I need help Bringing my husband to the United states

Hi people, I need some guidelines pls. I am a GC holder in the United States and I recently just got married last December.
 

My husband lives in Europe(CZech republic) and is a student doing his masters, almost rounding up and is thinking of doing his PHD in the US because we thought about me filing for him and It’d take more than 2yrs before he comes into the country.

 

We’ve been together for 3yrs and we re tired of being separated from each other, we are looking for ways to be together.

 

My question is, should we go ahead and start the filing process or should we go ahead and look for schools in the US for PhD before starting the filing process? Is it going to be complicated if I we start filing before he gets a school for PHD?
 

He went for an interview in December in order to attend a conference in Jan and got denied because he was told he didn’t have strong ties in CZech. He has a stable job and is also a student. I don’t want us to make mistakes that’s why I’m asking. Please somebody help. I have until 2026 before I become a citizen. Thank you in Advance.

He will likely be denied for an F-1 for immigrant intent.   You should petition him.   It will take many years.

Do you mean it would take many years for the petitioning if we go through that route or?

The OP is a LPR, not USC unfortunately.

That is going to be a looong time.

 

F1 could definitely be tricky but the only way of finding out is to apply, one of the things he will need to do on hos application is to declare is his US Spouse.

 

Presumably he can show adequate financial resources? I tend to think of CZ as a cheaper option, US is the opposite.

 

Presumably he declared you as his spouse on his B application?

It will be longer for you but yes a US US citizen is quicker, when can you naturalise?

Can you throw more light on this? Are you saying it’ll take so long to petition for my husband even after I become a citizen?

I am saying that likely quickest route will be for you to naturalise and upgrade your petition.

 Being married you have changed your marital staus.

 

No need to change your last name, purely a personal choice, I did not.

Thank you so much, you’ve been really helpful. Do you know the first thing I have to do in order to start the process? Do I need a lawyer? Sorry I’m asking too many questions. What’s the first thing I have to do?
