You can always apply, nobody can prevent you from doing it.
You can use the argument it was a temporary trip.
It's hard to tell how IO will rule it out.
I really hope it won’t be a problem. Thank you!

I can apply for citizenship based on 3 year rule but I just realized last year I went to my home country to visit my family after almost 4 years of not seeing them and I brought my 3 year old son along so everybody could meet him. Unfortunately my husband wasn’t able to come because he started his dream job and definitely couldn’t request time off. I know you have to live in marital union to apply based on marriage and now I’m worried this will look like for these almost two months we didn’t see each other. Obviously my address in the states stayed the same, I was even getting some packages and letters, me and my husband were calling and texting, we have a home together and our toddler. Just not sure if IO would be weird about this in this weird times. To me it’s just looks like a family visit or vacation but I’m not sure how they would feel about this.

I agree with @TBoneTX recommendations. Yes, at the N400 they will review your entire immigration history, and there should be a note there from your AOS interview, and you can repeat the explanation at the N400 interview. You should be fine as the I129F was most likely sent back to USCIS at some point and has long since expired.
Good Luck!
Thank you very much! I’m worried they overlooked it at my green card interview because we never officially withdrew the i129f and it expired on its own. I’m scared they will see it as 2 pending cases even though supposedly i129f is null and void after getting married

Thread is moved from the K-1 Process forum to the Removing Conditions forum -- OP is at that stage.
Your reasoning obviously satisfied the USCIS officer, and it's in your file. Proactively volunteer this information during your ROC interview and ASK whether it's a problem. It sounds like it is not, because otherwise you'd never have been granted your first green card.
Thank you for your answer. But also I’ve heard that they “dig deeper” during citizenship process so that makes me feel stressed

We had pending k1 visa during covid times but embassy was closed so it was stuck at NVC stage. Later on I came to the US to visit my partner for holidays and while I was here our circumstances changed and we got married. During my green card interview the officer did ask about if we filed for k1 in the past and we answered truthfully. I got my green card and now I have pending ROC and I’m eligible for citizenship but I’m worried it will look bad we never officially withdrew k1 and it just expired. Would that cause issues? Really don’t like political climate now and it’s stressing me out

I had the exact opposite experience. I found the N400 interview to be a very pleasant experience and felt that they wanted me to become a citizen as well.
Problem with the information age is that positive articles do not sell ads so they are not popular. And most people post online because the run into issues not because everything went according to plan.
Thank you! I’m just worrying about the fact that we never withdrew our k1 and it just expired on its own

I’m eligible to apply for citizenship based on marriage. I got my GC back in 2022 after adjusting status from ESTA. My case is a bit different because me and my husband had K1 pending at that time. In 2020 embassies were closed and k1 was not being processed for awhile. I decided to go and visit my husband (back then fiance) on ESTA. Our k1 was at NVC at that time. During my stay the circumstances changed and we decided to get married and file for AOS. My gc was approved and during the interview the officer did ask how I entered the states and if we had k1 pending. That was it and no more questions. Am I in the clear? All these articles about ICE and arrests stress me out and I keep delaying my application.
Also we have a son together, house and tons of things with both our names. Of course it’s a genuine marriage.
When I entered on ESTA, the CBP officer did ask what the purpose of my stay is and I said I’m visiting my finance and his family, he said ok and to have a good time. That was it. I never misrepresented myself.
also we never officially withdrew the K1, I was told that it will expire on its own. Would that cause any issues?
I’ve been seeing so many posts and articles how they screen you throughly for citizenship and they’re literally trying to find anything so your n400 won’t be approved

