting updated on their website and sometimes that just doesn't go through either.

    Hello everyone,
Remember my i485 was denied because the officer said I didn’t properly file the waiver and didn’t submit the i601 receipt notice with a receipt number on it as per RFE. The fact is that I submitted the i601 waiver package and it got returned with a notice saying
« your application /petition is being returned as it is not needed at this moment »,
I sent that notice to the local office but apparently the officer ignored it or didn’t receive it while making decision on my petition . I submit a motion to reconsider last April, and yesterday I decided to go to the local office with an INFOPASS appointment to explain my situation. The supervisor came, I explained to her the situation and she took the proofs of the notice from uscis saying my application was returned and don’t need a waiver and proof of mailing it to the officer. She went inside and after 15min she came out and told me they have assigned my case to an officer for review, hoping I get approved now🙏🏾.

    1. Yes, card generally gets printed first.
    2. Few weeks, mine took like 3 months between the C31 getting issued and the approval letter getting sent out.
    3. Honestly, don't bother renewing it if you have a C09. But if you really want to you fill out I-765 and include a copy of the I-360 approval notice.
    4. Yes, hence why you shouldn't bother with it and just keep renewing the C09.
    5. NJ. Who your congressman is depends on your actual physical address, not the address of your lawyer.
    6. You can send a letter to the service center or field office that currently has your case telling them that you wish to fire your lawyer and any correspondence from USCIS should go to your physical address at [address] and you designate this as your safe mailing address under VAWA.
    7. No. Interviews and jurisdiction gets assigned depending on where you physically live, it's not uncommon to have a lawyer in a different state handling your case and it'd make no sense for USCIS to schedule you for an interview in NYC if you live in California but the lawyer's in NYC.

Hello everyone. Hope everyone is doing well? My VAWA has been pending since August 2018 and I never received an Rfe. I am having issues with my lawyer and I need your help. The agreement with her for the entire VAWA package is $5500, of which I have paid. She is so arrogant, lackadaisical and not helpful at all. My EAD is expiring in March, I informed her about it in September 2020 and completed the I-765 form, only to be informed by her that her office will charge $400 for administrative fee to process a renewal for EAD. Mind you, this is my 3rd EAD card I am requesting for. I thought they had processed it only to call them up yesterday and the lady I spoke with said they had not processed it because I have not paid the $400. Can you imagine, they have taken me 3 months behind because of their greed.

This platform has given me some sort of independence and determination. Reading from real life experience and how the community has come together to assist has given me the “I can do it myself” mindset. I am now determined to do it myself, but I do not have the receipt notice for the I-485. Please can I renew my EAD without the I-485 receipt notice? I have just written to lawyer requesting for copies of all my immigration documents, but if she doesn’t respond, is there a way I can request for all the notices from USCIS. Can I renew my EAD without submitting the notice for the I-485.
    @sandranj @Stillwinning!!!😊 @Demise
Please anyone that has gone through this experience should kindly share their thoughts.

    Thank you.

    Hello fam,
I finally received a notification that my i360 was approved!!!!!!!!
I don't even know if what I'm feeling is relief or excitement. It has been such a long, frustrating wait and I owe my sanity to all of you on here. Thank you so much.
    My timeline is as follows:
    Nov 2017 - i130, i485, i765
    Nov 2018 - i360
    May 2020 - i360 RFE received
    July 2020 - RFE sent
    Aug 2020 - EAD produced
    Sep 2020 - i360 approved
I know I have to request a transfer of my i485 to my local NJ office, but the problem is I can't find my i485 receipt notice.
    My questions are as follows:
    1. Can I request for a duplicate i485 receipt notice? If yes, how?
    2. If no, what are my options?
    3. How do I request for my existing i485 application to be linked to my i360 and transferred to my local NJ office? Just by sending a letter to Vermont office?
    4. What documents do I need to send to USCIS now that my i360 has been approved, to proceed with my green card application?
Thank you for all your advice as always.

    Hi everyone

So I decided to proceed with my request about I-485 status update with the congressman and sent them whatever USCIS asked to release info about my case. In a couple hours, we got a response from USCIS and they basically said my file was waiting in queue for interview. And today I got a letter from my local USCIS Office and I was in tears for 10 minutes. Interview Letter for October 22nd. I can’t wait to close this period of my life which has been full of worries. I was thinking it would take at least another 6-12 months for an interview. I was in shock with this letter. I’m wondering if contacting my congressman made it any quicker because the letter was sent just after my congressman reached out to them but who knows.

