For information NVC assigns a case number for the embassy only and sends the case onward when embassy requests NVC does not process K1 If u know case # , you are set at NVC waiting for them to forward to consulate -
the G5 is nonimmigrant same as tourist visa You will follow the steps for her to AOS as now married to USC file the forms as listed on following site https://www.uscis.gov/green-card/green-card-processes-and-procedures/adjustment-of-status

Me too, dely the case at NVC Case can be kept open a year just write and let them know to dely interview You need to notify them once a month (according to a notice i received for my case ) short note with case #, both names and both DOB's to say , please continue to keep my case open you will also need to send notice in January that you are ready for interview

Only if the surgery can wait for a visa and she is allowed to travel and if you can show you can afford to pay as health care here is expensive and you have consulted a dr with the documents to show her issue If she needs surgery, don't make her wait Usually when dr says surgery is required , he means "lets do it now" -
yes, you can appeal anything to do now? No, this is a long process after a denial You need to wait for the NOID to arrive back in the USA (about 6 months) I filed my own appeal but i knew how to do this myself so i only paid the $110 fee (fee in 2011) If you can not write in legal terms , you need an attorney but only after the NOID is in your hands The appeal took a year and even though it said "marriage is bona fide " visa was not approved / it said i could reapply If i had known this , i would have saved time and just reapplied I suggest after the NOID from the US office is sent to you , you either respond to the query with actual proof the CO is wrong when i say actual proof if it says she does not want to live here , print out former dated emails or dated chats with her talking about long range plans to live and study in US you need to respond to each reason for denial with actual proof that the CO was mistaken not just "she wants to live here " You need to respond to these in both appeal if you decide to do it or answering the NOID or sending new petition I suggest you make sure IRS returns are joint and you file the W7 with this years returns if you haven't already gotten her ITIN and you start show commingling of finances to strengthen your case
