If they did not lie to get the tourist visa, and they did not lie to CBP upon entry, then intent is not an issue. Even if there was intent, that alone is not a reason to deny AOS for a USC spouse.

i guess it depends what you said to get your B2 not revoked and if they asked if u were engaged ect...

You can keep repeating the same thing over and over, you are still wrong. If it goes to immigration court, the judge will grant continuance until the divorce decree can be produced. End of story.

I think she does have intent.
Here's why. When you do a k1 you state that you intend to marry. She left due to (who even knows toooo many stories to count) ......so now she got by CPB with a visa that should have been cancelled when she used her k1.
Now she's back....I think marrying will show intent.

It's all assumptions. A different assumption could be that he left after they decided not to marry (maybe due some problems in the relationship) and came back on a B2 just to see if they can work out their problems.Turned out they did so now they want to get married and file for AOS.

OK, there are two different threads with 2 different stories. One has the finance mad and not talking and there was a family emergency. The other has you both decided to call it off and now you want to get back together. Which story is right?

no. a husband can be ruled a legal father in some cases, but not automatically

It is not very common for those who have recently been deported to obtain a waiver to come back.
It is very uncommon to see such cases.
Obviously very fact dependent, of the few cases I have seen many had issues where a waiver was not available.
From a logical perspective deporting somebody at great cost and then letting them back in with a waiver makes little sense, but then who said this is logical.

I think this has been discussed before or a case very similar.

USCIS won't care why the marriage ended, only why it was entered into. Doesn't sound like you have solid evidence, and that's most important right now.
