  2. The kids are not removing conditions, so no biometric fee is needed for them.
  3. I would certainly prepare for a combo interview. In our case, our I-751 was not initially mentioned in wife's N-400 interview notice. But, I was notified a few days prior to interview date that my attendance was required for the interview (combo).

  5. What is the issue? There is no additional biometrics appointment for a spousal visa case. There is no mailed interview letter.

  7. I thought Green Card holders are subject to the same US tax code as US citizens. I know that world-wide income is treated exactly the same.

  10. I'm not a moderator. I'm not derailing anything. I just doubt your all-inclusive advice is applicable to every case. I don't remember all the details about the Hacking case....but I do remember his telling a caller that there were issues with a similar case.

  12. I think Hacking would disagree with that statement. In fact, I think I have heard him say that it could be a big issue.
  13. A legal resident does not lose legal status, itself, when a Green card expires. Only evidence of legal status expires. After submitting an I-751, USCIS will automatically send the applicant a 48 month extension letter which extends the expiration date which is printed on the card.... but actual legal status remains intact until an immigration judge determines otherwise.
  14. We had no RFEs.....no issues..... USCIS was just slow. Now, USCIS issues a 48 month extension letter when an I-751 is filed. Our I-751 was approved only after my wife filed her N-400.
  15. One more thing: My wife entered about 30 days PRIOR to our 2nd anniversary. That was a mistake. It took 44 months for USCIS to approve our I-751.
  16. Bottom Line: If you have been married for 2 years (or longer) when the new immigrant enters the US via the spousal visa, he/she should be issued a 10 year Green Card. With a 10 year Green Card, you will avoid the dreaded Removal of Conditions (I-751). I would enter a day or 2 after the 2 year anniversary. Removal of Conditions is not a fun experience. You should avoid it if, at all, possible.

  18. Correct what? It sounds like NVC has already sent the interview email. There are no mailed letters involved.
  19. Who sent the response? NVC or the Consulate?
  20. They need only suspicion....not proof. Your case probably has triggered extensive background checks. It could take a while...or it could be done quickly.