We are filling concurrently,
I also got I-693 deficiency notice

Hi guys!
Our PD is 12th of JanGot letter for biometrics 1st of March
Biometrics 19th of March
Case is ready to be scheduled for an interview- 20th of April
still no EAD and AP
Our local office is Houston so I’m sure it will take long to have the interview lol at least I prepared myself for a long wait 😂
-
Did you already realize that they’re reopening just for students? Yes I was happpy and excited too but no anymore. My friend called US embassy in Warsaw, Poland today, woman was extremely grumpy and she said that k1 is under the proclamation from March ( this about travel ban). She even said it might not be processed till end of the year (does she know how long the ban will be on?). The thing I’m trying to say is don’t get too excited. Most of embassies is only reopening for students. Sorry for negativity but after 4 months of being positive I am done
anyways I’m very happy for New Zealand as far as I see they’re reopening for everyone.
but embassies in banned countries can only dream about that

Heyyy guys don’t be so pessimistic. We also waiting our interview in Warsaw, but I live in Belarus. Will be soon 2 years since we married, CR1 visa. For us it’s more frustrating. I heard that embassy in Ukraine started reschedule interview for spouses. So I really hope we will get good news from them soon. Be positive! 🙏🏼🙏🏼🙏🏼
I’ll have my K1 interview in Warsaw too!
let’s hope they’ll open soon.
they canceled June appointments, and new appointments are possible starting July 20th. I know a girl she has her k1 interview the 23rd of July. Let’s hope they won’t cancel July appointments -

I feel like this is a play from the Trump administration to limit immigration by all means necessary. They want the country open, but Visa's are on hold indefinitely. My fiances interview was scheduled April 13. They canceled and still nothing from the embassy about rescheduling. We would have been married by now. Now we all just sit and wait. I am furious. I made sure all the paperwork was perfect and he was tracking to be here in a little less then 6 months until this happened.
That’s what I was thinking too. Now it’s the best time and reason to suspend immigration and play with our feelings.
we were planing our wedding in August, eh 😩

I know immigration is not a right but what about trying to get the press to talk about the emotional trauma the whole uncertainty of not knowing when we will be with our loved ones is causing. The fiancee visa is supposedly an expediate visa but now we are left in limbo. At least, those pursing the spousal visa can visit. What is the great difference between them and us? I really am at a loss of ideas, but I think we need to try anything at least. Maybe a front page article on an important newspaper. A joint letter of K1 petitioners to the white house? I know I may sound ridiculous, the feeling of despair is very stressful.
I extremely agree with the emotional trauma. Uncertainty is taking over. It’s been harsh on mental health.

I guess it’s time to talk to my fiancé about moving to Europe. We’ll stay here in Poland or Ireland till next year when things start moving forward. He is down for this too.
Immigration to the US sucks a lot but now it just sucks entire energy out of me. I just want to be with him and go through this uncertainty together.
or let’s create a petition about finally taking care of us fiancés

I think the issue is the airports are not allowing international flights. Like if a visa is granted and there are no flights out what is the point. My personal opinion once the international flight begin to happen in your country the embassy opening will follow soon after... just my personal opinion..
Poland just opened the borders, flights resume tomorrow within EU countries. My guess is that we are banned so I can dream about embassy open anytime soon. There will be second wave and we won’t be able to have interview and finally be with our fiancés. Nobody cares about us and that’s it. Sounds pessimistic because it looks pessimistic

The islamabad website has no updates 😭😭 . They should just check temperatures and let them in ! When do you think good news will come ?
That’s what I’m saying, checking temperature, consul behind the glass and we are all set. I just think they like complicating and playing with people’s lives.

Guys do you have any guesses on when they might open? Am I the only one who thinks this is just enough?
Like it’s just so hard for them to put consul behind the glass and don’t make him touch anything without glows, also before entering they can check the temperature of applicants. This is way better than affecting so many people’s lives and also having a backlog. I understand they protect workers, but it can’t be like that. We have preschools and nurseries open, borders as well but of course embassy is just something different.

The DOS has published it reopen plan. Consulate operations are not until phase 3. To the best of my knowledge, nobody is at phase 3 yet
I didn’t find this info anywhere. Could you please share the link?
is it about phases of easing the restrictions in each country? -
