Proof of relationship - paper, digital?
JeanneAdil replied to thewildeguys's topic in K-1 Fiance(e) Visa Process & Procedures
Store for yourself you can not submit it on digital devices (USB or CD) to USCIS Not on all chats submit some from beginning of relationship and some recent (paper only) Best to send proof of meetings in person (like photos of 2 of you and some family) Time spent together is important Provide copy of boarding pass is better than itinerary as itinerary does not show u actually traveled -
It was the proper form to file and lawyer should have fully explained this Form I-130, Petition for Alien Relative, is the first step to apply for adjustment of status for a K-1 visa holder and apply for a Green Card. Adjustment of status is a process that allows people in the United States to apply for permanent resident status without returning to their home country for visa processing

864 requested at interview
JeanneAdil replied to Uzma555's topic in Bringing Family Members of US Citizens to America
Many countries what the hard copy for embassy interview you already sent to CEAC / doesn't help to send again the bene needs it to submit to embassy as embassy needs to see wet signature -
Some reasons for a 214(b) denial include: The applicant didn't show enough ties to their home country The applicant didn't show that they'd return after their visit The applicant didn't show that they'd have a temporary stay in the U.S. The applicant didn't show enough proof of funding the trip The applicant gave inaccurate information on their DS160 form its up to the person to prove this to CO And its not unproffessional to deny a single person with stronger ties to leave their country than stay there especially when you helped with the form and had to sign your name as preparer

yes, 3 hours as actually landing time is one thing and then there is 20 minutes to taxi to terminal Atlanta is now going thru afternoon thunderstorms and u may even be circling (forever) while waiting to land Actual lines for immigration there move easily along but u are good to give yourself 4 hours I always give myself 3 If this has connected flight to domestic, you have to catch the airport shuttle to domestic terminal and that is a long ride

many have mentioned supporting her family You need to understand that u r not just marrying her / you are marrying a family and family expects certain things You can apply anytime for the K1 with more visits in the future between now and interview /1 visit for 1 week is lame and meeting where at age 15 or 16? Do u fully understand the income levels u need to sponsor? Add to that additional travel to strengthen the case and the cost of marriage and AOS

Getting Through CBP
JeanneAdil replied to valinor's topic in K-1 Fiance(e) Visa Process & Procedures
CBP may check her luggage as she's coming from Peru (country with high rate of drug smuggling) /Even i was checked and i am a USC Senior citizen coming back after visiting Machu Picchu she is coming in on a legal US visa questions would be simple ones "address of where she will live in US" and "will she marry" she does not have to answer in English but can speak in her language/most officers in Miami speak Spanish this should be rather easy for her -
when a person is already not in their home country , it is fairly reasonable they are showing possibility of immigrant intent (not wanting to be in home ) And understand that Nigeria is on the new list of 36 countries that may be added to the ban to add to the denial BTW when you title it "why did I get refused?" not why did she get refused, it is basically understandable that a CO believed she had immigrant intent to come and marry and stay which is visa fraud
-
Yes, he has proposed the next 36 countries so K1 would be on hold till ban is lifted spouse visa is best way to go as it is exempt from ban and yes, wait time for each step of the process is long Nigeria has a long queue for interview for either visa

Administrative processing
JeanneAdil replied to Marty1's topic in General Immigration-Related Discussion
I would suspect a long AP while the case undergoes extra security checks as, like us, you are an African country add that, to your work experience will require some checks And understand that jobs are limited to u (even with extensive experience) until you become a USC -
All social media you use

Do u meet the poverty guidelines for income? How much time together? does her family approve? Can you afford health care insurance for her? Can you afford the over $2000 for her to adjust her status after arrival in the US? Are either of you students with promise of a good future job? would you be able to supply a joint sponsor for the income?

What visa type ? What embassy? -
Congratulations on the new baby to be born Very unlikely she will be approved for tourist visa as the I 130 shows immigrant intent when she returns to India the wait time for tourist visa interview in India is 8 months or longer depending on which embassy she applys to so your baby will be born in India when applying for the spouse visa , baby will also need I 130 as you are not a USC to be able to pass citzenship to the child but apply for the wife ASAP for consulate interview and let USCIS know when you naturalize Best to your family
