  1. My interpretation is that an RFE was issued, but OP failed to include required items in the RFE response. That's grounds for a swift denial.
  2. As I recall, you have foreign income for all 3 years. I don't think filing all 3 would be of any significant advantage.
  3. In Texas, I think it is better to change the status. We have never been able to update my wife's address online. I assumed it is because she was a Green Card Holder. I, as a USC, have always been able to update my address online. For that reason, I plan to get wife an appointment at DPS to update her status to USC. I am going to try online again, but the DPS system is undergoing Maintenace at the moment. I did find that even to change the Texas DL address by mail, the person MUST be a US citizen. I also found the same requirement exists for online address changes.
  4. My advice to refile a COMPLETE package ASAP. I assume the K-1 entrant is now out of status and subject to detention and deportation. Adjustment of Status (Green Card) Guide for K1 and K3 Visa Holders - US Immigration & Visa Guides - VisaJourney In your case, I highly recommend hiring that attorney to review your package before submitting it.
  5. No. People who submit only most recent year don't usually get RFEs. I don't know why submitting just 2022 tax documentation would delay your case. You still must enter the income information from all 3 years on the I-864.
  6. No, you don't get to select. Her only option is consular processing.
  7. I have always done the AR-11 online for my wife, and I have, of course, mailed the I-865 each time we moved (3 times). I've always gotten a hard copy conformation for my address change. We were able to dodge the dreaded "failed address change" issue.
  8. Contact USCIS and request the 48 month extension letter. You'll, possibly (likely), need it. Your Green card should be extended to 11/5/2025. In other words, your 2-year GC is actually a 6-year GC (with a valid extension letter).
  9. OK. She will be paying about $2000+ for her peace of mind. Good luck. She is free to join us here on VJ.
  10. I don't understand the concept of multiple DOBs. The only possibility I can think of is person who might use the Lunar calendar.
  11. Just submit the items you submitted with your taxes. There is no requirement to provide a foreign source document when reporting foreign income to the IRS on a 1040. You can't provide a W-2 that you don't have.
  12. Are they all at the same service center? That would explain the difference in estimated processing times. Each I-130 is a separate entity. USCIS will not automatically "put them together". Be prepared to hold the early cases at NVC until all have reached that point.
  13. VJ History indicates differently. They all could be at different USCIS service centers. They will be sent to NVC as they are approved. This happens quite often. It is best to hold each case at NVC (don't pay fees or submit DS-260) until all cases have reached that point. Then contact NVC (using DOS case numbers) and the consulate to request all be interviewed together. We have seen numerous cases in which the first case was scheduled for an interview while lagging cases were months from USCIS approval because the applicant submitted fees and a DS-260. That can be avoided by holding first cases at NVC until they are all there.
  14. Only the 2022 transcript is required. If you want to also submit 2020 & 2021, then just send what you have for each year (either the transcript or tax return package).
  15. Sometimes the consulate places cases under administrative processing due to the unreliable background verifications. The total average for all consulates from NOA1 to interview, according to data entered by VJ members, is 604 days.
  16. Filing under the 5 year rule is a piece of cake..... I speak from experience. Good Luck.
  17. The average time, according to other VJ members, is 410 days from NOA1 to NOA2. Add another 200 days (or longer for ISL) for interview. Your times may be different.
  18. Congratulations!!!! That milestone is now behind you.
  19. Spouses are not listed as dependents.
  20. You will receive either a denial, a rejection, or an RFE. I can't say which one will be issued...but it will not go forward missing letters of intent.
  21. Unless she misrepresented herself when she entered the US, the guide I posted above is the process to follow.