The idea of being free of all these worries....being free free.....finally having the freedom to move in case I want/need to because I have been avoiding it so that my mailing with USCIS wouldn’t be affected, etc etc etc. I haven’t even got a Greencard yet but it’s so f***ing close and I can’t wait for it. I wanna drink until I loose my consciousness even though I’m not a heavy drinker. Feelings... and more feelings....that’s been suppressed for so long now. Hardest time of my life so far....is about to be over. I just can’t believe I got this letter today. My feelings are all mixed together 🙈

Now I’m asking you to share with me how you guys prepared for your interview. What documents did you take with you? I don’t have a lawyer so I’ll be on my own. Please if someone has a checklist or the list you made before your interview....I’ll greatly appreciate 🙏🙏🙏 @sandranj @Stillwinning!!!😊 @Shroy123 @Claudia16049

Any VJ family member....please share your experience with me 😊🙈🤞🥰🤗

    TIMELINE:
    *July 2018 ........ I-360, I-485, I-765, I-131 filed all together
*(I’ll skip EAD and AP approvals and renewals, I don’t remember them)
    *January 2020 ........ I-360 approved
*June 2020 ...... RFE with I-485 from NBC (birth certificate), I sent my response in the same month
*September 2020 Interview letter for October 22, 2020

Ah yes the VAWA privacy protections, you know, the thing that is supposed to protect you from your abuser snooping around is instead used to make case inquiries burdensome.

Basically you cannot request information regarding a VAWA case online or over the phone. Either your lawyer has to write to the VSC (attach G-28 for good measure), or your congressman/senator has to write to the VSC (they have to get a signed release form under the Privacy Act of 1974 in order to be able to inquire), or you yourself have to write to the VSC to ask what's taking so long.

What's interesting is that when I did a FOIA for my entire A-file the entire VAWA case was there with relatively few redactions (initial I-360, RFE response, and some internal documents like the rubric they use for prima facie determinations) and yeah I submitted that thing online.
  23. Thanks

Hahaha I have received like 4 letters from my dear friend Laura. She probably knows me by now.

Anyways. This letter means Vawa petitioners would only get information about their cases through the following:

    1. your attorney if you have one
    2. your senator if you inquire through him/her
    3. You if you (1) don’t have attorney, and (2) you WRITE A LETTER to Vermont

Just make sure you sign the letter with same signature you gave in your case submission form.

  24. Thanks

Ok so Im going to give you some basic information about the process and hopefully things will make more sense. The 485 is a form one would use to adjust status (get a greencard). In order to file the 485 you need what they call an underlying form that makes you eligible. Otherwise people could just randomly send in the 485 and get GC. Obviously thats not how the US immigration system works. GCs are not just given to anyone who asks.

In a spouse based case- you would file the 130 as your underlying form. The 130 established you have a marriage that qualifies for immigration benefits (get a GC) . You can then adjust status (get your GC) using 485 based on 130.

For VAWA you file the 360. The 360 establishes you are a victim of abuse and can self petition. You can then use 485 based on 360 to get your GC.

So you have 2 separate cases going. One is the 130/485 and the other is the 360/485. Sometimes people transfer the 485 from the 130/485 to the 360/485. Based on what you posted you filed a second 485 with your 360 on 8/18 right? You should have different case numbers for each 485. Make sure to keep organized. Remember these are 2 separate case processes you have going on. They can impact each other indirectly.

For your 130/485.: You filed 3/17, had an interview 1/18 and in 3/20 they approved the 130 and are reviewing your 485 (based on 130).
For your 360/485:  You filed 8/18 and did biometrics on 9/18, it also seems you filed 765 EAD with the 360/485 right?

If so, You should withdraw your 485 (the 485 attached to the 130/485 filing) since you have a 485 already filed with your 360/485 package. You can have 2 processes going on at the same time but at some point the 130/485 case has to be closed out. You do not want them to deny your 485 (from the 130/485) and send you to removal proceedings. They may be holding your 485 (from the 130/485 package) because you have a pending VAWA- or you could ask them to hold it, but its probably better to just withdraw it. As long as your EAD is based on the 485 filed with your 360/485 package it will remain valid. (Im honestly not sure if they would send you to removal with a 360/485 pending though- so just to be safe I would withdraw the 485 from the 130/485 filing)   If your attny wont help you withdraw the 485 from the 130/485 package since they did not file it for you, you can send a letter asking to withdraw it yourself. Make sure you are using the correct case number for the 485 you want to withdraw and you can include a copy of your 360/485 NOAs letting them know you filed for VAWA and its pending.
