    It takes about 1 month to 6 weeks for you to receive the letter in the mail for the biometrics.

    Yes you will receive an email letting you know your interview was scheduled and mail you a letter with the date and time.
    No ETA unfortunately, could be weeks, months, depends on your local office and luck.
     
    2. Haven't received any update on my EAD/AP combo, yet. What should I do? I called, they didn't let me through with a Tier2 officer. Spoke with the Tier1 person, and standard answer: you are within processing time, and your case is on track!
    Went for an infopass, as I previously mentioned in this thread (quoted above). 
    Try contacting your local congressman/senator to see if they can get some info on your behalf or look for a job and try to expedite with a job offer
     
     
    3. How will this work, if the interview happens before the EAD/AP combo processing? Is there an opportunity to expedite?
    if the interview happens before the EAD unless your case is held for review, you would not need the EAD and it will not be issued, the green card will be sufficient to start working

    All 3 options are doable.
    IMO, You should definitely send your AOS package now, even if the I-693 is not ready, because wait times for EAD are long (4 to 6 months) the longer you wait, the longer your spouse will stay home and I am sure he is already eager to get back in the working life lol.
     
    I did not personally adjust from K1 and did not send the I-693 with my package and didnt get an RFE for it; but you can look at the January 2018 thread and see that many sent their package without the I-693, because depending on your field office it may expire by the time of interview. You should not  receive a RFE for it but a courtesy letter after receiving the NOA1 reminding you that you did not submit the medical exam with your original package but you should be ready to bring it to the interview or when prompted by them.
    Then after sending the package, you have time to find clinics or be covered by insurance to take care of the vaccines.
    For your question about EAD and AOS not being related, well actually they are, because the EAD is based on your AOS so they are related.
    So if you receive a RFE for anything on your AOS, the EAD is on hold until they receive the response to the RFE.
     
    I hope I made sense, in summary not sending the medical exam should not be a reason for RFE ( from my experience and many others seen on VJ but they are always new updates with immigration), but getting a RFE in general for your AOS will pause the processing of your EAD.

    No special visa. It's nearly impossible to obtain a tourist visa while going through the process, but visiting using an existing tourist visa is fine. It may raise some scrutiny of your intent to return home, but many, many people do this daily.

    We had our interview last week at the San Diego field office.  As I mentioned in a previous post, we have had no updates to our case past "Fingerprint Fee Received".  All of a sudden the appointment letter showed up.  We kind of scrambled to get everything together but we did it.  Interview lasted about 25 minutes.  We went in together and did all questions together.  The officer was very young and was very nice.  He asked a lot of questions about our application and then asked about our relationship (how we met, where we live, questions about our condo, etc).  Then he asked to see what documents we brought.  The letter said to bring copies of everything we submitted with our application and he didn't even touch it.  We showed him our joint account info (phone bill & electric bill) as well as my 401k showing my husband as the beneficiary and our 2017 tax return which we filed jointly.  We brought some photos of us since he arrived in the US and the officer asked us to tell him about each one (who was with us, where was it taken, etc).  He said that as of today (last Thursday) my husband is officially a US Resident and he'll get his greencard in the next couple weeks.  So glad it's done and we don't have to do anymore paperwork for 2 years.  For those of you with busy field offices or people who haven't had any movement on your case, have faith!  The processing times for San Diego are 12-16 months and we waited 8 and never received any case updates.

    Here you go. Take this with you to social security. It works. We did it before EAD was received. Right after marriage.

    Exactly!  There is absolutely no reason she can’t change her name right now. Like you said, they should talk to a supervisor or go to a different office. We had a person at the dice we went to tell us we couldn’t do it. We were persistent and the supervisor came over and showed the worker how to do it!

    I am in touch with my Congressman's office, they helped me a lot! They told me to wait 60 days to hear back from USCIS from the day they got my RFE reply. Before that they can't do anything 😮

    You should definitely schedule an Infopass at your local office to inquire about your EAD, call and speak to a tier 2 officer, send a request to the ombudsman and also get help from your Congressman/Senator because you are totally out of processing times.

    Alright, I guess I am done here until I hear something from them. It seems like most people assume the worst that can happen  I don't think anyone has talked about the possibility of getting hired and what can come after that.  Too much negativity.
     
