Your card will a 10 year Green Card. What the officer stamps at POE is irrelevant. The officer who stamped your passport does NOT decide which card you get.......your card will be processed by the records you submitted...
If, by chance they make a mistake (unlikely), you will submit an I-90 to have the card corrected.....

Definitely wait. Removal of conditions takes a long time and life is a little more frustrating during removal of conditions because you have no valid green card.

Personally, I would unless you really need to travel immediately. The ROC process is not super hard, but it is a pain, and with five weeks, I would wait and skip that step.

My opinion is that the immigrant should enter the US after the marriage is 2 years old if it is convenient....It will result in a 10 Green Card......My wife entered the US 30 prior to our 2nd wedding anniversary. I wish she had waited another month.

The officer at the POE does not make a decision regarding CR-1 vs IR-1. That is done when your green card is produced....... the laws in the country where you were married dictates the legal marriage date. In some countries, it is the date the ceremony took place. In other countries, it is the date of marriage registration (Taiwan, for example).

Pending green card doesn’t mean anything. (Green cards can be pending for years, people can have their situation change and not get those green cards after all, etc.) You can’t “explain” if that is what you meant by explain. You can get people who currently qualify to sponsor, or you can postpone until those family members actually become green card holders.

You should submit a joint sponsor that will enable the visa to be issued.
A work permit holder cannot joint sponsor.
So while the the 221g states this, you can't provide it and must do the next best thing and writing a letter in explaination wouldn't hurt.

My birthday and our marriage anniversary both fall in August and by the looks of it I’ll be celebrating it alone this year. Was really hoping that hubby would have received an IL last month but nothing. Praying this week shines a light on us all inshallah.

Honestly every case is different and when I was waiting on mine it took a while, I don't want to put your hopes up cause it's not fair, it's always annoying to say this but you just have to be patient and wait

My ds 260 never said accepted just went to complete after I paid all the fees.even until now says complete and now I'm still waiting on my visa to arrive.

You should get your money back and end business with them. If they refuse refund file a compliment with the BBB and with the appropriate federal agency of fraud. I’d also write my senator and congress and whoever I can do that they think twice about taking advantage of you and others. There are too many business steeling money from people and impacting families negatively due to fraud or complacency.

It is true! By reading the instructions and with the help of these forums the fastest processes are achieved. My experience has had good results without lawyers! But you can do it and speed up. Check your account at CEAC and follow the steps that are missing.

Already paid 800$ to that Attorney im just gonna wait a day or two otherwise im gonna. Do it. I i know everything is pretty simple i just wanted to make sure all goes well and on time. 800$ wasn't even a big deal i wanted the things done asap by a professional lol

I-864 is pretty straightforward, just read the instructions and upload the supporting financial documents. You provided everything to the attorney already, just go ahead and upload it all yourself, it takes a couple of hours at the most, NOT five weeks! Read the tips for scanning and uploading documents on the NVC website to make sure you do it correctly. You're paying someone to slow the process down, which makes no sense. You can login to CEAC and upload everything today if you want to. Why wait for them to do it? If you're in a hurry like most of us, do it yourself now and fire that attorney. Good luck!
