oh... and LOL @Dublindave..... You, my friend are spoiled! Getting your K1 in 4 months from i-129 filing... bahahahahah I see why you are impatient...
Try 8 months....
We truly were blessed to get it super quick. Im in college so it's not a huge deal for me to have the Green card or EAD. I feel so sorry for people who have nothing to keep them busy. Glad you guys are seeing things moving.

)
Congrats! Great news! Can you send some of that good luck over to the December crew.
I've been reading this thread multiple times a day. I miss making my own money.

You could have an issue with an over stay on your hands. When K1 adjusters go over our 90 days on I94 we go into a period of over stay and become out of status this is forgiven when you get your green card and adjust to LPR. Because you left without adjusting you might be classed as someone who over stayed and might need to apply for a tourist visa and not use VWP. Or receive a ban when you try to enter again. But I would write to USCIS or put in a request to have your case closed too.

Poverty guidelines for a I129F are just 100% which is 16,020 per year. You submit the I-134 affidavit of support not I864. For your income I would suggest you go home and get a job in the US, then when it comes to the interview you will have proof of income to send your fiancé for his interview. My wife done the same thing and the embassy accepted just 2 months worth of payslips from her new job. You can also get a Co-sponsor for most embassies.

Just spent about 4 hrs filling out our taxes lol
Using the 2555ez to fill out my total earned income (gross income).
Got the dollar conversion from a site referred to on the irs website.
http://www.x-rates.com/average/?from=USD&to=SEK&amount=1&year=2016
I used the average conversion over the 11 months which I received wages. Filled in the physical presence portion qualifying months as the 12 months from when I arrived here and 12 months back. This was very straight forward. This amount was transferred to the joint 1040 (added to my husbands income on line 7) and writing "2555EZ" ($xx,xxx.xx) on line 21 other income. Then subtracting this from line 7 and putting this number as Total income. THE WHOLE amount is therefore excluded.
After filling in the standard deduction fields and the exemption fields (and any other fields that apply to you) you can then get your Taxable income on line 43.
After that you have to figure the taxes using "worksheet for foreign income" from the instructions, and the tax tables as instructed there.
It was a lot of reading but it was doable...
Did you end up owing money? Im assuming not since you are filing the exemption. well done doing it all in 4 hours it will probably take me six weeks to figure out.

You will put your whole foreign earned income as an exclusion on your joint income. So whatever you you made will be excluded from what you as a couple report as your joint income to be taxed for. Overly-simplified, if he makes $30,000 and you made $3,000 reported as FEI the exclusion makes it so you as a couple only report $27,000 as your total income, effectively also reducing the amount of taxes you will jointly pay. Of course there are also other deductions/exemptions and so forth that might apply to you specifically...but that's how it works in theory.
You write this all down on the form Maria mentioned and then transfer the combined total income to the tax form 1040.. where you then continue to calculate your joint taxes..
This will mean at the end of things that your husband will most likely have payed taxes through withholdings that your FEI will help balance for the two of you and you will get back a tax return later in the year with this money.
This was very roughly put and as I have understood it. Lol we need to help eachother
post as much as you need I will!
Sorry to hijack this thread, but if Im reading this correctly. Me as an Irish citizen moving to the US in November to get married in December, currently adjusting status. Fill out form 2555 and attach it to the 1040 and all my income earned while living in Ireland will be excluded, I wont pay any taxes on it?
Im not giving the US government money for a job I worked at while living in my own country. I have very big problem with doing that.

Im in Utah and was able to get a 1 year license with my NOA1 for my adjustment of status. I don't have an EAD.
You should wait until you get the NOA1 and go to the DMV with your passport, NAO1,proof of SSN + proof of residence . They will use your A-Number to verify you on the DHS save case checker. But this all depends on the states rules, it looks like Alabama want proof of an approved I485... But you never know a lot of it's down to the luck of the person who deals with your case.
Wish you all the best

I would just like to share my experience around obtaining a Driving license in the state of Utah while adjusting status through marriage to a US citizen. I entered the country on a K1 visa.
All threads I've read on obtaining a license in this state ended in failure for the immigrant applying for a license past the I94 expiration date without a valid Green card or EAD. I have neither of these and was able to get my Utah license which is valid for 1 year from today.
Utah like other states require you to show proof that you are in the country legally verified through SAVE. To satisfy this requirement I showed my passport with my I94 (Legal entry proof) and my Noa1 for my I485.
Today Instead of using my passport number or I94 the lady at the DLD took my Alien registration number to verify me with SAVE. When I received both my SSN and temp license back in December, the two departments used my I94 number which expires in 90 days. The consequence of using these numbers at the DLD is you only get a license with a couple of months valid or until the I94 expires, thats what comes back from SAVE
I think some people have run into issues with not being able to get the 1 year license because the DLD uses your I94 and passport to verify on SAVE instead of the A-number which should be used when you have received your NOA1 for you I485.
So if you are going to the DLD and using your NOA1 from your I485 to get your license, tell them to verify with your A-number. You shouldn't have the same problems as lots of people in the threads of searched for around this topic.
I hope this makes sense and can help some people going through this. I got my license in the Provo office in Utah and had no hassle at all.

