    Even individuals illegally present and working without authorization are required to file and pay income tax.  For those without a Social Security number, an ITIN number should be requested and used. Payment of required taxes and immigration enforcement are not linked; payment  of taxes for illegal work will not alone trigger immigration enforcement action.

    Do you have any red flags you can think of? Who knows what will happen, we went through strokes too and even though we did good (especially my husband, i forgot to mention one of my jobs - he didn't forget, and i forgot one of his scars) they still gave us a NOID that was full of mistakes. We talked to a few lawyers and everyone said that it depends on the officer. So we have actually been waiting for 2 months longer than Ebunoluwa. Sometimes it's crazy like that. I truly wish you the best of luck, hopefully you won't be waiting for years like us and will get your approval soon - that's what happens most of the time anyway : ) Also, where was your interview and what visa did you arrive on (the purpose of this question is your i-130 approved)?

    Thank you Damara, I posted a thread about the home visit. About patience.....when you wait for many years to even come together
    and you are finally together then waiting together is not as bad as waiting being apart.
    We can either make ourselves sick over it or be positive and move forward the best we can.
    I will not let the system steal my joy. Life is too short.

    Thanks for the idea, i'll certainly ask the lawyer. I just don't feel like paying $1500 again

    Dunno about US territories or Alaska, but the part about Hawaii is absolute bull. I went to Hawaii from Seattle twice while my AOS was pending without any AP and had 0 issues. There are no custom checks between mainland US and Hawaii. Stop scaring people.

    #1: A very small chance, and one that has nothing to do with the fact that you were flying to Puerto Rico/Guam/etc. It happened on 9/11, and sure, I can see it happening in rare circumstances, but it could happen flying NYC-SEA too. It's unlikely they'd let you off the plane in most of these circumstances, since most Americans don't even have passports!

    #2: CBP visa checks happen on domestic flights - rarely. However, this is no different than if you were flying from Kansas City to Houston. America is America. With a pending AOS position you are in status, and you haven't left the country - you are fine. Again, USCIS has given specific guidance indicating it is fine.
     
    This is a difficult enough process - there really isn't any reason to add imagined rules when USCIS has said specifically that this isn't an issue.

    Directly from USCIS:

    No, advance parole would not be needed if you travel directly between parts of the United States, which includes Guam, Puerto Rico, U.S. Virgin Islands, American Samoa, Swains Island and the Commonwealth of the Northern Mariana Islands (CNMI), without entering a foreign port or place.

    Can I travel outside of the U.S. when my application for advance parole is pending?

    If you travel outside the United States while your Form I-485 application is pending and you do not have a valid advance parole, your case may be denied for abandonment.  There is a narrow exception for individuals maintaining certain nonimmigrant statuses.

    HI. I don't understand why you are advising not to visit Hawaii and Alaska? I understand an Alaskan cruise could be a problem cause of Canada...but flights to/from Hawaii from the mainland do not require any immigration procedures. And neither do flights to/from Alaska from the lower 48.

    You'll be considered an international student and will have to pay more (most of the time), also will not be able to take a part in some research studies for example. I checked. Its a lot harder without a GC, this is why im waiting, otherwise i'd be in school long time ago.

    Could you also please remove the other peoples' names from this? It is not their fault that USCIS apparently messed up, and I'm sure they don't want their information posted.

    Well, at least now we all know what they can be like and be more prepared. Damn, i'll be saving like everything now and taking pictures all the time hahaha (good, actually, because my husband doesnt like being photographed but now i can use uscis as an argument for the future Lol! And i want pictures most of the time. It's memories )

    So, i don't know. My main guess is that they probably just do this "super extra additional screening" on some applications, may be randomly, just in case. They probably can't spend two years checking every application, but some unlucky ones have to go through this. Even them taking so much time could be a part of it - may be they want to see if people will withdraw the application when they see that it's not working, who knows. But may be i'm wrong, just guessing. For example, if we had photos from every halloween but didn't travel together - they could have asked "why didn't you travel anywhere?". There is alway something that can be found.

    Wow, seriously.  This OP is obviously emotional about taking a chance of having her love get stuck back in his birth country.  I feel exactly the same way.  Who knows what tomorrow will bring.  The current immigration environment is taking a toll on all of us.  We love our spouses and want to be with them forever.  Please give the OP a break and be kind.  Are we all adults here?  Let's be kind and civil towards one another.  If you have something smart to say, keep it to yourself.  The young lady was expressing a legit emotion and has every right to feel the way she does.  Put yourself in her shoes.  
     
    Sweetie, I'm right there with you.  I'm terrified that one day we wake up in Jamaica and realize that immigration changes were implemented where the love of my life will be detained there.

    Guam is different though. I have AOS pending and i wouldn't go there without re-entry permit. Hawaii is a state, and Guam is a territory, not a state. 
    US citizens go to hawaii all the time without passports. How would they prove that they are citizens?

    " I hereby proclaim that the immigrant and nonimmigrant entry into the United States of aliens from countries referred to in section 217(a)(12) of the INA, 8 U.S.C. 1187(a)(12), would be detrimental to the interests of the United States, and I hereby suspend entry into the United States, as immigrants and nonimmigrants, of such persons for 90 days from the date of this order (excluding those foreign nationals traveling on diplomatic visas, North Atlantic Treaty Organization visas, C-2 visas for travel to the United Nations, and G-1, G-2, G-3, and G-4 visas)."

    1) LPRs are aliens, because aliens are everyone who are not U.S. citizens or U.S. nationals.
    2) Don't see LPRs in "excluding" part.

    Counterargument 
    Green card holders were not accidentally included. The EO talks about aliens which is per definition all non-citizens. This was clearly the intent from the start and was also initially confirmed by both WH and CBP statements. only after the emergency stay was ruled did CBP start changing this and the WH back-peddle and a new CBP statement issued. In a press-conference CBP spokesperson said that they had known in advanced and prepared on how to deal with travelers and that after the emergency stay they had to adapt procedures accordingly. That did not just happen magically and it wasn't a due to confusion. People had to actually challenge the EO for this.
    I believe I have said this in three threads now,but I'm just annoyed when ppl make it seem like it just happened, or that it wasn't the intention of the EO and that the "confusion" has now been cleared, as if that is all that took place. That's just not an accurate description of  events.

    It was just an example from real life, supposed to serve as a proof... well kind of. But we don't even have to consider this example. The point is, she is not going through immigration check, thats a 100% true, but of course she can have problems anywhere since she has no status.
