We September filers are getting so close… I'm sure we can all agree we can't wait to receive good news! I see so many posts about waiting, etc... Disclaimer: this isn't directed at any person in particular but I did want to share something my grandmother told me when she was still alive. I was complaining about long distance and she told me I should be thankful I have Skype, email, texts, etc. Back in her day, she married my grandfather and he left for war a few days after they were married. She didn't see him for 4 years… and relied solely on letters that took 4-5 weeks to arrive. Not even a phone call. Not one. To make matters worse, she didn't know if he was alive or dead or injured. Ever since she told me that, I realized I shouldn't complain. This K1 isn't taking “forever”(insert dramatic cue here), it's taking a finite amount of time, 6-9 months to be exact.  Stay positive everyone!

We have officially passed our visajourney timeline now. 

Just try to be understanding.  If you were in his shoes you would feel the same.  America is a great place to live but right now it is certainly not immigration friendly.  Let him vent and don't bother defending America now because there is no way for him to understand.  Just keep the love strong and let him vent.  He has earned that right.  Don't take it personally.  He isn't attacking you.  He is frustrated with the process.  Just remember that someday the process will be over and you will be together.

I disagree.  I sat for 260 some days with no word at all.  The RFE was a welcome sign because for the first time I knew that someone looked at my petition.

^ This! And more often than not, it is for something really small like a passport photo or copy of TOS for an online dating website. Those kind of RFEs are often processed in a week or so. 
 
Don't worry -- it's actually (somewhat) good news: they've touched your case and approval is most likely just around the corner once you mail back whatever they ask for.  

After 204 days we have just received an RFE through the app!! 
It’s not an approval but any news means everything to us at this point.

Well I was just notified through the app that they mailed me an rfe, I have NOA2 of Sept 15th, so there is movement.

Dont be discouraged.  That is the Tier I standard answer.  Do an online inquiry and a Congressional too.  You will get it soon.  The person you were talking too was just following the script.  Keep your head up.  This will happen sooner than you think.

Yes, you can divorce. Once that is final, you can remarry and they can file a new petition.
That said, the timeline is very likely going to stick out as a red flag for marriage fraud. You can overcome that with enough evidence of a bona fide marriage.

I'm sorry for what you're going through OP. I hope you'll be able to resolve this situation. I don't want to sound judgmental, but I'm surprised that most of people in America do not sign prenuptial agreements. My parents are both lawyers and I've seen numerous divorces turning ugly. When I got married even thought I was in a relationship for 6 years (my husband is the US citizen), we signed a prenup. Friends and family members made jokes about it, saying that I'm not a millionaire, why do I need that? You don't get married thinking about divorce later, but if you do, you have a way to protect yourself. Like health insurance. 
 
There's websites to help to prepare a prenup. We asked a friend to go to a bank agency with us since you need a witness, and in less than 15 minutes we had all the documents signed and notarised. It didn't cost us anything. And you can make changes to your prenup agreement later with you want. 
I know it's too late in your case now. But I hope your case can serve as an example to other couples to avoid situations like that. 

Well  I can only give you experience of my best mate. His ex lawyered up and so did he in order to defend against her. End result almost a million dollars between the pair of them in legal fees and it financially ruined them both.
 
As much as I would love to say fighting works - far better to reach a mutual agreement because the only winners end up being the lawyers who have no incentive to settle.

Law is a law - you gotta share all with him. Why waste more money on attorneys?
Sorry to say this, but there is nothing you can do unless you two signed some kind of agreement before marriage about how you gonna share finance in case of divorce.

If you get an RFE what will else will you send?  You cannot give them what they don't provide...  If that document serves as the termination of the marriage then you are worried about nothing

um, you know you can do the same scan on your smartphone if you have one, the case tracker app. you can search cases before your WAC number and after. it will show if they are close to your wac. I knew I was close to NOA2 when I did a scan and the few before me were approved and a few after me. then a few days later I got the noa2. its very simple and you don't need to wait for someone to post the same information that you can do right on your phone.
