jdolvera reacted to geowrian in US Citizen filing for both parents - Parents have overstayed tourist visas before
I see a potential misrepresentation and/or maybe even a 9C ban, depending on the actual details and how they pursue/interpret it.
As noted, the first visa was revoked the moment they overstayed. Having overstayed 1+ year means a 10 year bar. It's possible they waived it and issued a new tourist visa knowing this, but that would be unlikely IMO. If they issued a new visa without disclosing the past overstay, this is a material misrepresentation, and it's possible for a 9C bar as well since the visa should not have been issued and they re-entered while an automatic bar was in place.

On the other hand, if everything was disclosed and they did issue a new visa knowing about the overstay period, then the only bar would be the 10 year bar on their last overstay. Which you can wait out or do an I-601. Given the timeframes, waiting it would probably occur before they interview, let alone interview + I-601 is approved.

There case should not be approved by that date because it is taking roughly 1 year for I-130s to be processed right now. Just be aware that they will be asked about this during the interview.

    More information needed.

    What visas did they have?

How were they able to get another one after the first long overstay.

Agree with @Boiler. How were they able to stay in the US unauthorized for 5 years, then was able to return just 2 years later? Did they enter with valid visas all times?

I also agree with @Cyberfx1024 that their case will likely not be approved by June 2019.

So we just got the "Card is being produced" notification for our EAD/AP.

    59 days after expediting (denied)
    171 days after NOA1

Things did not really move at all until we got in contact with our congresswoman last week. Now we wait for the card to arrive.

Good morning everyone! I haven’t updated my timeline in a while but I still read new posts from time to time.

Finally! Interview scheduled for July 6, 2018. Received notice yesterday dated May 29, 2018. PD is May 31, 3017.

Submitted a SR online back in December 27, 2017 for case outside of normal processing time. Got an email response on May 17, 2018. 4 months+ after!

I got worried because my local field office’s processing times went from 11.5 - 18 months to 11.5 - 26.5 months for family-based AOS. 👎🏼😡

I was about to file for EAD/AP renewal next week which expires on September 20th.

So, good luck to everyone else who are still waiting for their cases to progress. Patience is key! 👍🏼🤞🏼😊

From what I read on this website and my personal experience, if you don't hear 2 weeks after faxing the supporting documents, then your request to expedite is not approved.

Here's the usual EAD expedite timeline:
Day 1: Request to expedite EAD via phone
Day 2-5: Receive an email or mail to fax documents
Day 4-7: Receive an email or email confirming document receipt
Day 12-15: Receive an EAD case approval
Day 19-22: Receive EAD card in hand

If it takes longer than the timeline above, then your case is headed to regular processing which takes up to 5 months lately.

NB: This is only my interpretation of other's experiences.

I filed both EAD and AP back in January 2 and have yet to receive at least one.
We don't event care of the EAD at this point, just the AP because we have travels plans for next month. we should've filed separately. LOL.

    Hello peeps,

USCIS will never cease to amaze me. I saw a letter from NBC on my Informed delivery this morning, I was surprised and excited (no email or text msgs updates from both websites were received).
I was hoping that it would be either the approval for my EAD or the letter for the interview.
So I check the egov webiste, it still shows Case received for EAD in January and AP in March, and they received my response to the RFIE late February: nothing new it has been like that for 2 months now.
I check the DHS website and I see that only the AP was approved. Doesnt make sense but I am thinking let me wait for the mail, hopefully both approvals for EAD and AP would be there. Sometimes Informed Delivery doesnt send you all the pictures of the mail you are expecting.

I get the mail in the afternoon and guess what? It is just the approval for my Travel document. What???! Just to clarify when I applied in January I didnt apply for AP, I applied just for the EAD, but seeing the processing times I thought let me apply for the AP just in case. So the AP was delivered on March 8th, and now less than 2 months later it is approved but no news on EAD.
I called but they gave me the usual BS that Im still within processing times yada yada yada, so I told the agent yes I know Im still within processing times, but why an application sent less than 2 months ago is approved and the one sent in January is unanswered? The agent couldnt give me an answer and was also surprised. He couldnt transfer me to a L2 officer because it was late in the afternoon. He said they have a new system now so he couldnt put in a request for call back. The best way to reach a L2 is either call early in the morning or on Thursdays and Fridays they are less busy.
So I will try again tomorrow morning and Thursday, if I dont get an answer I have an Infopass scheduled for next Tuesday.

I am really starting to believe like I read on another thread that they just pull out the easy applications out of the most recent, approve it to get their stats up and dont follow the order or even bother checking if that person has other applications. They do according to their moods. Ugh Im so frustrated. Sorry for the long rant. I will keep yall posted once I talk to an officer.
