    It it is unlikely that you would qualify for returning residents visa in the first place, as the criteria is basically that your not returning to the US was beyond your control. For example, if Thailand had cancelled all travel in or out of the country, that would be beyond your control. That was not the case -- you chose, albeit for what was a very good reason, not to return. However, even if they accepted COVID concerns as an acceptable reason, your wife would not qualify for a Returning Resident Visa because she likely has lost her resident status by not applying for removal of conditions.

     

    Of course, if you did file the I-751, that's a different story.

    Yes, this is our second time through this process, so it was relatively easy. They did mention her previous residence and tourists visas. The medical was fast, we actually took our results from 7 years ago and the doctor reviewed and ask why we are going through the process again. The vaccines were all in order. We did labs (blood work and x-rays) on Wednesday morning, medical on Wednesday afternoon, and picked up results on Thursady just after noon. We did fingerprints on Saturday morning and had interview on Monday morning.

    Not sure if you saw, but our case was expedited as I am in the US Air Force Reserve. I see you are an Army vet, thank you for your service! 

    Great question, I actually picked up the phone (they are behind bullet proof glass) to speak and he didn't want to speak to me. Told me he wanted to speak to the beneficiary. She spoke the entire time, but he did wave goodbye after the interview. Our case was also expedited at USCIS and NVC, best of luck!

    The interview was actually really quick. The CO didn't want to speak to me (prtitioner), entire time time talked to my wife. Asked about our relationship..how we met, how long we have been together, any kids. Also, if she has ever been in the U.S. illegally, employment information for both, why we want to go to the U.S.

    I am almost certain that all immigrant visa interviews are conducted in Montreal. Good luck!

    They will take your I-751 and processes it with your N-400. Nothing to worry about, I have sen both joint interviews and separate interviews. Although, more joint interviews than not. Good luck!

    Requirements for entering Canada by land or sea are a little more lax than the rules for entering by air. All you need to provide is a photo ID, such as a driver's license, NEXUS card, or a passport from your country of origin, and your green card as proof of lawful permanent resident status in the U.S.

    Has the form recently changed? I don't recall there being a section of previous U.S. entries on the I-130.

    She can get her new passport with married name. I actually recommend it since her GC will be issued in that name and you wil save the expense of changing her name on the GC later on. Good luck!

    Now i'm submitting in the supportive documents and affidavit of support and all that good stuff, and now its asking for my wife's (currently in mexico) passport information in which she is in the process of getting. My only concern is all the documents I've submitted prior to the case being approved have been in my wife's maiden name and not her married name. 

     

    So my question is, should my wife get her passport with her maiden name since I've used that name on all her forms or will it be ok if she gets her passport with her married name even though I've been using her maiden name for all her forms I've submitted to the USCIS?

    At the NVC stage you will use the exact name that is in her current passport. My I-130 had my wife's maried name (my last name), but at the NVC stage I had to use the name in her passport (Maiden Name). Colombians do not change their names to a married name, they keep their last names from brith until death. Good luck.

Here's my question - we have a certain number of documents showing both of our names with the same address: tax transcripts, auto loan, auto insurance, bank statements, a credit card, maybe a few other things. However, we have tons more stuff for each of us separately, but showing the same address: medical bills and EOBs, paycheck statements, financial documents (401k, etc.)...in addition to the stuff that is addressed to both of us, should we also send the separate stuff in since it shows each of us at the same address? How would we label that - just as documents that show residency at the same address? Thanks!

    To be honest "tax transcripts, auto loan, auto insurance, bank statements, a credit card, maybe a few other things" is good enough, I would just recommend adding a lease or rental contract with both of your names on it. Good luck!
