    It's your son, his life, do whatever it takes, ask your close friends, give them gifts or hire somebody, see if you can ask her uncle neighbors, do everything you can to see what kind of person she is. I don't believe really it is her uncle but you need prove, see if you can pretend to be a guy and chat her with her in Tender. I hope all will go well for you and your son. Good luck!

    You are right, this is almost unbelievable that one person could have so many secrets and lies and even to deny his own children equal benefits, a very bad person and you still may not know all his dark secrets.

    Just started to get better, he left mid April, I was lucky he left, he was afraid being caught by marriage fraud and human trafficking crime. Very nice man, so convincing he loves me more than life itself, so perfect single father with 1 child, I did visa for both, at the end I found out he has 3 women in 2 countries each one with the child but the child he brought on my fiance visa is not his, he faked the DNA result and marrying me, he was paying with my money that fake child mother tourist visa, she got denied and started to accuse him in kidnapping, he traveled back to his country in 1 day, I got the marriage Annulment by fraud. I was very lucky he didn't stay, his Advance Parole arrived few days after he left and his green card was soon to be approved but it was denied as he left without the Advance Parole. Much more to it but it's too much, I try to forget.
     
    And yes, I was very lucky not being hooked for 10 years with the Affidavit of Support. I didn't know anything, he was so nice and perfect.
     
    Better hire a detective and check out her personal story and whereabouts here in US, it could be anything.

    You certainly make me want to hear your story.....I bet people wouldn't believe you like some on here have decided that I made this ####### up and believe me, I'm not that creative verbally. I am just one of a set of very worried parents because my son is inexperienced with girls. A late bloomer and has a heart of gold that gets hurt all the time because even his friends take advantage of his generosity and knowledge. Maybe we could write a book together and make some money, lol. My son's story has just begun.

    She is a player. For some reason she wants to involve her lover in her drama. Get the paternity test, help her to divorce her husband and stay in US, marry her and watch her cheating on you the same she does now on her husband. Cheaters never change. Enjoy.

    Try to find out who is that uncle she is living with. Maybe it's not the uncle but her lover who took her in and helped her with job. There is also the possibility he is her boss and manager in the Vietnamese slave ring and she is working as a sexual worker for him. All her unstable saying this and that doesn't make her look as a simple honest girl. Try to check what she is doing.

    When I emailed the embassy, they asked for my mobile number so that they could call me (me, the USC) and talk about the case.  THEN they emailed me with a list of stuff that is required for the interview and asked for the application to be filled out AND the accompanying evidence to be sent before they scheduled the interview.  All of this just to determine if we were even eligible to apply for an SB-1.
     
    Pass that, they give you a case number on the spot.  It sets you at the Packet III point in the immigration process, where you have to fill out the online application for an immigrant visa, arrange a police certificate, medical, and prepare another affidavit of support.  A returning resident visa is not something you just apply for, interview, and get.  The process is set up to screen out cases like yours: Unsponsored green card holders who have clearly abandoned residency for an extended period of time.

    if the marriage wasn't consummated, ask your attorney to do the marriage annulment, not divorce, then based on that maybe you can tell to USCIS it was a fraud

    in Russia still pregnant women have good benefits comparing to other countries. Many Russian ladies are travelling from USA back to Russia just for to get the Maternity pay $1.374.58 USD.

    Annulment is the way to go if it wasn't consummated. I am sorry to hear about another this but I admire your braveness as I may call for trying it again with another pinay. It's true, we are not all bad but maybe try knowing them well, whatever nationality you may choose. You might still have a chance to pull the I-864. Once you succeed with that, she will definitely need to go home or worst, stay here illegally. Wish you all the best and be careful on your next choice. Don't ignore the red flags.

    I mean no disrespect to you.  I"m sorry you got into this situation.  But others have been telling you the only thing you can do.  You have to find out if you can even become an lpr again and enter the United States again.  If you can not then there is nothing more you can do.  If you can get back in again you are still faced with a difficult situation.  You can apply for a spouse visa but your wife will have to wait in another country for about 2 years.  You said you can't do that.  So I don't see any other choice than to stay in your home country.  You are getting angry at people for telling you this but these are your only 2 options.

