    Note: do not let your EAD expire even if you get your interview, re apply 4 months before it expires “just in case” I had seen many applicants not getting I485 approve in the spot with EAD expiring so this way you are cover all the time until your I485 is approve!

    We get both cards : I765/EAD applications and I360 Approval/EAD so it is normal, why do they do that: I really don’t know but your VAWA was approved so now you wait for the I485 to get process, this means all your documents will get transfer to the local office to get review again, it is up the Officer to approve you or denied you or to send your case for further review... let’s say a high number  of the I360 approvals get I485 approvals too! Nothing is a for sure thing until the day of the interview.

    You don’t need to have a lawyer near by, I had mine from another State. 

    The lawyer has to be specialize in Vawa. It would be best!

    I have a lawyer ONLY on my I360 petition, all the steps before I took without a lawyer and she is not a lawyer on my I485 unless USCIS link it automatically.
    Me and my lawyer sent in I360 before divorce was finalized, so divorce decree was not included in the application.
    I want to send it in now and curious if I can do so by my own or only my lawyer can do so if I have her on file for I360? Will USCIS accept communication from me or only from her?  (also I want to request my lawyer for a copy of I360 application she sent in because only she knows what she included from everything I provided to her and to check if I need to include anything else except of Divorce Decree).

    Another question is about my I485 pending application:
    So, in July my case status changed to "Ready to be scheduled for an interview" but I just moved in June and I did submit address change as required, but never got a confirmation of address change, so as soon as I saw new I485 status I enquired help from Congressman Local Office (as VJ members advised, thank you for that) and got feedback that USCIS has my new address, it is updated and interview will be scheduled at my new local office, but wait time in this area is longer, so it will take at least 6 more months to schedule it. 
    Now the question is: Should I submit a request to hold in abeyance until my I360 is adjudicated or not? Again...can I request that or I am not authorised to do such requests and only my lawyer can do so? 

    Please assist as you have more experience and knowledge!

    You will have to attend interview to ask the officer to put your I485 in hold until Vawa is approved.

    Once that happens you always keep a copy of your divorce decree, they have been asking for in the interview so you can hande it to the officer in case they ask.

    You should have the request of documents in your Interview Notice! Do you have a copy?

    my personal/humble advise: bring your I360 packet with your passport, Birth Certificate, Divorce Decree if you have it, DL or ID and whatever else is in the letter.

    all applicants must renew their EAD 3-4 months earlier of expiration date even if they have Interview schedule, always better be cover from all sides until we get GC in hand!  Best!

    In my personal experience I’d have an I130 Approved your PD when you start Vawa will be that one BUT after Vawa is Approved it will change for the date you filed as a self petitioner.

    That was the way it happened  in my case.

     

    as getting re-marry I don’t know but my lawyer said NOT to marry until you get your case adjudicated because it can potentially be denied

    I went in for my interview and it was a pretty pleasant experience! Wait time was short too. I got called on 15 mins after arriving.

    IO was friendly and cheerful. 

    We went through my biodata and yes/no question.

    He only asked for my medical records and then told me he is approving my case and I’ll receive GC within 4-6 weeks. 

    Whats odd is that he did not ask for my divorce decree. I went in prepared to only give what asked for.

    I also submitted my BC name correction affidavit as well. Basically I had a sheet of paper explaining changes since I first filed the I-485.

    He mentioned that low cost health insurance isn’t considered public charge.

    plus he did not at all ask about the abuse, bless him! 

    And I saw a big brown VAWA file on his desk which means they do have access to our files even after adjudication!

    I’m yet to receive approval updates. Case status is still the same.

    Totally correct BUT they are still asking for the document at the interviews.

    My officer kept the original copy, I express this so people can be ready to answer when they have the interview.

    Myself I had all done so I just handed it to him.

    I never got updates online so I just waited until my lawyer got the notification on the mail and once a made infopass

  11. Guys: Just a reminder (my humble recommendation) that you must keep a copy of all you Packet before submission and request all NOA’s Receipts too for your records.

    Officers at Interview dates are asking for them even though they have a copy of pretty much all so keep this in mind including you bank Statements and proof of your jobs/income.

    Divorce Decrees are being ask for too or if you don’t have them make sure you have a letter from divorce lawyer stating you are in motion process.

    If you don’ get a receipt please requested specially the I360/Vawa Approval Letter.

Today my lawyer informed me he just received my ead card (c31). I already have an ead (c9) which I have renewed before and is still valid.     dec 2 2017 rfe received by uscis 

     

    dec 6 2017 biometrics, I was never invited for biometric I just summoned courage and went there (uscis office)after waiting for long and I was scheduled for same day

     

    march 13 2018 filed vawa using a lawyer

     

    march 18 2018 uscis receives i360 docs

     

    march 19 2018 i765 and i131 combo card approved based on pending i485. Lawyer wrote to uscis to keep my i485 and attach it to my vawa app.

     

    march 25 combo card received

     

    march 28 2018 wife filed for divorce. We were separated already since Jan 2018

     

    april 13 2018 received first premie facie for one year (from March 13)

     

    july 26 2018 divorce finalized 

     

    oct 2018 applied for combo (131 &765) renewal

     

    jan 22 2019 combo card approved

     

    April 2 2019 prima facie extension for 6 months

     

    august 2019 renewal of combo card (c9)

     

    sept 3 2019 card in production notification for i360

     

    sept 9 2019 ead card (31) received my lawyer.

     

    i believe that some march 2018 cases are being worked on right now.  I just want to say thank you to Sandra and everyone on this forum. You’all Gave me hope. And for everyone waiting for approvals, yours will come soon. The journey will end in praise.

    That is best to focus day by day, there is no stone set for processing timelines all depends the local office and how many officers are working in all the pile of documents
