NYC waiting game

Hi everyone, 
 
I am here to give an update on my parents' cases. 
 
I submitted i130 on June 4th, got a RFE for birth cert in Sep, which was in the first submission. So I re-uploaded and explained in the cover letter. 
Two months later, today I got approval notice for both of my parents. Both cases were in Nebraska if that helps. 
 
Next step I will have to wait for the cases to be transferred the NVC. So good luck to me and everyone!

When people come into the US without the intention to immigrate and there's a change in circumstances, it's okay to adjust.

What you are doing is called preconceived intent because your parents are outside the US and you are contemplating having them enter the US on non-immigrant visitor visas with the intent to immigrant.  

It is illegal to enter the US via a B2 visa with the intent to stay and adjust status.  The terms of service of VJ do not allow us to discuss it further.

I am planning to bring my parents to the US and we are debating if they should visit and i130+i485 in the states or should we file i130+NVC?
 
We are worried because there seems to be a huge backlog in NVC that might delay everything. Surely it's a personal choice, but I would love to hear your thoughts. Thank you.

Updating my status here to hopefully bring you some good news.
 
I filed in Jan 2020 (Queens filer) and attended the interview today. The officer was nice and straight to the point, didn’t ask for any document other than the ones I uploaded.
 
I did asked about my pending 751 case which she said she’s going to approve. 
 
The status has not changed online yet. We shall see.

Log on to myUSCIS and viola - interview has been scheduled for Dec 14. Im Queens filer here.

So I checked my USCIS today. The wait time shows exactly 9 days, which I am not sure how accurate that is.😂
I am a Queens Jan 2020 filer with i751 pending, so I would hope the interview would be a combo of both. 

My case # is EAC19900454xx so I did search from 1990045300 and search for 200 numbers. You can see most of the i751 cases are still at fingerprint stage, I think we are still good? 
 
 

I know it must be frustrating. I had the same issue. The first time I called them, they won’t let me get info pass because the reason I gave them was starting a ne job, which is true, but they don’t care.
 
I called a week later for info pass, the officer called me and asked for reason. This time I said work related travel, he gave me an info pass appointment.

I filed a non-delivery last Friday when 30days was up. Haven't heard anything just yet. My case was received Jan 9 and also EAC.

On January 15th. Online it just says the typical received and that we don't have to do anything. But it also says that something was mailed and we didn't get anything dated around then so idk. First time we received something was today. Idk if I missed something else? Never received the extension letter. 😌 But biometrics is still a good sign.

Already got that letter and completed biometrics on the 4th of Feb. 

I did.  And then I got it again.  And then a third time....I never asked for it tol be resent either.  I also got 2 different  biometric appointments.

Update for everyone - especially the New York folks.
 
I received biometric letter last Friday Feb 1 for next week. I decided to walk in today and got it done.
Still no receipt or extension letter. Do you guys think I should file for non-delivery once it fits 30days? Do the receipt and extension letter come seperated? 

We received the biometric notice first too.  See my signature below and you can see sequence of events for us.  If you do not get the extension letter within 30 days of when they received your file, submit an e-request.

Alright folks! Just got a letter today from USCIS and it’s the biometric for Feb13. Do you guys know how much longer would the extension letter? I’m reading some Nov and Dec threads, doesn’t seem to have a pattern. Should I request that from USCIS online?

I’m in NYC and spoken to a few lawyer but seriously all of them are awful. They don’t care about the case And mostly handled by associate. I eventually nailed down to one but still they screwed me up big time. Anyway try talk to a few lawyers and hopefully u get a good one. U could go search on Avvo or Superlawyer.
