  1. It is no longer "fastest" overall, and the AOS process for K-1s is a big negative. Most of us who did a K-1 even when the petition process was only 6 months (vs current 13 months) would have chosen a CR-1 in retrospect. "Fast" is not a reasonable criterion for choosing a visa in 2022.
  2. It is not a stalling tactic. Generally, the I-129F petition is about the petitioner, including the background checks. However, vetting can occur anywhere from petition filed to visa issued.
  3. This is not an immigration question. If you are eligible for US military veterans survival benefits, the only way to ascertain that is via the Veterans Administration. As far as I know, there is no route to a green card via a deceased person who never filed a petition.
  4. Now that is completely different from what you originally said. Domicile for joint sponsor is different than domicile for the primary sponsor, your USC petitioner. Any joint sponsor must be either a USC or LPR, and evidence of that is required.
  5. Totally reasonable. I'm sure lots of people want out of Russia, but it is not your job to facilitate that for him.
  6. Wow. Beyond ridiculous. I can't see any US judge awarding him alimony, ever. He hasn't lost anything (except GC!), he is still home, he isn't unable to work because he's taking care of your kids, etc. You got this, girl. Another idea: if his end-game is a GC, isn't it in his best interest to divorce quickly so that he can find the next USC prospect?
  7. I wouldn't give him a dime. Totally opportunistic money grab. In most cases, 'alimony,' or spousal support is designed to help the spouse with fewer resources to "get back on their feet." Did you live together, and did you support him financially? Personally, I'd dig my heels in. Sounds like it was a short marriage that didn't even progress to living together, and someone wants to harvest the US dollar.

  9. How do you support yourself if you do not work? If scraping up $2k for a car repair is a challenge, I don't see you being able to afford to AOS, which would mean your wife sponsoring you, and you not working for up to 8 months. Immigration is not cheap.
  10. Removal of conditions would only be denied if they find that you received your conditional GC through a fraudulent marriage. Why are you worried about that?
  11. In our experience, they do. They wanted a current I-94, which we did not have, but they accepted my husband's passport in lieu of that, and made copies.

  13. Then I wouldn't worry. Sounds like "normal" AP, vs a potentially extended one.
  14. If your application is in AP, there is not a lot you can do but wait. Were you required to submit a DS-5535 for additional background checks/vetting? If you have travelled to certain countries in the interim since the last visa was issued, that will complicate things.
  15. Did you ever formally withdraw the petition? Are you sure that it has been closed? I agree that it is worth a try to have it reinstated, if it is still located at the consulate. They have the ability to reinstate 'expired' petitions, particularly in the age of COVID. I would request that in writing, along with fresh letters of intent to marry. Good luck!

  17. That would be nearly everyone here. We have all had to wait our turns, or are still waiting. Comes with the territory when we choose relationships with people in other countries.
  18. If you do pursue the CR-1 route, be aware that the bonafides are evaluated even more closely than for a K-1. My guess is that to overcome the suspicion that he is in it for a green card, you'll need to spend much more time together, commingle your lives some more, and like someone else said: possibly move to Haiti for awhile. In the time that will take, you can work to improve your financial situation.

  20. Have you read the guides? First step is to complete the petition. Everything else gets submitted later in the process.
  21. Seems you guys have all kinds of issues with following instructions for forms. If he paid an incorrect fee, the application will be returned for resubmission.
