  1. I don't think it would be an issue.  I would believe this is something they run into frequently in terms of divorce documents.  If you wanted to be 100% sure you might want to seek a consultation from an immigration attorney.  Calling USCIS would be a waste of time as their customer service people really have no training when it comes to this kind of thing.  But I would doubt that alone would cause a denial.

She should be able to go directly to check-in with the airlines.

Don't hear of many who were able to pay the travel tax in the air fare ... ;)     You are unique!

Yeah, I was a little surprised.  It was in the same area where they try to get you to buy insurance on the booking.

  3. When I got Jessa's ticket via Philippine Airlines I prepaid for her travel tax.  However, nothing is very clear as to how she is supposed to handle that.  Does she still need to go to the Tieze desk or can she just go straight to the airline check in desk?  Anyone have any issues with the prepayment?

    SOMETHING STRANGE AND AWFUL!

We got approved, the case was transferred to NVC, after an additional month, we call NVC and learn that NVC has sent the case BACK to USCIS.

Have you heard of something like this? What should we do people? :(

Did you ever put in a service request while at USCIS?  There are times when people do that since they are past normal time, but then the case gets approved, sent to NVC and then goes back to USCIS to "work" on the request.  Could also be that some of the minor paper work done at USCIS was incorrect.  I've seen a few cases where someone forgets to stamp or check something on the petition and it needs to be sent back.

  5. Unfortunately, they can find things in their final checks during AP and refuse a visa even after the CO approved during the interview.  You'll be notified soon, but as much as I hate to say it, it's probably not a glitch or a mistake.  While those do happen, they are extremely rare.  Sadly, all you can do is what to hear from the embassy.  Really sorry to see this, it's a terrible situation.  Starting to think about a CR1 would be a good idea.

  6. Issued means the visa has been printed and placed in your passport and will very soon be sent to you.  We received an email when 2go picked it up from the Embassy, but not all get this email.  Depending where you live you should get your passport 7-10 days after Issued.

  7. Some have reported issues, others have not had any, so it's kinda hard to say.  Jessa got one of each just to be safe, not sure which one she actually used at the interview to be honest though.  I think the issue tends more to be how old the NBI is.  The embassy states it should be valid for a year, but there have been people who had issues with clearance that was older than 6 months.

And yet she continues to ask about the possibility of continuing the K-1 Visa. It’s not too hard to understand she can’t do that. OP,  please accept the knowledge of those “who spend lots of time here” as the CR-1 being the only way to move forward.

I mean, if she's in denial, then she's in denial and there isn't anything anyone here can say that will fix that.  I get it.  It's gotta be hard to accept that you've lost a lot of time and money by doing something that was probably one of the happiest moments of her life.  So yeah, stay in denial and get denied at the interview, or cut your loses and start the CR1.  She's been told over and over again.  If she wants to grasp at an unattainable, then oh well.

  9. I'm so done trying to figure out anything in this process.  I managed to push my vacation back a week since it appeared it would take longer than we expected to get her visa.  And then tonight it goes directly from AP to Issued. Not complaining though!!

  10. So I know I should have known better than to schedule my vacation before she had her visa in hand but oh well!  Her friend recently had her visa in hand just 4 days after the interview, and here we are now a week after the ours and just today went into AP according to the tracking.  My understanding is it should (hopefully) go back to READY tomorrow, and then ISSUED the following day, correct?  Or maybe the same day, if we're lucky?

I know the times vary greatly but about how long are we looking at for delivery to the Angeles pickup location?  Friday?  Saturday?  Maybe?  Please?  lol Seems to me that would be a quick trip, but I've learned to never think that regarding any of this haha!  We were hoping to have her here by the end of next week, not sure that's feasible now.

  11. I have been through this process twice now (and never again! lol) And I know several couples who have also been through the process over the period of the last 10-15 years.  From my knowledge, processing times have never been as long as they are right now.  I could be wrong, but that's just from the data I see.  And the wait times are not caused by an increase in the number of petitions.  So take that for what it's worth...

Yeah, I thought so too.   I wonder if the email I sent after her interview helped?   I basically just told them our story, then asked if they would let somebody else review the case, and that whatever result they would come up with, we would accept.

    Thanks.

    Bob

That's what makes it so strange.  You can appeal a denial, but I believe there is a rather large fee involved and a whole separate process; something much more than just writing them an email.  Perhaps, if the CO was really as unprofessional as you stated they knew about it and that had something to do with the change in decision.  Either way it worked for you, you're very lucky!

  13. Yeah, always best to know the process before you jump in as there are multiple steps.  Your petition was approved with Homeland Security, the visa can only be approved by the embassy, which is part of the State Department.  Then after that is the green card process which is a whole different process by itself.  So technically, yes you could still be denied, but as long as your relationship is genuine you'll be fine.  K1s have slowed down a lot thanks to the current US administration, but at this point you're close to the end so it's better to see it through.

  14. If the marriage was finalized in the US then he should be fine.  The US government would accept that he is free to marry, but the Philippine government would not, unless it gets annulled there.  So in this case a K1 is probably easier than a CR1 as annulments in the Philippines can be expensive and very time consuming.  As long as she is free to marry and has a CENOMAR, then everything should be ok.

Hello all - I really hope that everyone that is waiting to hear back, hears back soon. I'll admit I'm a longtime lurker and a first time poster. My fiance and I filed our petition at the end of November. My fiance is from the Dominican Republic. I never received an NOA2 or anything but today I received an email from the Dominican Embassy saying that "This office is pleased to inform you that you can start the process of your fiancé/fiancée, K visa, application."

Does this mean its been approved?!!

Sounds like it.  I would call the NVC and see if they have a case number already.  This makes it sound like the embassy already has your petition.

Hi. Is it okay not to have the Income tax return form 1040 with me during the interview? My fiance said that in the website it says it is only required during adjustment of status stage with form 1-846 .with Form i-134 needs only to be proven that he can support and aince his earnings is beyond poverty guideline so his W2, current pay stubs amd employment verification is enough..

You'll probably be ok.  Manila rarely asks for financial information anymore.  Jessa will have all mine just in case, but like I said, you probably will not even be asked about it.
