    Hello,

NVC is requesting the Petitioner's forms W-2/1099 while those forms are inapplicable to his work condition, which is already clear in the petitioner's uploaded taxes.

We called NVC and they told us to upload a letter to the CEAC account explaining why those forms are inapplicable. But of course if we do that, we will be pushed to the back of the line and restart the waiting period for NVC to review the case again.

Does anybody know another way to communicate this to NVC instead of uploading a letter and wait until they stumble upon in as they re-review the case after two months? . . . doesn't sound like an efficient way to communicate.

    Thanx for reading.

Is it inapplicable bc the beneficiary lives and works abroad?

Like Hilde, I have never received an email of confirmation.

When I follow your instructions, Arshia, I have only the option to print - but it prints only the whole form, there is nowhere "confirmation"... 🤔

I did what @Arshia suggested and it worked. I clicked on the COMPLETED link of the DS260 and then clicked  REVIEW and went all the wy to the end (to confirmation). Then it gave me options to print and email the confirmation.

Also, I was searching MY email (I am the petitioner) and couldn´t find it. But then I realized that they send the confirmation email to the benefiary... So you can search that inbox too maybe.

    Good luck!

Hi Guys! Regarding the public charge issue; I’m currently a student doing my masters so don’t have a stable or income at all. I have a joint sponsor however whose proving for AOS. Does he need to submit his W-2s and tax return transcripts both? I’m concerned as I Being the petitioner am a student with no income at the moment. Thanks guys!

The fact that you are a student and getting a high degree is valuable as it shows employability. I would attach your Bachelor´s diploma and a school letter stating you are enrolled in a Master´s program. This shows that you are more likely to be employed than someone who has no education. (I am assuming you are the beneficiary - as the Public Charge rules applies to the beneficiary only).

Hi I’m working with NVC. I am having hard time submitting the documents, it states that they are uploaded and some are accepted but why am I having hard time submitting them? When I hit the submit it don’t do anything.

Some people who have this problem say you must wait around 2-5 minutes for "submit" to go through. Others say to switch browsers.

    Interesting. Thank you :)

Are there any other required documents that are not listed on the NVC info pages?

I was under the assumption (based on the guide there) that we need

    - Birth certificate

    - Marriage certificate

    - Divorce certificate of prior marriages (if applicable)

    - Passport biographic data page

    - Police certificate

    Military certificate, if applicable.

I already have evidence, as in pictures, etc to proof that we are legally married. I just meant with my regular life here.

I believe the USCIS considers legal documents more proof of marriage than photographs.

With your regular life I cannot make suggestions, but usually when people get married, they change insurance documents to married status and I am not sure what work things you are referring to but it cannot hurt to do so.

The fact that you file taxes as married is good proof.

I already filled my taxes before going to ghana to herh married, I mean after I got back from Ghana, do I have to change my status at work to married, do I have to change my insurance and stuff to married?

Any document that you have that states you are married is positive proof that you are infact married.

I also don´t see why you wouldn´t do this anyway...

I just sent out the I-130, i just want to ask and make sure as to if i am supposed to change anything here in the states, as in should i change my status here at work or al my legal documents to married or what exactly am i supposed to do?

    Any help will be appreciated.

You will need to show proof of bonafide marriage. So all legal documents that state you are married are legal documents that show you are married.

I would definitely start with taxes though. Filing it under Married.

Hiii VJ people! probably a stupid question but did you guys submit 2 passport photos side by side or 1 photo (for beneficiary)? I have a file with 2 photos side by side (the way they print out) and I also cut it in half to only have 1 pic.  which one to upload ? thanks

I submitted 1 photo in PDF format. I had read somewhere that JPEG images can get inadvertently rotated upon upload. I didn´t want to risk it, so I did PDF.

    Hilde is right.

As for me, regarding the PART 5 "your education and skills", I ticked "Yes" for "have you graduated high school..." (I have my 2 diploma from Highschool (baccalaureat) and university.)

And "No" for "Do you have any occupational skills".

