as we know it the ESTA is no longer an option as Pedro has already done the overstay, and if they go through with the marriage and the AOS is completed Pedro will get his first 2 year green card, if things continue to press on with the pair in a good way, then after 3 years of marriage Pedro can file to become a USC and get an american passport, none of which would make a difference. If you have tried to make things work and they for whatever reason fail. The ESTA is already behind, if the two of them have a boni fide relationship there is no reason that the AOS should not be denied.

Now if Pedro isn't really that in love, and marriage is only to satisfy Ashley there is a problem.

congrats for you, talked to tier 2 mine was approved on 1/18/18 nothing by mail, email, or text still not updated online mine hasn't been sent to DOS yet, I am hoping by end of the week.

because they didn't give you an exact reason for denial, you may not be able to claim uscis error, they could have said it was denied for any other reason other then the job situation.
 
Anything it worth a try it doesn't hurt at all, bust make sure you have your supporting documentation, when you call in so you know how to get it to them.

on Momondo, the one way ticket is less expensive then getting a round trip ticket...If you want to return after the weeding I recommend getting a round trip where the return flight is far into the future, you can only travel for 1 year from the time you get your green card, after that 1 year is up, I do believe, and please don't quote me on this, but I believe you will need to have filed for a travel permit IE: Re-Entry Permit or Advanced Parole.

there was also a June approval, but again I just got off the phone to confirm what the Tier 1 rep told me last night, and it is correct, NCS is not working the cases in the order they are received, they are in fact working randomly in 3 month intervals. 
so say...March, April, May are the three months, they will chose random files now, just randomly picking files in those 3 months to work on and finish. If March gets all completed they will add June to the Mix randomly picking files of whats left for April, May, and June.
 
This is how we are seeing cases ahead being approved and random cases behind being approved.

depending on your country from what I understand the police certificates are good for 6 months to a Year, however I wouldn't get it until the case gets to NVC, and there really isn't much else you can do but wait, you can start gathering all the evidence together for proof of marriage, there isn't any forms you can do ahead of time. You can't do the Medical exam until you get the list of approved places to have it preformed at. So really just try and be patient, I know its hard. I would make sure you have all your W2 for the last at least 2-3 years in one place, and get the Tax returns for the last 2-3 years together really just getting papers you think you will need together is all you can do.

I know it sucks, and worst part is some of those on this threat who were recently given their approval have had to wait over a year to get it. We are all in for a long process but will make all things worth it in the end.

I will tell you from experience, if you call the customer service number for the USCIS office, your going to be told the same information you can see on the website, and if you attempt to do a service request by phone, and according the the processing times for USCIS website hasn't passed your PD, your going to get a generic response "that you case is in line to be reviewed by an officer, and to allow 60 days, if you haven't heard back in that time to contact us at the number below" however there was no number below on my form. Do not think to go to your your local State Senator's office, because frankly they don't care that your waiting either, and all they will do is send an email to the service center and not push it.
 
I would wait until your PD passes the date that the USCIS website states it is currently working on, if that date passes I would do a service request.

I haven't seen anything, and you and I both have PD first part of May, it appears as if they might be into the middle to end of Feb now, which is good and bad, they are still moving slow but getting closer to us. I would venture to say that by looking at some of the Feb filers, that they haven't been on to update their status, so there is a good chance they have approvals and they just haven't updated the VJ timeline. we both need to hang in there. I don't know about you but it is frustrating to see all these other service centers with approvals past our date, but our time will come.

I wish everyone luck, as from what I heard they look harder at the undeveloped countries as they consider them to be higher fraud countries. I didn't know we would be in for such a long haul, just keep our head up and keep pushing forward, I also feel so bad for those waiting now a year plus for approval but they have to be coming soon.
