    Yes, that's true... Sometimes it takes 5 minutes to verify you documents with the issuing office which is DHS, but sometimes - up to 5 weeks. It depends on DHS, how accurate they were with updating your status after EAD card was issued.
    As soon as SS Office sees updates in their system, they will mail your card to you.

    If true, the reading of the rules are basically not "Here are the people who need to register", but rather "you must register unless", and that would mean that you must register unless you are in one of the specific categories you mustn't; basically, if the visa has expired--as it would during adjustment--then you would be included in a group who should register.
    I still maintain the OP is not going to be in a huge world of hurt because of this, though. It is not the end of the world, and is somewhat common without holding the catastrophe other immigration mistakes can such as falsely claiming citizenship.

    USCIS won't ever do it. They make majority of their money from AOS cases.

    CBP would need to turn away more people but yet people currently complain about their attitudes. US embassies and consulates abroad would have to deny more visitor visas but that would put the tourist economy in the USA at risk as well.

    It's not going to happen and people will lie. You can't control anyone's actions but your own.

    "...the bridge for my wife and I to be together"...only upon hearing some other feedback are you now trying to claim 'intellectual growth'......what subject are you planning to 'study?'
    I think by now most of us (certainly me, having seen and heard this story countless times) know what the actual reason is for this mind change.....it will fall upon you to be truthful with USCIS about it...
    taking general ed courses won't be intellectual stimulation...
    and as always, remind yourself periodically that your actions, that is, not having lived up to any statements or promises made when you received your B2 visa nor entered the US, will be tracked and remembered by other COs in Manila, and any thoughts of giving the next person the benefit of the doubt and a visa will vanish...and then we'll read more and more sad tales from some unhappy camper about why the CO wouldn't believe him or her.....
    In some of the countries in which I worked, when we received feedback from INS or USCIS about these mind changes, the bar for qualifying for B2 visas rose another 10-20% instantly. Requests for reconsideration hit the trash can, letters from congressmen were answered with mostly boilerplate blah blah and NO decisions were ever changed....which meant 'No' meant 'No!' This included other family members who often tried to 'follow to join' their sibling mind changer...when asked why we didn't believe them, we merely pointed to the one who skipped town.....not surprisingly, that fact brought a halt to most further arguing.

    It's your life, you cannot ask anybody else to make a decision for you. No matter what everyone's opinions are... it is YOUR life and YOUR decision.
    Personally, I would not return to live in Europe. Ever.

    When my husband (then Fiancé) visited me the first time, we didn't think about marriage at that time... But in few days after his leaving we realized we couldn't be apart and we started K1 process.
    So, we haven't known each other for years, we had only few pictures of us together, one visit, no engagement ring either But we had 'the book" of Facebook msgs, ton of daily emails, Skype - each for hours, and daily Zello "walkie Talkie" screenshots We got approval in 3 weeks after receiving the NOA1.
    In the "intent to marry" letter for I-129F my husband mentioned he was going to visit me the second time, and when. I see your concerns about just one stamp in his passport as a proof of your Fiancé' visit. So,he still can describe all his visits in "intent to marry" letter..
    Anyway, I believe with all you have you should be just fine!!!

    It sounds like you and the wife might benefit from a second horny-moon. Think about what made you so excited and hopeful about the future just a year and a half ago. Isn't it worth some marriage counseling and some quality time alone to try and restore your relationship?
    Brides-to-be who leave everything behind and come to a new country are quite brave. They risk everything to make a new life. The culture shock can be significant. Take a deep breath and think about how you would react to immersion in a new culture. Surely, your emotional rubber band has some more stretch!
    Every pencil I have shows wear on the eraser. I make mistakes and endeavor to correct them. What do your pencil erasers look like?

    The show is great, as long as you keep in mind that it's largely staged/scripted.
    My biggest problem with the show is the idea that they all seem to have and repeat throughout the show that the foreign fiancées come to the US to decide if they want to get married to the USC. It's like a 90 day dating period (according to them). I was under the impression that when filing for a fiancé visa, the couple have already decided to get married, and the visa allows them to do it in the US. That is part of the requirements, no?

