It’s very painful. The consulate now has all my stuff, including passport and updated medical and RCMP certificate since last week and I still don’t see any updates. I am getting antsy!

awesome! opening the DS 260 for my mom didnt cause any delays. i just updated her travel to US within 5 years and resubmitted it.

Congratulations you’re almost there! By the time I submitted my passport and medical to them and received the passport back it took  2 weeks. So it might be even sooner than 5-6 weeks!

This afternoon I have sent my passport and supporting items to Montreal. One step closer. Just hoping that re-opening the DS-260 not another dirty trick for delaying me; I am somewhat paranoid at this point. Otherwise, it felt good.

Well it has finally happened, pressing back on the law firm got a lawyer to talk to me and she was able to get the US attorney to lean on the consulate to send me--at long last!--the request for medical, a new RCMP certificate, new passport photos and my passport,  and to resubmit the DS-260 (for no described reason).
 
This can be considered positive movement. However, the court deadline is Jan 14 and this stuff cannot be done by that date, so the lawyers are going to have to negotiate something with US attorney to allow more time.

It's going brother, it's painful but it is what it is. All we can do is wait. Even the US officials know that this process is bizarre however since it's the law so all who are suffering have to go through this process. I hope it works out for all who are suffering. 
 
Imagine being put into DS 5535 for a security reason and still you have visited US many times in the past without any restriction. They whole process doesn't make sense, in my opinion.

Advocating working in the US on a Tourist visa and using that visa  defacto living in the US is a violation of the TOS. Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method.~~

He is not going to send it in yet, I still need to get the flu shot and submit the record of it to him. 

A lawyer from the jump only helps with paperwork and prep. There’s no advantage to having one when thrown into AP, unless you’ve already decided you will immediately sue. 

For what it's worth, I have travelled many times to see my wife in Miami since being in AP with DS-5535. So yes, but as always, it is up to the discretion of the CBP officer to let you in or not.
