    That's correct, she only needs her passport and medical because everything else was already sent to the NVC, however, it's always a good idea to bring copies of them just in case the embassy misplaces any document or says they never received it.

    This is exactly what I was thinking. I know it's a hard decision for you to make given the fact that you're so emotionally involved and it's hard to think with your head when your heart gets in the way. I hate to tell you this but based on my years here on VisaJourney reading all kinds of similar stories and personally knowing how some women in Colombia can be, I can honestly say that based on your story, she's a fraud. It's that simple.
    Many women in Colombia who are struggling financially think that their only way out is to marry a foreigner who they believe is rich and can provide for them and their family. On top of that, your her ticket way out of that situation and my prediction is she's waiting to get her green card to take off. She'll use the money she's saving to start a new life, either keep on working where she's working now or get a better job so she can have a much better life than the one she had back home.
    So in summary you have two options, one is to go through with the Adjustment of her Status so she can stay legally in the country and have a better life than if she were to go back to Colombia. Or 2, show up at your AOS interview with a letter saying what you feel she's doing, that you consider her a fraud and want to terminate the immigration process by filing for divorce. This will result in a denial of her AOS without her claiming any sort of abuse from you and won't give her time to get to plan B to make you look like the bad guy in order to get her permanent residency. She'll either have to stay in the US illegally or go back home. If you decide to do this, it's extremely important that you save all kinds of evidence that supports your story, that you're the good guy being used, that she has no interest in staying married and that it shows your marriage is not what it's supposed to be. Again, this will help you in case she plans on using the "abuse" excuse to get her green card.
    Either way you'll have to accept the fact that your marriage will eventually end up in divorce, that she used you to move ahead in life and that the woman you thought she was was just a farce in order for her to get what she wanted.

    La verdad no tiene nada de grosero mi comentario. En ningún lado dije groserías, ni utilizé palabras vulgares como lo hizo el miembro sarita88. Tampoco insulté a nadie. Lo único que dije es que esa persona está generalizando todas las relaciones entre extranjeros y latinas basado en lo poco que ha visto y en lo poco que conoce. Su punto de vista es muy ignorante en ese sentido ya que es obvio que no se ha educado bien sobre las estadísticas de ese tipo de relaciones y sólo generaliza, lo cual nunca conduce a tener una conversación madura e inteligente.
    Estoy de acuerdo con lo que dijo Osita en que parece que es una persona que sólo quiere crear controversia y armar un avispero donde no lo hay. Por esa razón de mi parte le doy punto final al asunto para no seguirle dando más cuerda, que obviamente es lo que quiere.

    Damn, if I weren't Colombian and read your post I would stay away from it at all costs. I know you're trying to give some sort of help but at the same time you're putting down a country where life may not be as "easy" as it is in the US but is not as horrible as you want to paint it.

    I'm not here to argue with anyone but I have to stand up for what I know, and what I know is that yes you can make a life in Colombia if you wanted to, I've seen it happen, that yes, there is a middle class, and that people stand out like sore thumbs more than you can imagine. However, as far as getting a visa approved for your girlfriend in the future that's for a CO to decide, not for anyone else, including yourself.
    You need to discuss this issue with a very good immigration lawyer who can give all the options you may have, who can tell you exactly what your hurdles may be and who can guide you through the entire process. Speculating on what may or may not happen, what you know about Colombia or what you may not know about it, what you can or cannot do leads you nowhere. I can honestly say that no one in this forum knows for sure what you need to do and what will happen. What you have in your hands is a serious case that needs to be handled by an expert.

    Con todo el respeto que Ud. se merece, primero no creo que este foro se hizo para "regañar" y poner por debajo a las personas que sólo tienen preguntas sobre una situación migratoria. Segundo, Ud. no sabe cuál fue, cuál ha sido y cuál sigue siendo la situación de esta persona para dar una crítica tan ingnorante. Y tercero, le sugiero que si no tiene nada positivo para aportar, por más derecho que tenga para hacerlo, no lo haga de una manera tan baja y tan de poca clase. VisaJourney se creó para ayudarnos los unos a los otros, no para insultarnos ni para ponernos por debajo de los demás.

