    I've been a stay at home mother and wife, as well as a board-certified oncology RN with 25 years of experience, so: I can confidently say that being a non-working spouse/mom is absolutely no easier. Nor does it have lower responsibility. Running a household and keeping children alive and happy is harder work, with higher stakes. Don't underestimate your worth, or your obligations.

    If she is here on a green card, why would she need another visa? Your post doesn't make sense. Very, very odd also that she was able to obtain a visa with that criminal history, as the US consulate would have done their background checks as they do for all immigrant visa applicants. Something does not really add up here.

    It’s not that difficult. Are you using sources like TikTok for your info on immigration? If so, I strongly recommend that you use USCIS, the actual source. And, social security is completely separate from USCIS and immigration.

    Of course it makes a difference. Being the spouse of a USC confers no immigrant benefit. She will be out of status and subject to deportation. Also, fees are about to go WAY up.

    Photos are not primary evidence for the required meeting, because they do not show a date. Boarding passes and passport stamps are best. Flight itineraries are not good, because they can be printed and then a trip not taken. No, you cannot “bring” your fiancé to the US while the visa process is underway. Does she have a B2 visa already? She can apply for that, unlikely to get.

    Your father (a USC/LPR, right?) lives in a congressional district and also has two U.S. senators from the state where he resides. Your father can reach out to them, and they can make an inquiry on his behalf at the U.S. consulate to try to get info about your case.

    They are talking about Dublin, a POE/preclearance site for US CBP. Visas are processed and travelers are admitted prior to ever getting on the flight.

    I think the FOIA is essential, and probably a lawyer, too. Maybe @Boiler will arrive and weigh in on the waiver issue, but I would expect it to be difficult to obtain a waiver for a tourist visa to visit siblings.

    Okay so zero percent of this was clear from your initial post. It's not our fault if we can’t understand a poorly-explained story with jokes in it. You were denied entry for immigrant intent. You will need to develop stronger ties do Canada if you want to be admitted to the U.S. With a history of illegal crossings (into either country), that will be challenging.

    So you crossed from the US into Canada illegally, and then tried to come back into the U.S., on what type of visa? What is your citizenship?

    I can’t speak to the laws of other countries, but the bottom line is that people visit the U.S. on nonimmigrant visas are not permitted to do any type of work (including online) without authorization.

    You entered on ESTA, then decided to marry and try to adjust status. They will rightly assume you’ll try to do the same thing, to avoid the queue. You could try for a B visa, but I don’t see that happening either, with your history.

    OP, have you read the guides? The petition processing time is only one part of the overall process.

    What do you mean? That affidavit isn’t a thing in the U.S. If that is a special requirement of the Chinese government, you should ask a mod to move your thread to the China forum.