    Immigration, in general, doesn't always make much sense. I'm sure its been said before, but it is always worth repeating. Somebody can enter our country illegally and have more rights and benefits in the first three months than somebody who followed the rules and immigrated through the proper channels. Where is the incentive to play by the rules when illegal aliens qualify for voter's rights, a driver's license, and government assistance in housing, healthcare and finances? Its is just so damn backwards. If I entered just about any other country illegally, there would be stiff penalties including jail time, heavy fines and deportation. Not in the U.S. We seem to pride ourselves on bringing folks in by the boatload whether they are legal or not. THAT is what makes the immigration process so much more frustrating.
    As for your situation: yes, it is frustrating. Take a deep breath. Relax. Getting angry at the system will only add to your frustration.

    Look to the past to predict your future, he TOOK 7 YEARS to visit his children, his action tells a lot about him.Sending a few dollars per month does not mean he was a present father.
    I doubt your case will be approved, bUT in my opinion you have a bigger problem than Immigration. Good luck.

    my husband just immigrated this past January. The embassy told him that he MUST live in the US for at least 7 months out of the year to keep his green card valid. If you stay outside of the US for more than 4-6 months , they will assume you have abandoned your green card. I am not sure what happens after that.
    Also, you mentioned you make $3000/ month over there. You would still need a co-sponsor because the USCIS requires US income.
    IMO, if you show leases and employment letters to the embassy, I would think that would be enough to show she has strong ties in Vietnam and only want to visit. If you get the B2, then you can travel back and forth to visit for 10 years as long as she doesn't overstay.

    A Schengen visa might help, but not necessarily.. I've seen people who successfully got B1/B2 approval, and US visa was the first visa in their entire life.
    The most important is to prove you have strong ties with your home country. If you are not able to provide this, a schengen visa won't help anyway.
    But it doesn't hurt to try - never know what can happen
    Not sure you really need a lawyer - NO ONE can guarantee you the result you want, applying for US visa. And if you try, the visa fee is gonna be your ONLY expense.

    The following applies to you if you are a male at least 18 years of age, but not yet 26 years of age, who is required to register with the Selective Service System: "I understand that my filing Form I-485 with U.S. Citizenship and Immigration Services (USCIS) authorizes USCIS to provide certain registration information to the Selective Service System in accordance with the Military Selective Service Act. Upon USCIS acceptance of my application, I authorize USCIS to transmit to the Selective Service System my name, current address, Social Security Number, date of birth, and the date I filed the application for the purpose of recording my Selective Service registration as of the filing date. If, however, USCIS does not accept my application, I further understand that, if so required, I am responsible for registering with the Selective Service by other means, provided I have not yet reached 26 years of age."
    It's still the indidivual's responsibilty. I would not count on USCIS registering anyone for Selective Service. Too many people count on USCIS registering them for their Social Security cards and not get them. The last few sentences above puts the responsibilty and penalties on the individual even if USCIS fails to register the person based on the I-485.

    I would start calling too, but not to USCIS - i would start calliing around, trying to figure out who is the cheapest civil surgeon in my area.. because there's really nothing you can do about this but response to RFE...
    Yes, you are right, K1 medical is good for year and I understand how you feel right now.. I wasn't "excited " either, re -doing my medical and paying for this again, but... Your application can be easily denied if you fail to comply with the request on and before date it says.
    You received RFE and there is a good news in this too - your case has been touched Hopefully the new medical is the only thing they need.. Just sent in what they want and most likely you will have your AOS approval soon ; )

    You have no way of knowing they will be fine. It's far more likely than not that they will be, but you can use the search function on these forums and find more than one K-1 who was detained by ICE for being out of status.

    You do not need to send in evidence of a bonafide marriage with your AOS application, except for the required marriage certificate. Stuff like proof of joint insurance and joint bank accounts are not needed with the initial application. If you are scheduled for an interview, you can bring this evidence with you then.
    Also, getting an interview waiver is completely random. Front loading your petition will not do anything to help you get an interview waiver.

    That's OK. It also took for me some time to recognize the difference between those two, re-entry permit and AP
    Hope you will hear something about your AOS soon - usually, when you apply for RENEWAL of your EAD, it's some kind of "reminder" for USCIS about your I-485. I had to renew my EAD in June and at the end of July my I-485 finally was touched, after pending more than a year. On September I got approval

    All you need to do is;
    1. pray and ask God to give you the patience you need for the remaining part of the journey.
    2. you need to wait for mails from USCIS instructing your on the next steps.
    3. you could also look for fellow October filers here on vj and you can keep track of your application time frame by comparing with others.
    Since you are K-visa your are likely not to have an interview. Just sit back relax and let it playout.
