We have been talking for two years and he will come to visit me next month finally. Another question, i've read online that he needs to have a work in the states before he can file a petition for me coz that is one of the requirements. Now my question is, is it ok any kinds of job as long as he has work? Thank you Jessie K. :)

Yes, the I-129F requirement is that you have met at least once within the past 2 years. However, proof of a bona fide relationship will also be necessary. Face time is best, but Manila is fairly simple and I don't think it will be an issue.

 

A job is not strictly required, but you must show that you will not become a public charge in the US. The most common way to do this is to have an Affidavit of Support (I-134 for a K-1 visa) filed by the USC, which has a 100% of the federal poverty line requirement. Current income is preferred, but assets can be considered and would need to be at least 3x that amount (or the difference between current income and that amount). The I-134 is presented at the interview upon request (Manila COs sometimes do not even ask for this, but you should have it with you anyway).

 

So the short answer is that not just any work is required, but enough work to show that he is able to support you in the US. Manila COs usually do not accept a joint sponsor for an I-134.

Nothing gets simpler in any pregnancy. :)

 

But in terms of the K-1 visa, being pregnant won't have an immediate effect on it. However, you will need a medical examination and that will be provided to the CO, so they may want assurance of his ability to support you and the child in the US. If you give birth prior after the visa is issued but prior to entering the US, there is a process to have the child's status recognized and come with you. That said, just be aware that you have 6 months from either the medical or the interview (whichever is soonest....usually the interview is) to use the visa, then 90 days to marry once in the US. Also note that many airlines will not permit a pregnant woman to fly after a certain point without doctor approval.

you have not met him yet but contemplating to get pregnant? Be careful, you have never met that person face to face. Anything can happen. I would urge you against getting pregnant. Also, being pregnant won't speed up or help your process at all. Even if you get pregnant and deliver before you file your paperwork and your bf will fly to get all the paperwork for the child done to receive an American passport, it won't give you any privilege to move faster to the US. You will wait the same processing time

It's actually 125% of the Federal Poverty line for K1 and later on for AOS.

He needs to make at least a little more than  $20,000/year. Otherwise he would need a co-sponsor.

That's incorrect. Some COs use the I-864 requirements (which have the 125% requirement as noted), but the I-134 is 100% of the federal poverty line and what most COs use.

And as noted, a joint sponsor for the I-134 is usually not accepted for Manila COs.

I can't remember the amount for K1. It's been almost a year since we filed for my visa.

But for I-864 it's definitely 125%.

Pictures are secondary evidence. Proving a location + date is quite difficult. I only included 2 myself and they approved mine just fine without any questions. I included boarding passes, JR passes from our Japan trips (which have passport numbers, names, and dates on them with a signature from an official), and Angkor passes with photos, names, and dates signed by another official. So just remember the goal is to show you have met at least once within 2 years.

 

Providing a few more than I did is perfectly fine. Just remember that a 3rd party (who wasn't there and won't take you at your word) needs to say without any doubt that you two were together within the past 2 years.

Correct. For AOS, you use the I-864, which has the 125% requirement and permits joint sponsors.
