  1. According to what is considered NIV K1 is also that so are they included in all this vetting? NIVs are also issued to government officials, treaty traders and treaty investors, exchange visitors, temporary workers, and fiancées of U.S. citizens. https://2021-2025.state.gov/wp-content/uploads/2024/06/NIV-CA-PIA-Public-Facing-Site.pdf\ and on the site for stats of issued visas , the are under NIV monthly non immigrant visa https://travel.state.gov/content/travel/en/legal/visa-law0/visa-statistics.html
  2. you will need joint sponsor / immigration is not good as accepting assets as seen here on VJ
  3. Certificate should be given at ceremony as he will need to surrender the green card
  4. It does not work as child is not living with her nor has lived with her for 6 months of 2024 Basically she is not providing housing , food and the essentials for care of your child even if she sends money to support u and the baby the baby is not living in her home in 2024
  5. you just married (3/17/25) under the k1/K2 so she has no green card yet and you shouldn't wait for the green card to enroll her You have no plan at work to add wife? Issues with medicaid and CHIP is they are for low income families and you need to have 125% of poverty level income for the AOS process Several companies like Blue Cross. Blue Shield, CIGNA, AETNA offer family plans
  6. child born in 2024 or real recent -2025? The child mother is not in USA from reading thru past post ? so, how would the future MIL claim the baby in UK CBRA, yes, as u already know but To claim a child as a dependent, that child had to live with you for over half the year. If the child did not live with you at all during the year, it is typically the case that the custodial parent is entitled to claim that child as a dependent instead. when you get to interview at embassy, the most current tax returns will be taken (to interview ) with W2's and I 134 joint sponsor the same I 134 just for any other VJ'ers January executive order paused any I 134a (if that was ever used for K1)
  7. to help with our visa , I added Adil onto house with a quick claim deed at cost here in TN of $15 filing at clerk's office (typed it myself by copying the deed from when i closed on the house)/ did not add him to mortgage as that can only be done with remortgage steps and i didn't want to pay new closing costs. do all the above and add giving each other POA in case one is unable to function BTW quitclaim deeds are generally valid and used in all 50 states for transferring property ownership, but the specific requirements and procedures can vary by state
  8. when u presented the 601a for a waiver for overstay , was this because u did on your own or the CO said you could do this? February interview and the time to investigate the 601 to verify information You are just 1 of thousands the embassy deals with each month Example in January Casa issued 1916 Non immigrant visas and 597 immigrant visas this does not include the # of those denied or in AP like you It just puts your case in "stuck waiting mode" while the requests from other sources come back in so a decision can be made and the CO deals with all the new interviews for March Its rough, I know, but its the work load that you deal with now
  9. i would apply for state ID to change name it has a section for non citizens https://www.alea.gov/dps/driver-license/license-and-id-cards
  10. it is there on page 6 under provide information on beneficary's spouse and children (2 spaces for spouse and 3 for children) and general instructions say to add any additional info on part 9
  11. When Trump implemented the 1st ban in 2017 , it stated Department of Homeland Security had 60 days to investigate the countires listed and write a report . the Dept found it impossible to complete and this happened Except for the extent to which it was blocked by various courts, it was in effect from January 27, 2017, until March 6, 2017, when it was superseded by Executive Order 13780, a second order sharing the title "Protecting the Nation from Foreign Terrorist Entry into the United States". After which covid interfered and the Department did the following Form DS-5535, the supplemental questionnaire for visa applicants, was implemented by the Department of State in 2020 and is used for applicants who require additional scrutiny related to terrorism or national security concerns. New proposal: Ten countries whose citizens will be limited from entering but not entirely banned, meaning they are required to have specific visas, were on the “orange” list. People of Belarus, Eritrea, Haiti, Laos, Myanmar, Pakistan, Russia, Sierra Leone, South Sudan and Turkmenistan will have to sit for in-person interviews to obtain a visa, the outlet reported. so , i would think, and that is only my thinking, the interview will happen and the Pakistan citizen will be filling out the ds 5535 with a long wait for the security checking to be competed.
