SalishSea got a reaction from OldUser in K1 Visa processing but family situation horrible (need advice)
You cannot reside in the US on ESTA.
How old are you? You stated that you’re adults, but if so, how are your parents able to so closely control your life like this? Maybe it is time to look for better/full time employment and a more independent living situation?

IMHO you're not getting an immigrant visa for the US, DV or otherwise..

You will have problems …even without the convictions rising to the equivalent of a US “ criminal threat” and notwithstanding the short 4 month sentencing nor post conviction relief.
‘I would even guess they could assert a Reason To Believe …xyz. inadmissibility .

How would we go about the job changes? We once tried calling their phone line and it just gave us a bot instead of a representative 😕

You can request, but when the financial loss is because of your failure to file or failure to do your research, expect a no. Costs nothing to try.

Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to timely file the benefit request or to timely respond to any requests for evidence; he can try it

I can’t imagine those will be issues. The DOS is very well versed in the identification of gang tattoos.

SalishSea reacted to NEO2023 in F2B case with complication
Thanks for the information. That's a regulation, not a law. Currently, the law remains silent on this issue.
However, due to this regulation, if one goes to court in the event of a visa denial due to marriage, he is likely to lose.

The law is not silent on this issue. The law for automatic revocation is in 8 CFR 205.1(a): https://www.ecfr.gov/current/title-8/chapter-I/subchapter-B/part-205/section-205.1
§ 205.1 Automatic revocation.
(a) Reasons for automatic revocation. The approval of a petition or self-petition made under section 204 of the Act and in accordance with part 204 of this chapter is revoked as of the date of approval:
(I) Upon the marriage of a person accorded status as a son or daughter of a lawful permanent resident alien under section 203(a)(2) of the Act.

As you are the only person I have come across who thinks a LPR can sponsor a married child I think the onus is on you.

SalishSea reacted to K1visaHopeful in AOS Filing another Affidavit of Support i-864? (Already did one for k-1 visa petition)
The petitioner provided the K1 beneficiary with an I134 (not an I864) for their K1 visa interview.
An I864 is required for I485.
I134 and I864 are not the same.
The I864 must be filled with current details and have current supporting financial documents so even if they were the same form, your documents would be not current.

I understand, but the marriage will happen in the US, where it is legal and the staff at the Embassy will treat it accordingly

Time to put on your big boy/girl pants and take control of your life! I know it’s easier said than done and there might be some cultural things happening here but again, you are an adult. Get a new job, see if you can crash at a friend’s house until you find a room, etc. If your partner is financially stable enough, they can also support you for the time being.

Do a Cover Letter titled Supplemental Filing for I-129 F , list the enclosed evidence along with copy of receipt notice. Excellent odds to avoid RFE

Seems a bit odd to discuss marriage within mere weeks of meeting someone, especially when you’ve already had a bad experience with a foreigner…..

Doubtful.
You sent the petition three months ago? Processing time for I-129F is currently 13.5 months.

Did you already know her before she entered the US? When did you meet her? Even if you met her the day she entered the US, discussing marriage (especially in her circumstances) seems VERY hasty..

SalishSea reacted to Boiler in B-2 Tourist Visa
Not many people can afford to retire at 60 nowadays, having a good pension will help.

SalishSea got a reaction from milimelo in Are Canadians with B2s granted 6 months per entry or 6 months per 365 days? (merged)
You were rightly denied entry because you were de facto trying to live in the US on a nonimmigrant status. Going forward, you should plan to use the entry privilege more like a proper tourist, for reasonable periods of time.

SalishSea got a reaction from pushbrk in Transfer IR1 interview from Dushanbe to Almaty?
I think you’re misunderstanding the requirements. Individual consulates do not set their own medical requirements.
