  1. US doesn't even transfer from state to state recently know a person who had DUI in NYS but TN has no record of this and doesn't care
  2. valid visa means embassy cleared u/ CBP shouldn't ask but all your luggage goes thru xray clearance
  3. page 13 of 1040 instructions You and your spouse can also choose to file as U.S. residents for the entire year if both of you are U.S. citizens or residents at the end of the year and either (or both) of you were a nonresident at the beginning of the year (the dual-status spouse(s)). You can only make this choice for 1 year, and it does not apply to any future years. https://www.irs.gov/pub/irs-pdf/i1040gi.pdf even if u were nonresident alien you can file MFJ when married by end of December the change IRS made on this is the following section which only allows a USC to claim nonresident alien spouse for 1 year (if the spouse is still out of the US) u are here so that section is not for u but it is for those who will need to file MFS if spouse is not here after the 1st year of filing as married/this affects those of us who wait years to get spouse here .in the past we were able to claim spouse (if an alien ) for all years

  5. His visa expires October 2025, He went awall while docked in cali. What can we do to get a visa while he is here He needs to leave ASAP He is here illegally
  6. Crewmember Visa Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for temporary stay, or an immigrant visa for permanent residence. Crewmember (D) visas are nonimmigrant visas for persons working onboard commercial sea vessels or international airlines in the United States, providing services required for normal operation and intending to depart the United States on the same vessel or any other vessel within 29 days. https://www.uscis.gov/visit-the-united-states/change-my-nonimmigrant-status You may not apply to change your nonimmigrant status if you were admitted to the United States in the following categories (unless you are applying for T nonimmigrant status or petitioning for U nonimmigrant status): Visa Waiver Program Crew member (D nonimmigrant visa) In transit through the United States (C nonimmigrant visa)
  7. not interview letter, we got a document to take to dr that let us schedule interview and same for MIL that just went thru the process
  8. at interview the medical will be looked at closely for use of drugs and CO can deny (even if drug free exam ) and make the bene go thru the 1 year process to prove no drug use This is even if legal in bene's country or in petitioner's home state, it is not legal under federal law and when asked , must admit to using in past
  9. To find out which USCIS processing office is handling your petition after filing online, check the "receipt notice" you receive after submitting your application; the first few letters of the 13-character receipt number will identify the USCIS service center processing your case. processing time depends on to many factors like number of petitions received, petitions still in processing office, country and embassy, all documents needed received and/if RFE needed
  10. he did lie as he had/brother is family too
  11. this is information on the federal court site for Eastern District of NYS/ all info is there about location, guests, etc https://www.nyed.uscourts.gov/naturalization it does not show a court calendar but says this: Several times during a week, a hundred or so people gather on the 2nd floor of the Brooklyn Federal Court. They have not been summoned or forced to come in any way; they are there because they want to. They are about to become citizens of the United States.
  12. You can not schedule or have exam till the notice comes for the medical/ you need that document to schedule the exams for parents
  13. The basics are on above as indicated by others but when case is in 2nd phase NVC and u receive the NOA2 notice and need list of documents use the following site as Morocco has a few difference (like 2 criminal reports needed) For now u apply online with all documents for 1st phase at USCIS and wait /it will seem like a long wait so prepare yourself all those documents u scan for the petition need to have those originals at interview /keep copy of all including your I 130 and the receipt . https://travel.state.gov/content/travel/en/us-visas/Supplements/Supplements_by_Post/CSB-Casablanca.html Incha yekbel
  14. https://studentaid.gov/help/means-tested-benefits By definition it is means tested benefit and although its a great idea don't do it now The federal government offers several means-tested benefits that you and your family may want to consider as you apply for colleges or career/trade schools. A means-tested benefit is a public benefit where the granting agency considers your income and resources for purposes of determining your eligibility for the program.
  15. she has to buy it for u the bene and its expensive even if she can add u to a work place policy if I was on my husband's at work, it would require the family plan even though there is only 2 of us and that is an extra $450 monthly plus the $3000 deductible unless u have a co insurance I only mention insurance as this is normally one of the things she will need to prove she has checked into and can afford for u (usually in high fraud countries which Canada is not ) but Canadians can now answer your query as they know best Even on the K1 you have time to attend tech school or college as your wait is about 2 years for K1 or CR 1
  16. for original question, u can never do the NVC documents till you have case # from NVC but u can gather many documents needed to support the petition (example would be criminal report if beneficiary lived in a different country for more than 6 months and then u wait for NVC to send invoice to pay the 2 fees when CEAC site says fees paid , you will fill out the I 864;she will do ds 260 and you will scan supporting documents and PD date is the date USCIS received the petition (NOA 1 date)
  17. the poverty guidelines were from HHS The lines for dates of going into effect were from USCIS which did not have 125%
  18. what country/embassy? have you checked poverty guidelines to see if she has income to support the petition? Has she checked health care insurance to see if she can provide u with insurance? and you say fees are not an issue but do you know the fees to AOS after US marriage as they are over $2000? To be serious young people can marry and often do but income is so important not only for immigration but for a good life and to have a family If u were my son I would say both of u need to look into furthering your education and hold off on marriage time goes faster than u think and entering into this with a good career later on has all the advantages good luck to u both and i wish u well Keep the coresspondence open and visit each other as much as possible so u know each other well
  19. you don't need Real ID if u have a passport/ they created the real ID as many US citizens do not have a passport but in the reality they can be domestic terriotist so if traveling across the borders or by plane , they need to have security checks done also
  20. why they went down is my question with all expenses going up AI says Poverty guidelines can appear to "go down" when adjusted solely for inflation, even if the cost of living is rising, because the calculation method used may not fully capture the true increase in living expenses, particularly for necessities like housing and healthcare, leading to a discrepancy between the poverty line and the actual cost of basic needs in today's economy; essentially, the poverty line might not be rising at the same rate as the cost of living, causing it to seem lower relative to current expenses.
  21. 2025 was announced January 8th These income guidelines are effective beginning Jan. 15, 2025. https://www.uscis.gov/forms/filing-fees/poverty-guidelines Federal Poverty Guidelines for FFY 2025 House- hold Size 100% Poverty 125% Poverty 1 $ 15,060 $ 18,825 2 $ 20,440 $ 25,550 3 $ 25,820 $ 32,275 you will note the income limits have gone down so no worry there
  22. Question? Does she have children ? if so, keep the F2 as they are derivatives If u become US citizen and change to CR 1, you would need to file a I 130 for each child as they are now not derivatives of her I 130
  23. then u need proof that it is in original language you will need to show the Ahmadiyya Muslim the Islamic movement originated in British India and uses English as native language / it can be found to be described here https://en.wikipedia.org/wiki/Ahmadiyya
  24. still will be vetting for additional security purposes as u have returned and could have possibly created an issue like travel to other counties on US list of supporting terror or broken the law since going back it does happen and US , especially with new administration is going to be careful careful careful they will check and all u can do is wait it out
