    1. The Waiver is that relief for the ground of inadmissibly.  The Waiver is the final step to adjudicate your I-485. The Waiver is the final decision at the discretion of the officer if a Waiver of inadmissibility is denied you are inadmissible your I-485 will be denied.  RFE are sent when the waiver is missing and your I-693 form does not contain a blanket waiver for the Covid-19 Vaccine.
    Applicant can proceed with USCIS I-290B to request consideration. 
    Waiver under religious beliefs is accepted and will be consider and analyze by the officer and is at his discretion. Please read the Chapter 3 of USCIS for more https://www.uscis.gov/policy-manual/volume-9-part-d-chapter-3 
    * USCIS mentioned The applicant has to demonstrate that he or she opposes vaccinations in all forms; the applicant cannot “pick and choose” between the vaccinations. The fact that the applicant has received certain vaccinations but not others is not automatic grounds for the denial of a waiver. Instead, the officer should consider the reasons provided for having received those vaccines. * Applicant have to clarify with reasons why received others vaccine but not the covid-19. The religious belief or moral conviction must be sincere and explaining. Hope this help.  I think many applicant can get this waiver approved if it is well elaborated and explain to USCIS.

    ALERT: Effective December 9, 2021, USCIS is temporarily waiving the requirement that the civil surgeon sign the Report of Medical Examination and Vaccination Record (Form I-693) no more than 60 days before the date the applicant files an Application to Register Permanent Residence or Adjust Status (Form I-485). It is still in the best interest of applicants to undergo the immigration medical examination close to the time of filing the Form I-485, as the Form I-693 only retains its evidentiary value for 2 years from the date of the civil surgeon s signature. After the 2-year timeframe, the applicant would need to submit a new Form I-693 if USCIS has not adjudicated the Form I-485. This temporary waiver is effective until September 30, 2022.

    With PF you can apply for FAFSA (federal Aid) Must collage accepted but i do not think private Nursing school does. You must verify with the School.

    I know that we have had several discussions about Prima Facie Determination, and that several believe that if they receive the letter that their VAWA will be approved.  I found the following information.
     
    Prima facie eligibility determination is not a final determination which guarantees final approval of a petition.  The regulation provides that "[a] finding of prima facie eligibility does not relieve the petitioner of the burden of providing additional evidence in support of the petition and does not establish eligibility for the underlying petition." 8 C.F.R. § 204.2(e)(6)(ii).
    A primafacie determination: (A) Shall not be considered evidence in support of the petition; (B) Shall not be construed to make a determination of the credibility or probative value of any evidence submitted along with that petition; and, (C) Shall not relieve the self-petitioner of his or her burden of complying with all of the evidentiary requirements .... 8 C.F.R. § 204.2( e)(6)(iv)(A)-(C).

    It is up to the Civil doctor to document that you are unvaccinated, and they will write their determination on that since you fo not have a vaccine waiver.

    it has been a long journey my people.  i nearly commited suicide 2-3 years ago after been abused by my spouse. he couldnt go with me to the second interview i had toog myself and lawyer to put the i485 on hold..

    on day of interview(i took my lawyer with)
    very nice lovely lady..only asked me some few questions on my i485. name gae adres bla bla..asked where i work
    asked the date of my ;last marriage. ask for taxes ask whom i live with at the moment... i told her i live with my new fiancee
    ask ofor medicals and last year taxes.
    and thats it,,says everything looks gud..also mentioned that i have two i485 running says she gonna cancelled the old one out....then i just had a nudge that it is done,
    i went home still no update and bam this afternoon...i got the joyous update CARD IS NOW IN PRODUCTION
     
    SO GLAD MY JOURNEY HAS ENDED. i  pray for evryone whom are looking to get approved soon you will dance for joy as i am dancing now
     
    i cant wait to go see my family after  7 yrs in this country..chai

    note. i only submitted psychology report in vawa and it was approved...this is for those who think they dont have enough abuse proof.. pls just submit what u can and pray!

    If you want to be exempt from the Covid-19 Vaccine Please consider this  is another layer of process, you must submit a Waiver I-601 based on religious beliefs or moral convictions, along with I-693 form and this waiver is at the discretion of the officer to granted, your I-485 will not be process until the I-601 waiver exemption is granted. If it is denied your case will be denied for medical inadmissibility.  I have not seen no one who have gone this road yet, but if you do please keep us posted.

    Any documents must be valid by the state in order to be use, even thought you had EAD extensions (which is use to work) the actual physical card was expired. Even some DMV like in NYC are not accepting extension letter to extend your Driver license just giving you an example. So now that you EAD is update I think you should have no problem, but  this is also determine by the state police policy and firearm laws.

    Once you receive your I-360 receipt you must write and sent  (USPS tracking to proof it was received) a letter to your USCIS local office where you had your interview. The letter is to request your I-485 to be hold on abeyance until adjudication of your pending I-360,  In the letter include your Name, Address, Forms # I-485, Case #, Alien #  it should be a straight forward letter dear USCIS Officer Enclose is my I-360 receipt as proof of a pending Vawa case, with this letter I will like to request my form I-485, (I-765/I131) to be held on abeyance, etc.... I will also include a copy of your I-485 receipt and copy of your ID for identity verification.....
    * Please note the officer can deny I-485 even thought you sent your I-360 if it is deny simply file a new I-485 Package with Vermont Services Center*
    *I will suggest your to hold your Travel plans until i-360 is receipt is received and you sent the letter to the local office. *

    It seem that your I-485 is held, this is the reason you keep renewing your EAD C9, Once your I-360 is approved Vermont will transfer your file to NBC (they make sure your file is complete with all documents) and NBC will sent to local office the officer will consider if interview is need it or waived usually if they request I-693 means interview will be waived and thats all they need it.

    Thanks for the info is great! specially for the group member that are still waiting. If I am not mistaken all of us mentioned on your post are already Green card holder.  Your interview was fast considering processing time for NYC is between 14-24 months.

    Hi everyone, so after USCIS messed up the address of where my gc is supposed to be delivered, I finally  received my green card!!! After x times of calling: 
     
    USPS and telling me to call local USPS-Kew Gardens wherein I ended up being ignored, and staff told me “ I can’t stand here all day and keep scanning”, I got ignored too when I told them that the suite number that USCIS used for the address was wrong (old) and that it has been corrected by my lawyer at USCIS and USPS. I was told “ I don’t know where your package is”
     
    USCIS- I asked them to resend my card and that I have asked for an e-request too online. For form I-90 even if I have checked the box that my gc was lost, before submitting it online it still required me to pay $500plus dollars unless if I’ll file for waiver but then with waiver I can only apply via snail mail.  I have even asked for info pass appointment. It was frustrating. Lots of pointing fingers and calls. 
     
    Lawyer- I begged  if he could go to post office since it was address to his name and office, he said “line was too long, couldn’t wait”. I don’t think he went anyway. 
     
    I’ve reached out to Senators Gillibrand and AOC, couldn’t believe the quick response that I got compared before maybe bec election is coming? LOL. I told them about the job I lost in the hospital. So from AOC, a representative from her office asked my tracking number yesterday via email and I replied last night and viola! Mail delivered. Thank God. To all my fellow VAWA filers, don’t give up and use all the resources that you can get. Thank you for this forum. God bless us all!

    You are not obligate to renew C31, you only need one EAD to work you can choose either both, But I recommend C09, for my personal experience C31 seems to take longer to be validated on some state agency like DMV, Medicaid etc.... C09 is better for me.

    Interview was Schedule today, The actual interview notice should arrived next week. 
    it solely depends on the officer.
