Yet again you don't even admit to the fact that you are spreading wrong information regarding the intent issue?
Its ok, we are all wrong sometimes...just move on.

    OP, from personal experience:

We were also worried about intent. My spouse was here on F1 visa and we were married for 2.5 year before we even applied for AOS. Within those 2 year she had 2 exits and entries back into the United States. The last one being a few months before we applied for AOS.

It did not even come up. And I know the officer paid attention to it because she told my wife that she (the officer) did not need an updated I-94 if January 2017 was her last entry (we travelled together).

Go ahead and file, you do not need an attorney.

It wont be OP's burden to prove that, actually.

Yes, people really need to stop fear mongering when it comes to this particular topic. It does not help anyone.

It wasn't the part about you advising the OP to consult an immigration attorney that resulted in the responses you received.

It was the part about you stating/quoting inaccurate information as fact.

Advice to speak to an attorney about a case in its totality to get an opinion is fine and normal...even if one is not needed, an initial consultation is not a bad idea.
Advice to speak to an attorney about a specific issue that is factual in nature with a clear answer is unnecessary.
The reference to the current administration was unnecessary as it has no bearing on the OP's case.

Well, never thought that an advice to consult an immigration attorney would lead to this sort of chastisement.

Ok, OP, do NOT consult an immigration attorney. Just do whatever you want. What do I care...

Exactly. It's USCIS' own policy NOT to deny an AOS application of an immediate relative of a USC based solely on intent.

The so-called 90 day rule has no bearing on AOS. USCIS does not follow FAM (from the DOS) guidelines. Multiple BIA court cases have upheld that intent cannot be the reason for denial of an I-485 for the IR of a USC.

Intent is determined at the border.  OP does not have to prove anything beyond that point (in terms of intent/no intent) for filing the AOS, or at the AOS interview afterwards.  The adjudicating officers also know intent is determined at the border, so it cannot be brought into question at the interview.

The nonsense that you created.  No need to be so bitter over your own ignorance.  You asked a question and you received an answer.  You're welcome and have a great day.

Why? There was no intent prior to entering. It's fine to stay and AOS.

From a practical stance, most people don't actually do it and they likely won't care. But the law as written requires the notification of a change of address.

So I get it that it's beyond you to understand why other people make different choices from you? Maybe for you it's not hard to be away from family, but for others it is. In my case, we like to travel internationally and one year without that is a missed opportunity. Nobody is blaming anyone or anything. You just said you don't understand why people want to travel soon after they arrive. It's pretty simple and easy to understand actually. Also, for many international couples, balancing between the two families is important and for many immigrants (like me) being in the US is a compromise in order to be with our loved ones and in order to make more money so that we can afford more international trips.

And you're wrong about jobs not giving you time off, you just need to know how and when to ask.

Just file AOS ASAP. Don't forget to include AP and EAD applications, too.
