Yes would definitely be best to file together I would do everything to make that happen! 
 
If if not then you answer no when asked if she apply with you. (If you get interview you will most like be asked why) also remember she will be out of status and will not be able to get a DL or job. 
 
You just will will put down what you remember maybe the month and year he was born. 
 
Also so remember that when you do ROC you can add a child without a extra fee if you do not get green card at the same time or within 90 days you will have to pay for the both of you when that time come. 
 
I will I’ll be honest and say with the age she has I really think you should try and do AOS now. 
 
EAD and AP fees are waived for the both of you when filed along with the AOS.

You may find it helpful to get a list of paperwork that you're going to need for each step of the process and make sure that he has what he needs from you to submit the petition (the first part of the process) and that you will need from him for the visa application (the second part, once the petition is approved). Also take time to read through your regional thread for embassy specific requirements.

You should file under permanent resident for more than 5 years, no need for kids or common law partners. I'm surprised that you are able to file tax returns as 'married filing jointly' if you are not legally married. I would be astounded if the USCIS would consider you married, however. There is no such thing as joined W2, since that is the document given as a summary of an employee's earnings and tax deductions. Unfortunately, 'stay at home mom' is not a classification of employment, so you would be 'unemployed' or, if you have attended any school, you'd be a 'student'.

It's doubtful stay at home mom would be considered as employment for USCIS purposes.
I don't believe minor children can petition relatives.

Not across the US/Canadian border, but flying from London, England to Manchester, NH via JFK. I am a paper crafter/ scrapbooker and so was my best friend, who we were traveling to visit. I had a portable 'die-cut' machine and a folder with the shapes in. Basically works like a hand squeeze press with 2 metal plates and you slide the shape and paper inbetween the plates and it cuts the shape into the paper.

It's about the length of a forearm and pretty heavy. It's also very valuable, so I opted to carry it on board with me. We fly transatlantic, clearing security at Heathrow, of course and go to transit from our NY flight onto Manchester, but have to go through security again. He stops me and opens the bag, pointing to the quickkutz and folder and says, 'what's THAT?!' I told him it was a craft tool and went to open the folder up and he leapt back and shouted, "DON'T TOUCH IT, MA'AM!!" So needless to say, I didn't. "What does it do?" "It presses different shapes out of card and paper for using in a scrapbook." He then looked at me like I was crazy and said, "I'll need to confer with my supervisor." Goes off and comes back and shakes his head. No way, I'll have to check the bag. I ask him why and he looks at me like I'm crazy again and says, "Ma'am. It constitutes a lethal weapon." Now it's my turn to look at him like he's crazy and he goes on to say, "We just can't take the chance Ma'am that you're not going to go nuts on board and start attacking people with it." I was mad as all heck because I was travelling with my 4 year old, near to boarding time for our connecting flight and would have to go through security all over again. So I said, "Sir, if I was going to go nuts on any flight, traveling with my 4 year old, do you not think I'd have gone nuts on the 7 hour transatlantic flight, rather than the 1 hour hopper flight?" Of course he didn't care, I had to check the bag or leave my lethal weapon behind.
On the way back through security, I had a different guy who pulled our other bag with my daughter's stuff in to one side and said, "Ma'am. What is that?" Pointing to my kid's Leappad, which is like an electronic talking book for kids to read along and interact with a little pen with. "It's my daughter's leap pad, it's a toy and sure as heck doesn't constitute a lethal weapon, unless you plan on boring the pilot to death from listening to the same questions and stories repeatedly." The first security guy came over, having heard my brain explode, no doubt, and looked at it and told the new guy it wasn't a problem. His kid had one and it drove him crazy but it wasn't lethal as the lady pointed out. LOL
I nearly told him if he made me check our bag because of the Leap pad, I was going to recover the first bag and put my 'lethal weapon' craft tool to good use. But figured that would get me arrested, so I shut up!

Totally get the benefits of a 'package' deal but in our case, we're both rather skint and also won't be having a very big wedding numbers-wise, so will likely keep it more DIYish. I love the idea that you can use anywhere you like to actually get married, unlike the UK where it has to be licensed as a venue for civil ceremonies and also, can have anyone who is registered be the 'minister'. Ry's best mate is actually licensed although I'm not sure if he wants him to perform the ceremony or act as his best man. But as it's really easy to get licensed, we could theoretically ask anyone we like to do it and the idea of it being that personal is fab. He's not a church goer, so doesn't have a family vicar or anyone like that.
That's really helpful to know about the dress alterations. This is my second marriage, and I did the traditional dress with train first time around. Definately going white and weddingy but thinking more for a knee length, empire bodice type, chiffony skirt type affair. Definately don't want to spend a fortune so will actually be looking at bridesmaid dresses too. Having said that, I get the impression (possibly wrongly, it has been 11 years since I last looked!) that we Brits tend to not have the same variety of styles for bridesmaids that they do in the States.
I don't want to shoot myself in the foot and say that I'm pretty confident that we'll get the visas for certain by x date, but by having it as a less formal event, we can get more flexibility. I like September 12th as a date, because it's shown up twice in our relationship history now but I'm unsure about having an anniversary so close to 9/11. It would also mean that some of my friends would want to fly in the day before and I just don't know how people feel about flying on that date. I know I'm a little wierd about it and I don't blink at the thought of flying usually.
How are you managing invites and is anyone from the UK traveling over for it?

I'm sorry but hyphens don't make your name illegal. Plenty of women hyphenate there last names. And if Prince can change his name to a symbol then anything goes.

Your kids will be US citizens once you become a citizen. As long as they are under the age of 18 when you become a citizen then all you have to do for them is apply for your US passport and their US passport using your certificate of naturalization.
If you want to get done with USCIS and update their records, you can apply for N600 for each kid and the will have certificate of citizenship of their own.

To the OP, I'm sorry to read that your marriage has failed, whatever the reason. I can also empathize with wanting to make as clean a break imaginable with a measure of revenge thrown in. But she is human too. You cited age and cultural differences, and you're probably right. Had you married a US citizen, no matter how difficult she was going to make your life post-divorce, you wouldn't have any such 'get rid of' process. I'm sure you didn't enter the marriage with the thought of 'oh well, if it doesn't work out, I'll just try and get her deported' so don't enter into divorce with that attitude.
Change the locks, change your number, advise security at work, get a restraining order against her if she starts being malicious but please don't sink to the low level of objectifying her through attempted deportation.