  12. Are you a single man that would cause the CO to suspect you intend to marry here and remain in the USA? Have you traveled in your work to countries that have known terrorist cells? These are the 2 things that make for the ds 5535 and extra security vetting and yes, Casa does not make sense when approving some tourist visas my MIL applied when Adil was just a LPR of US and we could not have done AOS for her to stay so no reason to think she would not return home they did approve it when he became a USC and now we could have her stay under the AOS petition Please let us know if the ds 5535 checking is done by August and the outcome please let us know denied or issued a visa
  13. https://trumpwhitehouse.archives.gov/presidential-actions/executive-order-protecting-nation-foreign-terrorist-entry-united-states-2/ Read thru the entire 1st ban executive order 13769 each case is decided on such Case-by-case waivers could be appropriate in circumstances such as the following: and a waiver applys to (iv) the foreign national seeks to enter the United States to visit or reside with a close family member (e.g., a spouse, child, or parent) who is a United States citizen, lawful permanent resident, or alien lawfully admitted on a valid nonimmigrant visa, and the denial of entry during the suspension period would cause undue hardship; your country in the orange group Countries in the "orange" category would affect immigrant, tourist and student visas, with some exception. The list consists of Belarus, Eritrea, Haiti, Laos, Myanmar, Pakistan, Russia, Sierra Leone, South Sudan and Turkmenistan. It stands out as a farce to anyone who listens to what he says as he reports these people will have to interview !!! Does he not know they all interview and go thru security checks. He really has no idea about the immigration process/ I am sure his wife and former wife had all their work done for the process of AOS by a lawyer who didn't get any info from him
  14. you are not taking all that we say seriously my wife applied in 2009 for K1 for me we were denied and she came to Moroc and we married and she applied in 2010 for spouse visa we were denied again and she made 3 more trips (10 months total) before we were approved in 2015 she also added me to tax returns as we were married and a lot of other things to prove our relationship was real We, here, are all very serious and our answers are from experience /not meant to offend but in honest, very honest , answers to your question according to the country (embassy) you go thru and issues people have had in the past but if your wife is not willing to help you by meeting you again, there is not much we can do to help
  15. Has your USC wife filed the petition for spouse? If not , why? If she has not applied, she needs to visit (at least once a year during her vacation time like she did when she came to marry) if she was free to take time from work to meet u, she can do the same now to strengthen your relationship If she cares to learn what she needs to do, please have her come online here in VJ Advice here in VJ is honest to let all know the hardships of being apart and what needs to be done for immigration My wife got me here by making several trips to Moroc and spending time with me and family it took us 6 years to get my visa
  16. Are you a USC or LPR? 1. USCIS step -apply with I 130 for spouse 2. NVC -pay the 2 fees and submit the I 864 (125% income according to poverty guidelines) and ds 260 (spouse fills this out to apply for a visa) 3. interview in Morocco with ORIGINALS of all supporting documents submitted to USCIS and NVC
  17. US Embassy and interview are run under US laws and same sex marriage is legal here
  18. You must spend 2 years living in China supporting this child (as an orphan) as adoption is done by China laws and even then it may not satisfy Immigration for the US laws China's Central Authority for Adoption Affairs (CCAA), as mandated by the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption, governs the intercountry adoption of Chinese children, ensuring all adoptions adhere to Chinese law and Hague Convention requirements.
  19. this is vital as it will be up to her to submit proof of a real relationship and a bona fida marriage (which it doesn't appear to be the case) she is the one who has not traveled frequently to spend time with u which can not be explained by the comment "can not get time off work" we have vacation time every year -the norm is 2 weeks off Too many red flags 1. vast age difference 2. cultural differences 3. How about education differences and social backgrounds? 3. religions of both? 4. Secret wedding/ keeping this from either family? 5. Woman is past the age to bear children /which is expected in Nigeria 6. Marriage soon after you met The ones in bold we already know about
  20. Seems you are lucky, it is being considered at all According to USCIS site https://www.uscis.gov/citizenship/learn-about-citizenship/naturalization-ceremonies If you cannot attend your scheduled naturalization ceremony, return the notice, Form N-445, Notice of Naturalization Oath Ceremony, to your local USCIS office, along with a letter requesting a new date and explaining why you cannot attend the scheduled naturalization ceremony. Failing to appear more than once for your naturalization ceremony may lead to a denial of your application.
  21. K 4 for child -the child needs I 130 also with all the fees that go with it children are not derivatives of spouse visa
  22. To get a Canada visa from India, you'll need to meet requirements such as having a valid passport, showing proof of funds, and having a clean criminal record. You may also need to provide biometric information.
  23. yes, could be red flag issues under the following there is secret marriage along with cultural differences sorry did not know this issue about the family not knowing when addressing other post https://www.nolo.com/legal-encyclopedia/red-flags-that-make-uscis-suspect-marriage-fraud.html
  24. 1st if you and spouse have prepared good solid evidence of the relationship and have spent quality time together, there is no reason to stress over this Stress symptoms can affect your body, your thoughts and feelings, and your behavior. Knowing common stress symptoms can help you manage them. Stress that's not dealt with can lead to many health problems, such as high blood pressure, heart disease, stroke, obesity and diabetes the following activities will help control the stress Get regular physical activity on most days of the week. Practice relaxation techniques. Try deep breathing, meditation, yoga, tai chi or massage. Keep a sense of humor. Spend time with family and friends (my add talk online and encourage each other while waiting . this is suppose to be a time of romance) Set aside time for hobbies. Read a book, listen to music or go for a walk. Schedule time for your passions. Write in a journal. Get enough sleep. Eat a healthy, balanced diet. Stay away from tobacco and alcohol use, and use of illegal substances. there is a good site that tells red flag issues but mostly the immigrant needs to know every little and big thing about the USC during interview, keep your answers short and do not elaborate by going into long detail, and don't let the interview stress u out bless u both