    I'm already paying child support and on the hook for one Filipina that was unfaithful. I don't know about you, but money for me is hard earned and limited, that is why I'm so concerned with that. Who wouldn't be? And the question of withdrawing the I-864 is not yet answered. I don't know for sure that I submitted it in time. It appears that my wife and whoever is helping her know the timelines, know what to do. I'm certainly behind the curve. If she gets her AOS, I'm responsible. Go read about what happens in court on these kinds of cases and see what hell men like me go through for women like that. Annulment is not a certainty at this point, only a possibility. I won't let her back. Why do I like Filipina women? Why do I like Cheeseburgers? Why Do I like the color Blue? My heritage if Filipino. My dad was from there. I went there, I liked the women.  Is it ok if I like what I like? I like brown skin, is that ok with you? I like petite women, it that ok with you? And, its not 2 strikes, this is not a game. I got used twice by two scheming women from a country that is apparently full of women who know how to do this well.  Why don't you tell me what kind of woman I should be looking for.

    If a marriage isn’t consummated then that is grounds for annulment (check your State’s law but I’m sure it’s common law).
    List the medical professionals whom she went to and whom reported back nothing was physically wrong and the therapist whom she missed her appointment with.
     
    Keep that text message saying she was coming back - objectively speaking, a reasonable person who was genuinely scared of you would never return to you and be alone with you. The authorities would scrutinise her on this.
     
    Good luck with whatever you decide, but put your health first.

    to add to what Geowrian said, you can't even do the i-130 until you straighten out your greencard abandonment issue. You can't do anything for your wife when your own status is a problem and needs dealt with 1st; however, based on your own admission, is most likely a non-starter.

    I think you should consult a good lawyer.  Get your GC status straighten out and then take  the next step; how to get your wife legal into the country.
    Personally my main concern would be if you're still considered a LPR and that's something a lawyer can help you with.

    ah, and also watch out if he decides to bring his kids with him, if he does, it's very possible the mother of his kids will try to come on tourist visa at the same time with him and kids or a little later even being divorced and wait for him to divorce you, in the mean time you will have a marriage a trois

    Since you were abroad so long, if you try to return on that green card, they will likely determine that you abandoned it and took of residence abroad. Typically, I would say if you had ties to the US and could be re-petitioned, you could be fine with this route since LPR status won't terminate until an immigration judge makes a determination. But it sounds like that's not the case here, so I think it would be quite risky to try this in this circumstance.
     
    You can try for an SB-1 visa, but they are rarely granted and you must show a strong case as for why you were unable to return to the US. To be a little blunt, it sounds like you chose to live abroad for so long...there was nothing compelling you to stay abroad.
     
    Why not get married abroad since you're with your fiancee now? As others noted, if your plan is for her to stay in the US, this would be fraud.
     
    Technically it's 4 years + 1 day if you broke continuous residence (as is the case here).

    You will be lucky to get your green card back, no citizenship, your 5 years time will start again, so you could petition your wife as a green card holder. If she comes in B1/B2 visa, she will stay illegal or needs to go back out of US and wait for your petition being approved and her visa as a wife for a green card holder approved. If she stays in US and becomes illegal, it means for her to stay 5 years illegal waiting for you to get the citizenship and petition her as a citizen yet there it will be a question in your citizenship application, did you ever helped any illegal person to stay?
     
    This is the best scenario. Another one is you won't get your green card back and you lost your legal residence in US and you will need to live where you are now

    All true. and it's American law care about children. OP is correct worrying about her kids, the new wife will care about hers if she has them.
    OP, it's OK he comes back to US, here he won't dare to miss child support payments and go to travel abroad instead, the judge can even ask to take his passport if he doesn't pay which is his obligation to his own children.

    When he returns to the US it will be easier to attach his wages to get back child support, also too much back child support will cause him to not be able to petition her ( just like too much owed back taxes )   A lot of states give spousal for half the length of the marriage so you may not have much more coming in.