    I am just trying out here folks. I am not there to do harm to someone or screw someone over, but rather try to get a job I really want and support my own family. I think I would have this job if it wasn't unfair HR practice and I am simply addressing it. Nothing more, nothing less.

    HR is in NY, I applied in NC. There is only 5 people in that office and the branch manager/hiring manager likes me. What do you think are the odds that I will have a decent work environment? I think pretty good.

    Geez, the lack of empathy and blatant disregard for the law from some posters in this thread is frankly a bit appalling.  If you care about the law, then read the post by Hypnos.
     
    We all know how long it's taking to get a green card these days.  Imagine if you or your spouse or other family member went one year applying for jobs with a valid EAD and countinuously getting turned down because you don't have a green card yet.  You'd be pissed!  And this is her dream job!  And as far as I can tell, nothing the OP has stated implies that the job requires the person to be a US citizen.

    Why does everyone assume that I am going to sue them? I filed a claim and I am not going beyond that. I certainly do not have resources necessary to go into a lawsuit with this giant company. As I said before, if it worked for that British girl in another post, it may work for me. If not, I will move on and forget about Morgan Stanley. Is this so hard to understand?

    I certainly appreciate everyone's thoughts and time to respond to my concerns. It has been very informative and helpful for sure.
     
    While it seems that many of you would choose to try your luck again after receiving LPR, I believe that fighting this is in my best interest based on my personal views and current standing. There are many more opportunities out there and if it is not Morgan Stanley then it will be some other company where I will eventually land a job. I am not gonna portray myself as a person who does this for the greater good, but to some extent this action will probably help out others in the future. HR will probably be much more careful in the future when someone like me comes around for the next time. There is something to be accomplished for sure. First, we will have to see what comes out of my claim I guess.
     
    I also do not understand what is there to lose at this point. I feel as if I am being robbed of a very nice opportunity and all that because of my immigration status which is, heck confusing even for me but, nonetheless I have been granted unrestricted work permit by the government, therefore, it has to have some weight. I would not have this job anyway if I did nothing at all since HR already made a call. If things remain unchanged I certainly would not strive to work for the same company in the future. If my qualifications are good enough for them, they sure are for many other companies too.
     
    My point - There is nothing to lose so I am gonna stand up for myself.

    I'm not a big fan of Morgan Stanley anyway. I roll with Charles Schwab, you may want to try them out.

    I'll just reiterate that it sounds like this was a positive result caused by proper education of what was required. When there is actual discrimination, it's a much more difficult situation to handle. In the OP's case, they just didn't know what was required but otherwise wanted him, so the persistence to inform them of his authorized work status was crucial.

    Congrats!
    Nice to hear they offered you a job. Thus it appears the Corporate HR did not know the rules about EAD cards. Seems strange for such a large company like M&S.
    In the end the "alien" (or non-USC or GC holder) was able to obtain a job on EAD. Great News for all of us!

    As most of you saw my previous post got closed due to unnecessary anger from our fellow VJ-ers.
     
    I would like to post a quick update... Today, I have received an e-mail from the hiring manager telling me that the company reversed its decision and now I am invited for the final found of interview. I am not sure where this is going to lead, but it is certainly much better than accepting a plain NO based on the fact that I have only EAD and not a GC yet.
     
    For those out there facing the same issue: Don't give up just yet. If it is worth for you then fight for it.
     
    Those who do not know what I am talking about, this post is an update/continuation of my previous post

    Hmm, so here's a trick I learned. Call USCIS and press the option to verify/change your address. It takes you to a Tier 2 rep right away. They won't say anything like, "Do you need to change your address?". They'll just ask you how they can help you. Tell them you want to verify the status of your case because you haven't had any online updates in a long time. They SHOULD be able to tell you a little more detail. 
     
    For example, I never got the notification of "your case is ready to be scheduled." I ended up calling them and doing what I described above. The lady ended up telling me the exact date my case got put in line for an interview request. I've been calling every other week to make sure it's still in line and hasn't been actually scheduled yet because I haven't had any online updates. Try it out. If it doesn't satisfy you, then try the InfoPass.
