    Don't worry you're not alone. I'm on 182 days. Still no NOA2. Maybe all of us who got left behind have the same USCIS officer. Cant imagine what's taking this long.

    I called USCIS and spoke to tier 2 again just a few minutes ago. They still don't have an update on my case, except for the service request email I got saying  " we're actively working on your case" blah blah "you can expect a decision within 45 days" ARE U KIDDING ME. 
     
    Tier 2 officer says that's all the information he can get, and he sympathizes because his wife is Japanese and they went through the exact same thing. Haha

    She didn't say they got married.  She said...
    . People are saying we should've gotten married first and applied for the spousal visa but wouldn't they also ask for proof of domicile? The only difference is we're already married but if he's still a resident of the Philippines, it doesn't make a huge difference, does it?

    Thus the statement is a hypothetical one.... Hypothetically if we're already married it wouldn't make a difference anyway...

    For the K-1 proof of intent to establish domicile like school enrollment proof,  housing arrangement documents etc. may be sufficient it will depend on how the interview goes... You will not be denied the visa based on domicile but you may be put in AP asking for additional documentation on the domicile issue.

    Oh, OK. I though they were saying they got married!!! There are a lot of people that do that. 
     
    Yes, domicile is pretty easy to do. Also, you can have your interview a bit later if he needs some time to get his paperwork in order. The start of school + moving can be a bit crazy, so he might need a month to get his things in order.

    If you are already married in the Philippines, then you are no longer eligible for the K1 visa. Applying for the fiance visa and stating that you are not married on the I-129F is misrepresentation and will get you ban from entering the country.
     
    It is not difficult to establish domicile in the US especially since he will be coming back to the US to start school. If he filed a I-130 for you now, by the time of the interview, he would already be living in the US for awhile and be able to fulfill the domicile requirement.

    Another smell of desperation of living the American dream.

    K-1 visa holders have to adjust status through the fiance(e) that petitioned the I-129F. If that is not possible, the K-1 visa holder has to leave the US as there is no path to a green card or legal stay. At this point it's useless to contact an immigration lawyer as it won't help the situation at all. The petitioner and beneficiary have to get married in order to proceed adjustment of status. Your friend should leave the US to prevent any damage for the future.

    Wow you're really not getting it - immigration lawyer can't help. She can't adjust status by marrying another man. The way you keep asking questions sounds like friend is only after a green card. 
     
    Have your friend go home and next time she finds an American she better marry in PI and not go for K1 visa.

    Yeah, I got my RFE earlier than those with receipt numbers close to me but didn't think I would take longer to get my NOA2. I can tell by how quiet this group has suddenly been that everyone has moved on with their petitions and could possibly already be with their loved ones. I'm really happy for them, but it's still tough being left out! Haha

    Hello, I'd like to know if I am able to work in any capacity during the K-1 Visa Transitioning phase, Here are my questions:

    1. After first moving to the US, can I still work for UK clients prior to gaining marriage/green card status, during the transitioning phase?
    2. Is there any capacity that I can work for myself, selling digital content online, prior to gaining marriage/green card status, during the transitioning phase? 
    3. After marriage, how long have you generally had to wait, before you have been able to work?

    Thank you for any responses that may shed some light.

I can tell by how quiet this group has suddenly been that everyone has moved on with their petitions and could possibly already be with their loved ones.     It's been rough on us too. We were planning to be together for the coming holidays and the window for that to happen is closing very quickly. I'm seeing some people get RFE after waiting 190+ days.  I hope we all get an approval soon.  It's day 183 for us without any word.

    I felt the exact same way with the January group back then. Most everyone was almost done and I was left behind. I only had USCIS to blame though, as it wasn't their faults USCIS was faster for them. I ended up moving to February, then March, and finally, I got the NOA2. The good news is that the longer you wait, the closer you really are to that NOA2. Hang in there.