I don't remember at what stage it was, either USCIS or NVC, but at some point, we had to specify the work we have been doing and for how long. So they have all those infos already (right?).

    Take care :)

    Alix

@Alix64 if you have a university degree, I would consider this as an occupational skill. You can prove this by showing your diploma.

If you happen to have any licenses (for example, a lawyer´s license or a healthcare professional license) this would be even extra.

I still can't decide on this... 🤦‍♀ I just checked the DS 5540 and I don't think I can have it ready soon. I have a lot of questions about it; like do they also consider the line of work of the beneficiary or is it enough that you have a work experience? I was a government employee in my country and just resigned last February to focus on this whole process and on my family. And of course, I don't expect to get the same work in the US. My worries is that they might ask me what other jobs I can do when I get there, I mean I know my capabilities and what other things I can do, but then again I don't have a proof on that since I was stucked doing the same job for 4 years. 🤷‍♀

I believe you can submit copy of diplomas and certificates that show that you are qualified to perform a specific kind of work. Any kind of training that you had that you could continue doing in the US.

Hi everyone. May i ask who are affected by this new ds-5540? We filed aug 2019 are we affected by this? And my wife is a usc.  Thank you for the response.

I see it on the dropdown menu of "Additional Documents" under the DS-260 form.

Since it´s under Additional Documents, I don´t think it´s necessaritly mandatory for this stage. However, I imagine they will definitely ask for it in the interview. So I would suggest sending it along with the DS-260.

Where does it actually state it has to be uploaded to CEAC? My portal doesn’t have any mention of the document and to be honest I wouldn’t even be aware of this document if I wasn’t on VJ! I’m not opposed to uploading it I’m just curious what source has instructed applicants to upload to NVC aswell as bring to interview?!

    Thanks

I see it on the dropdown menu of the DS-260 Civil Documents section.

Hi guys, all of it is a bit confusing. I'm doing a lot of research but I still have some unresolved questions regarding this new DS-5540 form and I hope you can help me with that?

I’m a beneficiary of CR1 visa currently living abroad and I never worked in US. So what I should write in part 4 of the DS-5540 form, since it asks about U.S. federal tax and IRS transcript? Should I put 0 (never worked in US), or enter my income I earned in my country for the past 3 tax years?

Another question about the insurance after I enter the US: will the tourist insurance be sufficient?

I would write it in the comments box that you did not file taxes bc you did not work in the US. So that would justify your "no" answer - that you did not file USA taxes.

As for insurance: I´ve been reading for people to get insurance quotes - with the beneficiary´s name. That way it shows that you can get that insurance upon arrival.

I submitted the AOS and IV fee last night. I checked the “Visa status check” on the ceac website today and it says that “NVC has received your fees and you need to fill the DS-260”, however when I log onto my account on the ceac website it says that the fees is still “in process”. Anyone else facing a similar issue/knows what to do about this?

I can take up to a week for them to process your payment. When it is processed, the DS260 will become available. I think mine took 4 days.

I worked in Singapore for 10 months as an expat, but NVC still asked me for a police certificate from there. I know it's a hassle, but I think it's best to secure police clearances from places you've been in for 6+ months even if the website says it's only applicable for 12-month+ stays. Better to have submitted those than risk them being reasons for RFEs. Just my two cents.

@AarLar - everything I've seen said 6 months or more after the age of 16. But honestly, things change and you're better doing some more digging. The good news is that after filling out your list of addresses on the DS260 form, they will automatically generate a list of civil documents needed. They will specify there which police reports you need. For me, it said: POLICE REPORT (BRAZIL).

I am not sure what the procedure to obtain one in the UAE is, but maybe try to request it online just to have it. If you need it, then you will already have it.

Hi I am a bit confused. I was born in the Netherlands, then moved to Norway for 3 years, then dubai for 10 months and then back in the Netherlands. I know I need the Police certificate for Norway and the Netherlands, but I do need it for Dubai as well?

    Thanks!

If you lived somewhere for more than 6 months after the age of 16, then you need a police report.
