  1. Does anyone know if i can do an application for the B1/B2 visa while the k-1  is still processing? Also what are the chances that they will approve the application knowing we have a pending application already?

      Yes you can apply.

      The odds are against you. A pending K-1 implies immigrant intent. The INA requires a presumption of immigrant intent. A tourist visa requires not having immigrant intent.

      The main way to overcome immigrant intent is via strong ties to return home. A K-1 implies you will be moving to the US in the "near" future...so any claimed ties aren't really ties since they will be broken soon.

       

      But the only way to know for sure is to apply. It's rare, but people have been approved for a tourist visa mid-process.

  2. Not sure if this is legit!

     

    We submitted our I751 application to the Dallas office in June 2020: NOA1 Receipt date - 8 June 2020

     

    We received an I-797 " APPROVAL NOTICE for I 751" with a notice date of 20 Jul 2020 today in the mail.

     

    Checked the USCIS web page an it says they received our request and are processing it.

      Yeah, contact USCIS to make sure it's not a mistake. That timeline is not even remotely normal. Hopefully it just got put in the wrong pile or something and ended up at the front of an IO's desk.

  3. Hello! I am a LPR petitioning my husband who is outside of the  U.S , my question is If my 3 last year income are beyond the required amount, but currently am not working frankly i resigned at my job last year in november to go abroad to visit my husband. I stayed 5 months comeback pregnant and due to covid-19 i was not able to go to work for my health safety. I am at NVC stage where i need to fill out AOS so, can i fill it out without current paystubs just only my 3 year verification income which for sure they have a good amount to qualify me and my husband or i have to wait, get a baby and go to work after then present my paystubs? 

    Please any idea or comment will be appreciated. Thank you all.

      Your current income would be $0, which is obviously below the minimum requirement (125% of the FPL) for consideration. As such, you need either sufficient assets in lieu of income ($5 assets = $1 income), a suitable joint sponsor, or to obtain employment meeting the minimum income requirement.

    Many thanks to you and all the mods for maintaining such a useful site.  So much valuable information here.

     

    Related to that, can someone (I'm happy to help in any way) update the K1 AOS "Guide" page to now include the dreaded I-944?  Right now the list does not include it.  I could write up a brief explanation of the form like you have for the others if it would help.

  7. I received a request for an I-485 interview for my wife about a month ago and said they will follow up with a scheduled date but so far no response. Is the Trump immigration suspension affect the interview we are waiting for?

      All interviews are suspended right now due to COVID-19. They aren't doing any at all right now, and probably have not scheduled many or any new ones yet.

  8. I saw refused on my cr1 status today. 

    After interview in oct 2019, I was handed a 22g and asked to provide 2018 tax transcript with my passport handed back to me. Wifey contacted irs , after two weeks  I sent it through dhL which I was instructed to do before I was placed on Ap. Now this “ Refused” 

     

    I dont know what next to do. Can someone guide me on what to do, pls.

  9. My fiance was mailed a physical letter from the NVC on the day our application was shipped to the consulate. It arrived about 2 weeks later. I don't see why they didn't email. I provided our email addresses per the instructions in the PDF, but I guess it didn't work.

      Here's what "should" happen. But even this doesn't always occur.

      NVC sends a physical letter to the petitioner to notify them that the petition was sent to the consulate.

      The consulate sends either a physical letter and/or email to the beneficiary when the petition arrives. This will either be a packet 3 to submit documents prior to scheduling the interview, or a packet 4 with interview instructions (where you would self-schedule the appointment).

      Depends on the consulate. Some do physical mail. Some email.

  11. Say you have your naturalization ceremony on March 1. They take your green card at the ceremony and give you a Certificate of Naturalization. You're planning on going on a trip out of the country 2 weeks later. Do you expedite a U.S. passport in order to re-enter the USA when you return? Or do you take a copy of the Naturalization Certificate (or heaven forbid, the actual certificate!?) with you on a 3-week jungle trip? We don't know what to do...any advice?

      A newly issued US passport is not an issue for re-entry. Just use that.

      A naturalization certificate is not suitable evidence for boarding a plane. It would only be useful if you can get to a US border, or to obtain a US passport while abroad.

      You need to get the passport.

  15. We have received today a form called Request for Evidence (RFE) from USCIS. 

    It seems to be a new additional requirement.

    All they are asking for is additional evidence to process the petition I-130. In our case, they are asking for one US passport-style photo. The photo must conform to the US passport photo specifications. My spouse's US passport was done in Feb 2019 but USCIS now requests photo taken within 30 days which will be challenging due to the current wait to process petitions. Thought we'd share this info as many of you will likely get this exact same request.

      They need a 2x2 US passport-style photo (not their actual passport photo). This can be obtained at various locations like Walmart, Walgreens, CVS, etc. Or you can do it yourself and print to a 4x6 and cut it out (if you want to save a few dollars and have no difficulty dealing with this stuff). This was required in the initial petition per the instructions and guide on this website.

       

      While they almost certainly can't tell when it was taken, the instructions say 30 days so I always say follow that.

      Yup, just hold on to it. Either that or the approval notice is needed when you get to AOS in the future (after getting the K-1 visa).

      It means they accepted the petition. A paper receipt will come in the coming week or 2. Now it's the long wait for approval of the petition.

  20. Is the Affidavits of support form free for k1 visa? and how will it be submitted (if at all) or it to be taken along with me to the interview with other documents that thats comes with it ?

      There is no fee for the I-134. It is presented at the interview.

  21. I mailed my I-130 to the Phoenix lockbox as directed on the instructions.  Does anybody know what service center the I-130 would go to after everything is finished at the lockbox?  I would like to track the timelines at the correct service center.

      It will be routed based on internal rules with USCIS. There's no way to know for sure where the I-130 will end up until you get the receipt notice (NOA1), which will state the service center.

      Odds are Nebraska right now, but nothing is guaranteed.

Hi, my fiancé had her interview on August 6th and we were told by the consular that we were approved and that the visa should be issued within 4-5 business days instructed how to receive it via aramex after a week we got a notification from aramex that the passport was ready for pick up “online status still said read at that time” went to go get it we got the sealed envelope but the passport had no visa printed on it went to the embassy right away and brought back the package that was sent with aramex they took everything “including the sealed envelope” and than after a week sent it back but this time it was the passport with 2 papers saying that the application is at “administrative process” and required me to answer 10 security questions about my full name/social through media/relatives/lived and travelled etc.. through email. what exactly is going on? Is this normal?

      I don't see a reason to worry...it just will likely take a while longer wait to get the visa. Barring a national security concern, AP should complete  and the visa can be issued.

      Only potential issue is if the medical exam expires before AP completes, then a new medical exam will be needed.

      Sounds like they mistakenly sent the sealed packet back before the visa was issued.
