  1. Phnom Penh has greatly reduced flights coming and going (like many other places), but they are running. My husband and I left Phnom Penh last night to the US. We had several flights with EVA airlines cancelled over the last month and a half due to Taipei restricting all transit flights, so we gave up that route and went through Korea. Good Luck 

  2. I just want to give some hope with a CR1 and overcoming an interview with a forceful CO. We went the K1 route and withdrew our application to get married in my husband’s country (where I have been living for the past 8 years) and make our life in his country. A few months later some things changed with my employer and we ended up having to file CR1 to change our plans to move to the USA. Very long story short, during the interview I was present and the CO continued to tell my husband that he looked like someone who had applied for a visa before and accused him of lying. She was very forceful and threatened lifetime ban 4 or 5 times. He continued to be steady while I was a wreck inside. We told her that we applied for the K1 in 2017 but nothing else. She accused him of looking like someone who applied with someone else before that. We knew this wasn’t the case because over the last year he gained a significant amount of weight from stress and he doesn’t even look like the same skinny guy that I was with over the last 5 years. She said that he looked like someone else and took his fingerprints a second time. When seeing that they didn’t match, again, she finally let up and said we were approved. We leave for the USA next week.

     

    Before our interview, we could hear her interviewing another man, the American wife was not present, she also accused him of lying about the timing of his wedding ceremony (he told her they had 2 ceremonies) and he wasn’t able to overcome it and she sent him away with a request for more evidence and DNA tests. 
     

    Spend as much time together as possible, go over the petition again and again with your husband and make sure that he knows the exact details before the interview so if they are forceful he doesn’t get flustered and can answer honestly with confidence. She CO didn’t care about any evidence that we brought or photos either. She actually laughed at one of our evidence. She just asked questions very quickly and didn’t even give a moment to answer completely before asking the next one. I don’t know if every interview is like this but prepare your husband for this kind of interview and he’ll be ready if it’s like this again or an easier one where the CO tries to build rapport and understand the relationship.

    Our attorney uploaded one to the NVC that we originally filled out when we submitted our I130 in August 2018. This had only my taxes from 2017 and earlier. I decided that I wanted to make sure that they got the full picture of the last 2 years since my petition had been sitting in Nebraska for a year and my attorney didn’t believe that it was relevant to submit a new form, only to have one with me in case they asked. I don’t like to sit and wait to see if someone wants something, I would rather send it ahead. So, if your documents are as old as mine is, it’s probably a good idea to redo it, if not, it’s up to you. The October 2019 version is the most recent.

    Yes, the financial documents under the petitioner/sponsor optional documents click on the little link that says add a new document. It will let you select the i864, W2, paystubs and the tax returns all separately and you can write an explanation about why you’re uploading new things. I figured I wanted to make the embassy’s job as easy as possible.

    Yes, the attorney was dumb and uploaded the original i864 that they sent with our I130 petition in 2018 so it only had 2017 taxes done on it. They kept telling me you don’t need a new one but I wanted to be as prepared as possible and I made a new one myself and uploaded it. The NVC sent a notice that my income was insufficient but it’s much more than the minimum so I think it was the old documents and not the new ones. I told them that I am not a fan of the wait and see approach. I would rather give more than I need to give than to be sent home and asked to upload something, but that’s just me, I don’t know the exact right or wrong way. I just wanted to be more in control of what they could see ahead of our interview. 

     

    His visa was ISSUED today and updated online. We have an appointment to go to pick it up next Friday March 13.

    Did they ask you about the DS5500? And what type of health insurance will your husband be eligible for when he enters the US? Most research i have done says employers wont add the foreign spouse until he immigrates to the U.S. first....

    Our attorney said don’t upload and see what they say at the interview. I’m not a fan of the wait and see approach and didn’t want to be sent home to

    upload. They thanked us for uploading. They didn’t want proof of anything, she said I’ve got it all here. They never even asked about taxes W2 or money in general. Never mentioned the DS5540. Now, if something had not been acceptable I’m sure that they would have brought it up. 
     

    I’ve been living overseas so we’ve had a global policy that covers everywhere. It’s with Aetna. I also uploaded proof of the quotes that we got for permanent coverage in the USA which we will get within 2 weeks of his arrival. Arrive by 15th and it’s covered on 1st of the following month. That’s when this other policy would expire anyways. 
     

    generic questions - Where did you meet. Tell me about his family. Why didn’t you have a big wedding. Are you having a wedding in USA? Why not? Tell me about the NGO that you work for. What is his job now? He goes to church? Do you speak his language? (Haha my whole family does even though we aren’t from here weve all worked here before my parents have been here since 1999) They asked about our age gap (I’m older by 10 years) His passport photos triggered some kind of facial recognition to some other person and she kept asking him again and again if he ever applied for a visa before and if he is lying right now. She kept threatening lifetime ban. We withdrew our K-1 in early 2017 and had been open about on all our documents and at the interview, but this was some other guy completely. She checked his fingerprints a second time and confirmed it wasn’t him. 
     

    Overall it was alright. We sure weren’t expecting the grilling on him looking like somebody else. 

  7. We interviewed today. I went along with my husband. I uploaded the DS5540 into CEAC for my husband this weekend and I asked if they needed the original, was told no because it’s in the system now. Approved. No questions on health insurance, but proof was also uploaded with the DS5540. We are 250% of poverty line so I’m not sure if that was a factor or not. My husband has a job offer letter that we also included. I think each case is going to be different.