Some colleges in certain circumstance will let you change your status from non resident to resident, reducing your tuition. Out of state and international tuition is much more expensive.
A school I was looking at automatically gave you residence status if you married a resident from the state the school is located.

That lady is not nice at all. The girl needs a reality check. She tried her damnedest to cancel my interview on the day. Asking for things that where not on the website or in the Packet 3. It was proof of address for the place I'm staying in the US. Lucky I had it just by chance.
In your case, you need to be less nice to her. if you push back she backs down, If you get what I mean.
Don't roll over and take it.
Maybe get the tax doc's notarised or verified by a lawyer. Or ask the IRS for your online log in to print off your tax statements from the IRS website. Or have your man print them from his computer in Ireland. Thats how my lady got her docs for my Affidavit of support.
Also tried to cancel my friends interview a few weeks before but he asked to speak with a manager and she backed down. I feel your pain. But don't let her bully you.

yes it has changed to a non immigrant visa. Yay
It will be issued very soon.

Does anyone know what this means: "
ase Creation Date: 26-Oct-2016 Status Updated Date: 26-Oct-2016Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days. It's a good sign. It means they're just doing the final checks on your visa and will issue it soon. Mine went into Administrative processing and changed to issued the next day.
Has it changed to a non immigrant visa?

Thanks everyone for the responses. I do have a couple friends with husbands from the same country, and the husbands both said that this behavior would never happen. Wives are treated very well usually. They think he's dangerous. The thing that throws me is how could he fake an awesome personality for 3+ years? I am still in love with MY husband, the one that was waiting forever to be with me forever to live happily ever after. I am feeling like, I am in mourning, like MY husband got murdered or something and this person stole his visa. I don't know this man. Same looks, but personality is horrible...and all he ever does now is beg me to forgive him, he accepts responsibility for his abusive behavior towards me and says he feels bad about it, and wants me to let him prove he will never do it again. But he's said it before...many times since he's been here the past 5 months now. I called ICE they said if he breaks his ppo he will be arrested, and to call them immediately, and they will proceed with removal; because he is still conditional for first 5 years after arrival...& there are certain things immigrants can be deported for, and violating a ppo is one of them. The thing is, that would be forever... but I want MY husband. Does everyone here really think this man can't be rehabilitated through the DV class therapy? How do I accept that THIS man really is MY husband, and scammed me this whole time??? Am I insane because I want to believe him, that he'll change? How can anyone do this to anyone? Should I call his family and tell them? He's threatened suicide. The first week he was here we went to a gun dealer, he found a semi-automatic black rifle they said he could buy for around $700, he had plans of buying it "for protection" ...until i added that in the ppo that they should ban his ability to purchase a firearm. Oh, btw...he used to follow islam. I wore hijab of my own free will while we were separated waiting for issue. After he got here, he made me stop wearing hijab, and wear tank tops and short shorts...we never prayed, nor followed Ramadan this year, never went to mosque, nothing islamic. He drinks alcohol now, occasionally. His family knows nothing. I haven't skyped with them for months, because I don't want to lie. I know, he sounds horrible. He even commented to me, laughing... that he would do a bomb like the one in new york, the pressure cooker one, in the dumpster if trump paid him, and made him disappear. He told me isis is hiring in his country...you pledge your life for 7 years, they pay you like a king, but at the end of the time you have to give your life as a suicide bomber, no exceptions, no way out. Why would he tell me these things? I seriously think whoever this guy is, is psychotic and possibly dangerous. BUT I don't know if he was just talking or... if it's possible he would do something. I don't know who this man is, but he looks like MY husband...how do I handle this, and being committed to marriage, shouldn't I give him a chance to prove he wants to be a good person by going to these DV classes? I know, I sound like I'm mental...but I'm devastated and feel like, wth is going on??? I have been going to therapy, talked to domestic violence advocates, my doctor put me on xanax, talked to the dr's office counselor, talked with friends....but I still feel sick. I believe he is a narcissist sociopath...but again, is this man really MY husband, and HOW did he pretend to have a completely different attitude/personality for over 3 years? Was is like a split personality? How do I get his old personality back? Was he possessed? Can anyone help me to make the connection? Thanks for any response.
This is the most heart breaking thing I think I've ever read. I just want to give you a big hug and tell you everything is going to be alright. I was in a terrible relationship last year with a horrible person that used me and abused me and went off cheating on me and told lies all the time. It took every fibre of my strength to break free. I was physically ill for months pining after her and just kept thinking of the good times we had at the start and couldn't believe the person she became at the end. But you know what time heals all wounds even wounds from a broken heart.
Im sorry this is happening to you but keep yourself busy get out and hang out with friends and family because there is nothing worse then sitting around the house thinking about what ifs and maybes. This guy had his chance and blow it, You can do so much better then him.
Take care