    La embajada necesita dos cosas del DAS:
    1. Certificado Judicial
    2. Carta Migratoria o Carta de entradas y salidas, así no hay salido nunca de Colombia.
    Si ya tiene el Certificado Judicial, mire a ver cuándo se le vence. Si ve que no se ha vencido para cuando le den la cita, no tiene que sacar otro.
    Las vacunas son MMR, TD y varicella. Si tienen menos de 26 años de edad es recomendable aplicarse la del PVH porque la necesitan para el Ajuste de Estado.
    Para el divorcio, siempre y cuando el divorcio haya finalizado ANTES de haber mandado la I-129F al USCIS todo bien.

    OK, I get what you're asking now so here goes, the only reason you would need to register your marriage in Colombia is so that it can be valid there for whatever situation that may arise such as dividing your Colombian assets in case of a divorce, child custody, seeking Colombian citizenship, etc. You don't have to register it if you're filing for a US visa of any kind because as I said earlier, the US recognizes most marriages that take place outside of the US and you would only have to deal with the US embassy and no one else.
    As beejay said earlier, you can still file an I-130 from outside the U.S., since you say Rwanda no longer has DCF you will have to send it to the USCIS and ask to have the CR1 or IR1 interview at the nearest US embassy. Again, the fact that you didn't register your marriage in Colombia has nothing to do with this since you will only be dealing with the US.
    For the child, she only needs a signed, notarized permission from the father issued no more than 30 days before leaving Colombia. She will show this to the DAS person before boarding. That's it, they only care about getting the father's permission to leave the country, they don't care about where they're flying to nor how long they'll be there for.

    My husband also booked his flight to Colombia with our AA miles and when he checked in online this morning was pretty shocked to see that the charge for a second bag is now $70 when it used to be free of charge, which means it's an additional $140 round-trip.

    Do not delete emails and phone messages offering not to report him. You may need them if he files under VAWA and claim you abused him. You will need those messages to protect yourself.

    The way I see it, high fraud countries are pretty much those that are not a part of the Visa Waiver Program. So if you live in a country where you have to go to the embassy to get a tourist visa, that pretty much means the country is considered high fraud for most visa types. These include most, if not all of Latin American countries, and others from Africa, Easter Europe, Asia, etc.

    Yes, the certified copy will work because the stamp certifies that is a true copy of the original. Never send anyone the original document because there's a small possibility that you may never get it back. In Colombia everything is kept by official notaries and they're the ones who keep the original documents, people can only get certified copies which is why the NVC has to accept them in lieu of the original.

    No se lo tome personal porque no es por contradecirla sino que es muy importante aclarar este tipo de cosas que pasan en la embajada porque como dije antes, muchas personas automáticamente piensan que si a una no le pidieron evidencia de ningún tipo, a ellas tampoco y luego les puede costar caro. Esto también se refiere a la evidencia inicial que manda el peticionario con el formulario al USCIS. Uno no puede asumir que esa evidencia es más que suficiente por varias razones, una porque la cita es varios meses después de la fecha en que se envió el formulario y es posible que la evidencia no llegue a la embaja en su totalidad ya que varios empleados del USCIS, del NVC y de la embajada tienen acceso al caso. Otra razón es porque durante todos esos meses es posible que la pareja haya terminado y muchas veces el cónsul pide ver evidencia reciente para determinar si la relación sigue en pie. Otro motivo puede ser que la evidencia no sea clara o lo suficientemente específica y muchas veces el cónsul no puede tomar una decisión con lo poco que tiene y siempre le dice al beneficiario que se tiene que volver a presentar con el peticionario para ver si de pronto le pueden aprovar la cita con más evidencia, y varios de estos casos se han visto.

    Aunque no le hayan pedido evidencia personal, ni económica, eso no quiere decir que la embajada no la pide ya que es algo muy importante para la aprobación de la visa. Si ellos no tienen cómo saber si el sponsor y/o co-sponsor ganan lo suficiente al año, no aprueban la visa. A nosotros, al igual que a muchas otras personas, nos pidieron todo tipo de evidencia, el cónsul vio cada una de las fotos que llevamos detalladamente y leyó todos los emails y chats que habíamos escrito mi esposo y yo.
    Sólo quería aclarar ese punto ya que muchas personas leen cada mensaje de cada tema y de cada foro en VJ y si se van confiados en que no necesitan llevar ningún tipo de evidencia, lo más probable es que no les den la visa el día de la entrevista.