Like many have said - healthcare.gov select your qualifying life event, usually this is moving to a new location, and do not follow the options for subsidy calculation, just look at full price plans for your zip code. There will be many different plans available. It’s a really simple and intuitive site. I checked the companies and plans on this website and then contacted the health insurance company directly to see if they had less expensive options of going direct to them. I was told by the company that we chose that we had to arrive in the US and apply for the policy by the 15th of the month for coverage to start the first of the following month. They said to apply without a SSN and add it within 60 days. 
     

    I printed the name and extension of the lady that I spoke with, the plan details and prices and will give to my husband to show at his interview.


    I’ve been out of the US for the last 8 years and this is how I’m planning to get the health insurance as my employer doesn’t offer coverage.

    It is definitely possible to add a non-resident alien spouse to a bank account. Check with your bank’s rules and process. I added my husband to my US bank accounts back before we started this whole process. They wanted copies of his passport since he had never stepped foot in the US and didn’t have any alien or social security numbers. The US based bank sent the signature cards and we signed in front of a public notary and we sent them back to the bank. 
     

    He’s been added to my credit cards as an authorized user and we applied for a joint apartment lease application remotely too. 
     

    Just be open and ask your bank, landlord, credit cards, etc how the process works. 

  10. Not just a story, at this point I’ll be out a lot of money, including out of a job if I don’t go back! My son already left last year to go back and it would be near impossible for me to get him

    back here with me after he’s tasted being back in the US. 


    Don’t forget to upload the proof to go along with the steps you’ve taken. 
     

    You can also try calling the NVC and see if you can speak with a supervisor to see what it is that you’re lacking if you’re unable to provide more documents. 

  11. One more thing, when I wrote the letter I added a bulleted list of the things that had done to prove that I was making concrete steps. I had always kept my driver license and my mailing address so I didn’t add that info. I added new things that showed I was working on going back just like I had to do things or make changes in my life to move myself and my son overseas 8 years ago. 
     

    Oh, and the supporting documents to prove it. :)

    Thank you for your reply. Unfortunately I am self employed, showing a job will be difficult for me. I used my parents to Joint sponsor the financial portion, so far they have not rejected that part. We also do not have any kids. 

     

    Do you remember how long it took for them to view your document support? It's really disheartening if we truly end up back at the end of the line after waiting 8 weeks to say "give us more info"

    It took from November 27-January 27. 
    I uploaded as much as I could possibly think of to show that I was making concrete steps to prove that I was moving back to the US. 

     

  13. I am the US Citizen currently living and working overseas and petitioning for my spouse. 
     

    I sent these to the NVC

     

    letter from my US based employer stating that my job is transferring me to the US 

     

    my son’s US school registration forms

     

    bank statements from the last few months with US based bank and US address. 
     

    letter signed that I will be returning to the US concurrently with my spouse when his visa is approved 

     

    application and approval with deposit confirmation for an apartment in the US with both mine and my spouse’s names

    for keeping domicile and establishing domicile 

     

    I was DQ this week with the exception of my Income, the NVC said they could not make a determination on my income and will forward to the embassy for the decision to approve or reject.

    Ah, thank you for the clarification! I never thought keeping the same job would be so complicated. I thought it would simplify things! Our category is CR 1

    1st review - no problem 

    2nd review - not enough income .. 

     

    they first ask additional documents on the 01/21 and finally DQ , all documents accepted  on 01/23 . 

     

    all of that is odd but I give up trying to understand how it works lol 

     

    Well, at least we are in this boat together! The income is far above the minimum and I have official letters from my employer explaining the job transfer. I guess the NVC just knows how to handle petitioners that live and work in the US. I didn’t realize that this kind of life was an odd situation til today. Haha!

    finally , it happened !!!

     

    they said the same for my husband income even if we transmitted his tax transcripts +his Va income and we are doing more than 125% of the minimum required .  The embassy will take the decision.

    Did they label his AOS as incomplete with the explanation that it will be the Embassy decision? It’s all so odd to me. 

  17. After lurking for a few months, we finally get to join this thread! 
     

    Received DQ today along with another email that said to check status. When logging into the CEAC my affidavit of support showed incomplete. The messages and the website would not load details, it would log me off the website when I checked, so with the help of my mom, FaceTime and speakerphone, we called the NVC. The rep said that because my income was foreign, they weren’t able to make a decision on it, even though it will continue in the US as my company is transferring me back. The NVC is giving it to the Embassy to decide on if it’s acceptable. It should be, I’m way over the minimum requirements. I submitted this proof of continued income with all of the other financial documents. The rep said don’t upload any more documents because it could delay things, on their side of things everything said complete. 
     

    Has anyone else had this same experience? 
     

    531 days waiting, my son’s 15th birthday is today! What a great birthday gift that we are closer to being together again!

  18. Anyone else CEAC not working? I received 2 emails from from the NVC one says Document Qualified, the other, sent a minute later, says to login and check the messages. I have logged in and see incomplete under my AOS, but when I click on it to see what is the problem it gives me an Application Error and kicks me out of the site. When I click on messages, nothing loads. 

     

    I tried it on 2 devices, 2 internet browsers. My attorney’s office gets the same errors. 
     

    Tried calling NVC and can’t get through. Guess I’ll try again tonight. Anyone have an overseas calling app that’s better than Skype? This is costing a fortune to call and get the automated message and call dropped. 
     

    At least they drank their coffee this morning, but the web tech people went a little

    overboard and broke everything. lol. If you don’t laugh, you’ll cry.
