Older children and citizenship applications

Timeline

Forgive me if this is somewhere on the site but I haven't been able to locate it so far.

 

My understanding is that each of my four children here will need to submit their own N 400s with the possible exception of my daughter who is under 18 - almost 15. The others are 18, 21 and 23. So though they are listed in my filing we need to submit one for each of the older ones. Is that correct? Will my daughter be considered under mine?

 

Any help appreciated!

Yes, the children over 18 will need to file their own N400.  You 15 yr old daughter will gain citizenship under you when you finalize your oath and get your naturalization certificate.  After you get your certificate you can apply for a US passport book and card for yourself and your minor daughter, and you may want to consider also filing an N600 for her to obtain her own naturalization certificate (she will not get one at your oath ceremony).  Your other children will all get their own certificates as they will be naturalizing as adults.

Which part?  Over 18 and the 5 year rule?  Yes.  They are not considered derivatives of their mother after 18 and have to follow the general qualification and processing path. 

 

The 3 year rule is dependent on the continuation of the marriage that brought the beneficiary to the US in the first place.  

 

Minors who obtain citizenship as derivatives gain it by whichever way the parent did (3 year or 5 year filing).  The rule here is that the parent actually files and obtains citizenship.
