  3. This was in 2017. Wife submitted additional document same day as interview. 2 days later, visa changed to issued.....2 day later, passport was delivered from AIT.
  4. 1. Hold your husband's case at NVC by NOT paying fees and NOT submitting documents. 2. Immediately contact USCIS and request an expedite for child's case. 3. Once child's case gets to NVC, pay fees and submit documents for both cases. Ask NVC and consulate to join cases. We have seen this situation many times. Good luck.

  10. Every couple has their own priorities, and each couple must decide which visa is better for their situation. K-1 More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months) Spouse can not work until she/he receives EAD (approx 6-8 months) Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed. A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire K-1 entrant cannot file for citizenship until after having Green Card for 3 years. Once an I-129F has been approved, delaying the case is difficult to impossible if the need arises. CR-1/IR-1 Less expensive than K-1 No Adjustment of Status(I-485, I-131, I-765) required. Spouse can immediately travel outside the US Spouse is authorized to work immediately upon arrival. Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport. Spouse has legal permanent Resident status IMMEDIATELY upon entry to US. The clock for citizenship filing starts immediately upon entry to the US. A CR-1/IR-1 case can be delayed indefinitely at NVC if the need arises.

  12. None of that helps to overcome the assumption of immigrant intent....which is the most common obstacle for non-immigrant visa applicants. She needs very strong ties to home country to convince the CO she will return home. Until she has that evidence, don't expect the application results to change. Good luck.
  13. This is not correct. The I-864 is used for immigrant visas and for Adjustment of Status. The I-134 is the affidavit of Support used for K-1 cases.

  16. You have no choice for a trip that soon after the oath. Even an expedited passport after a USPS appointment will take more than a month (maybe 2 months). You will have to get an URGENT appointment at a passport agency, and that usually requires booked travel withing a few days.

  18. Only the most recent tax year documents are required. The 2nd and 3rd most recent tax year documents are optional. Your CURRENT annual income is important. What you earned in past years is not so important. Current annual income is calculated as follows: Gross income from most recent pay period multiplied times the number of pay periods per year. Example: Even If you just started receiving $2000 per month, the current annual income would be $24,000.00

  21. You will need: DS-11 Original Naturalization Certificate Copy of Naturalization certificate State ID/Passport Copy of State ID/Passport Appropriate Fees I would start EARLY looking for an available appointment for a slot immediately after taking the oath.
  22. You can delay your case at NVC by just waiting to pay the fees and submitting required documents. You can delay for a year just by doing that. To be issued a 10 year Green Card, the new immigrant needs to enter the US on or after the 2 year wedding anniversary. Good luck.
  23. Agree. Go fully prepared. They don't cut you any slack at the Texas DPS. I even had to take my 88 year old Mother twice for her ID a couple weeks ago because they are strict.

  25. I see a couple options, although our seeing what the consulate gave you would be beneficial: 1. Your husband can write a letter explaining that he was not required to file taxes for 2022. 2. Husband can file 2022 taxes showing little or no income. Then, you can submit a copy of the tax return. Do you have a joint sponsor? If not, I would get one, too. Good luck.
