    What exactly is the Fraud?  He is coming in on a business visa to help with his sisters business, along with visiting his family. I don't see that he is committing fraud. If we are comitting fraud in any way, please let me know. We aren't trying to hide, or misrepresent any facts. Especially to the POE officer.  My main worry was if it would be an issue for him to travel to another country on a business visa, while residing in the US and still having to go through ROC. 

  2. Hi everyone! My husband and I are soon flying to Bahrain for a trip to see his parents. This is our first time seeing his family since he left to come to the US. Also, their first time meeting their only grandchild as well. We can't go to Saudi , so this was the only place we can go. Unfortunately my husband isn't a US citizen yet, and has a Philippines passport. For this reason he can't get a visors visa to Bahrain like my son and I can. His sister owns a business in Bahrain and was able to get him a business visa to come there. It was quite expensive and she had to put down around 3000 BD (about 7900 USD) that is refundable as long as he leaves when he is supposed to.  He is an accountant, so she plans on having him do some work while we are there. Just looking at the books and helping any way he can. He won't be compensated for any of it. My question is will we receive any scrutiny for him having a business visa traveling there? We intend to be 100% honest with POE officers in letting them know this was the only way he could see his family, and that he does plan on helping with the business while we are there. Any advice would be appreciated. 

  3. You never know until you try. No one here can say you won't get a tourist visa. It's up to the CO. While you dont have strong ties, you have more than some others I've seen approved. Then again that was before Trump. Either way, you dont know until you try. Also, I don't see what the big deal is about the fact that you don't want to go to the USA right now. It's your life, your marriage. Whatever works for you.  

  4. I'm confused as to why you didn't go to him in the first place. You say it's because you didn't want to live with his parents, but you must've known he lived with his parents prior to your flight coming to the US. Not to mention, you didn't even give it a chance. I know if I loved my husband, and wanted to be with him, I couldn't imagine letting something like that stop us from being together. At least trying. As far as the visa coming here with your parents and sister, well that takes a lot of time. Not nearly as fast as coming on a IR1 or CR1. You need an immigration attorney. One that is knowledgeable in immigration.  

  5. My husband is Filipino and we went through the embassy in Riyadh.  If you have any questions about the embassy message me. We had a great experience as far as the interview goes, but not so good with the embassy before hand. They lost our case and we had a terrible time contacting them.  They don't want to answer emails. Hopefully their communication has gotten better since.

    OP travels to US on ESTA no issues

    OP files k1 visa

    OP continues to visit fiance until case  is approved by USCIS 

    OP tries to comes to US and is denied Esta based on the fact that they believe there's intent 

    OP applies for B2

    B2 put into AP because OP is from a MENA country 

    OP goes to k1 interview and put into AP for same reason as B2

    OK first, calm down. There's nothing wrong with laughing a little. Secondly, you plainly said "We were planning on filing for my AOS before his arrest. Is there a way forward for my immigration" Hence the confusion.

    Did you read the end of my post or just what you wanted?  I said "sometimes it's not always as black and white as just being able to get on a plane and leave" My entire point of sharing my side. All countries are different. Not everyone can just leave. 

  9. I know my husband couldn't just quit his job and get on a plane. In Saudi if you leave like that (without notice),  or with an debts (he had to pay off all credits and credit cards) they can bar you from ever entering the country once again. His entire family lives in Saudi, so he has to be able to go back if needed. We did not want to risk him being banned from ever getting to enter again.  Sometimes it's not always as black and white as just being able to get on a plane and leave.

    No need to answer as @Nitas_man answered correctly.  

     

    However if you do decide to continue to pursue the k1 I would advise you not to offer any information unless you are asked. Including photos. That goes for anyone during an interview. Only answer the questions being asked and do not add additional information.

    I'm teeter-tottering on if I should continue to pursue the K1 knowing that we have to be honest and that may lead to a denial. We are only weeks away from out NOA2 so worst case it sets us back a month or two on the CR1.

     

    Good point. There is one piece of evidence that could cause suspicion. To what extent to they vet social media? I.e. should I expect a FB friend request for the embassy? Can the compel us to share our social media accounts?

     

    Its not a hard decision to make. If you're married you file the CR1, if not then continue the k1. How difficult is that? Your lack of will to provide any info on the type of ceremony makes it almost impossible to help you. 

  12. I have 4 kids, and was the sole provider at the time I met my husband. I managed to find a way to go see him.  It would have to be physically impossible for you to meet your fiance' or you'd have to prove something like religious or cultural reasons for the waiver (even those reasons are usually denied)! We all have faced hardships trying to meet our loved ones. Besides do you really think it's smart to marry someone you've never met in person?

    I don't have a lot of information for you because I haven't been through this myself. I have to say I'm suprised you received your NOA1 and bio app letter. I would think they would of denied due to lack of funds, but even the other posts I've read on this aren't very clear. Some say that USCIS will try to process the payment once more. Are you aware if they've tried a second time?  Maybe @geowrian can help provide some insight? Here are some other threads I've found similar to yours.

    The same in Tennessee. It's a bit chilly today, and tomorrow. But right back to the 80's by the end of the week. I wish the fall weather would stick around. :(
