    Each state requires residents to have  in state DL .. usually within 10-30 days of moving there. You should have done this when you moved. Do it now. Follow the information given to you by the IO..

    Do not confuse the “acceptance” of the lodged documents with the “approval” of the documents and application. The clerical worker who processed your application and documentation does no more than verify that you have 
        sent a readable photo of a   drivers        
                        licence
        signed everything
         sent the required paperwork 
         paid the correct fee. 
     
    They do not evaluate the contents. Only the field officer who is assigned your case will do that .. and they do it in preparation for you scheduled interview. 
     
    It is the applicants responsibility to ensure their application is fully compliant with requirements.

    you cannot enter the US without visa stamping. That is the whole purpose of visa stamp. it is an entry ticket. Also if the child mother does not have custody, the child no longer has h4 status.

    1. Indian embassies are known to be somewhat tough
    2. I know the kid is only 8, but what if he's put in administrative processing for several months? I'm not aware of age restrictions for admin processing....

    they think
     
    1) you are a potential immigrant to USA and will never leave US. if your entire family in US, there is a good chance you will never leave USA 
    2) they think you lied to them during visa application
     
    if the above 2 changes than you can try getting a waiver

    Correct. Age < 18 are considered as children and will be derivate of you when you submit their info with your n-400 application

    Interview can last 5 minutes or it can last 5 hours. There's no way of knowing ahead.
     
    You maybe interviewed together or separately.
     
    You can be asked many questions or just a couple.
     
    You may be asked to show IDs, passports, evidence.
     
    Nobody can tell you what exactly is going to happen.
     
    But briefly:
    - You'll get invited to come in
    - You'll swear to tell the truth
    - You'll be invited to sit down
    - Officer will be typing / clicking a lot on the computer, and periodically ask questions about personal details, relationship etc.
     
    You may get a decision instantly, on the same day or some other day. You may get RFE for more evidence. There's no way of knowing.
     
    Most importantly, give short and straight answers to any questions. If you can answer "yes" or "no" answer it like that instead of lengthy statements. If you don't remember or don't know the answer, don't guess or invent the answer. If you don't understand the question, ask to rephrase it or say you don't understand. Do not tell stories etc unless asked to. Do not try to predict why question is asked and modify the answer to create some narrative, just answer the question itself. Do not try to control the interview or fill the gaps of silence. There may be a lot of silence between questions asked, that's normal.

    Expect questions on how you met, how you got married and how you're living together since getting married. You may also get asked personal details about each other and extended families to show that you have a real relationship.

    Expunge doesn't work for US immigration. It has to be declared.

    No I-751 that's Removal of Conditions. They need to file:

    1. I-130
    2. I-485
    3. I-765
    4. I-864
    5. I-131 (optional)

    Okay so zero percent of this was clear from your initial post.   It's not our fault if we can’t understand a poorly-explained story with jokes in it.
     
    You were denied entry for immigrant intent.   You will need to develop stronger ties do Canada if you want to be admitted to the U.S.  
     
    With a history of illegal crossings (into either country), that will be challenging.

    fly to Spain
    Get married in Spain and come back to usa
    File for CR1 visa. It will take 12-18 months 
    She gets her CR1 visa .
    She lands in USA and becomes a green card holder/permanent resident on the day of arrival on US soil
     
    ESTA can be tried but as long as she tells the CBP / Border patrol the truth that she is entered the country to get married and adjust status .

    Give her the divorce.
    File i-751 with divorce waiver. As long as you entered marriage in good faith, you should have no issues
     
    On other hand dont mess with uscis , it will haunt decades later. Always stay honest with the intentions, you have nothing to be fearful

    Actively Reviewed, unfortunately means the opposite most of the times.
     
    You can file WoM yourself if you wish, but it's not the easiest thing to pull off.
     
    Here's instruction:
    The filing fees are just over $400. If you file with a lawyer this means paying about $5000 in legal fees on top.

    if the consulate is not interview, i dont see a WOM value. if you file is being punted by NVC and consulate and delaying your case, i see value in filing WOM.

    You should count 4 years and 1 day since you came back from your last trip that laster over 6 months.