While I can't say I know the policies and guidelines of every college in the United States, every private college that I'm familiar with only has one tuition price and does not have a "in-state" rate. Tuition is also not tied to a school's accreditation, and federal grants are not related to it either (except in some indirect ways perhaps).
It just sounds like the school is unfamiliar with K-1 visa holders.
Yes thats exactly what happened. Just someone in the office giving me the wrong information.
Thank you for your call this morning. After speaking with you, I checked with (name removed), our office director, to clarify a few things.
Regarding your situation, currently in K-1 status, you will not be considered an international student and will not be required to change status to F-1:
1- You will not be required to make an international student deposit.
2- You will not be eligible to continue studies after winter semester without proof that you have applied for Permanent Resident status. I am certain that you know this is required of those on K-1 visa status after they have married a U.S. Citizen, so I imagine this will be no problem for you.
3- If your PR application is somehow denied, please understand that there is no financial aid or assistance for students without lawful status in the U.S. and you would not be eligible to continue schooling at that point.
Received this a couple of hours ago. It's safe to say Im a very happy man now. That first email just did not make any sense at all. When I rang the lady that sent that mail today she was mad that I was told to switch to a F1 visa by the previous assistant.
The school I will attained is a private institution and does not receive any state funding AFAIK. We as members in good standing received reduced tuition, all non members pay a significantly higher tuition.

My status reads it should be with me within 10 days. I think I'll get it by Monday. I live 5 mins walk from the embassy I wonder if they will let me come walk over and pick it up. hahah probably not.
Kara I think they send an email with your DHL tracking number when the visa has left the embassy.

My status on CEAC just changed to issued..... That was quick.
Good luck to everyone still waiting for their interview dates. Wont be long now.

Classes don't start until the 9th of January there is no deadline to register for classes before this date. My account is on hold with the school until I get this sorted status sorted. The 18th of December is the day my USCIS petition expires which is exactly 4 months after my NOA2. I don't understand why the school has latched onto my USCIS expiry date. It's not important at all. That email makes no sense. No if they said you need to have proof of application before classes start that would make more sense. I just don't understand. Also Im not entitled to apply for a student visa now. Because Ive immigration intentions If I remember correctly thats the case.

Hi I don't need to provide residency. it's a school run by my church. As long as I'm a member in good standing I can attend for reduced tuition. I just don't understand why she wants the application receipt by the 18th of December. Is there something significant about that date or is she just confused. I understand I have to adjust status i just thought I had 90 days to do it.

Hi guys i really need some advise on this. I've applied for a place at a university in the state I will be living in. My K1 has been approved and i expect to enter the US on the 3rd of November. My wedding date is the 10th of December.
I got this email from the college I will be attending. They ask for international students to pay a deposit of 4000 dollars and provide affidavit of support to receive their I20 so they can get a F student visa. Seen as I wont be needing a student visa they just asked me for my I-797 I got from USCIS. After I sent it i got this reply.
We would need to see a proof of his application for permanent residency in order to waive the deposit.
His I-797 form shows that his approval for a fiancée visa is valid until 12/18/2016.
He can either apply for permanent residency before that date and show us his application receipt, or he can come to (college name removed) with a student visa.
He would need to change his visa for that, and he would need to pay the deposit and provide the other documentation.
Hope this makes sense.
Kind Regards,
I believe this information is completely inaccurate and was just wondering if anyone has any advise on what I can say back to them.

Next stage is issued
Are you sure :-)
My interview was only yesterday and they told me it would take 10 days. I've got a very popular family name and given name, so thought the FBI checks or whatever they do would take longer then a day.
I'd be so happy if it was issued soon.

My visa status has changed on the CEAC to Administrative processing but interesting the visa type has changed from immigrant to non immigrant visa. Im assuming this is normal? Did this happen to other people?
