    I honestly fail to realize how having a house, a car, and money in the Philippines is a bad thing. Really..? Can someone possibly explain this from his point of view?
    There is so much awesomeness out of owning your own things.
    1) Whenever you travel to the Philippines you always have a place to stay and a way to get around.
    2) Her kids will always have a home.. They won't end up on the streets.
    3) You can Airbnb that shiz out. $$$$$$$$$$$$
    4) Its friggen equity. You own it. It's yours. You'll never end up homeless.
    So what if she has a savings in the Philippines..? So what if her kids don't want to come live in the US..? How exactly is that hindering you all from living and loving each other every day?

    My parents and I lived in the US since 1999 on an E2 visa as they have a company here but never had PR.
     
    I was able to give my parents their PR through my K1 visa marriage after I became a citizen, so unfortunately they’ve only received their PR a little under a year ago. We just gathered all of our resources to be in a place to be able to apply for my brother now

    How is that question relevant? How he came to the US is none of our business nor is it relevant to his question. He's an American citizen and that's all that matters.

    Btw guys :3 if you don't already have the USCIS case status app, I suggest you download it cause it's definitely a time saver since we're all trying to follow at least 2 case Files here. Plus this way you'll definitely get the notification as soon as you get the update! You won't have to scramble through numbers and have to remember like 15 different ones.

    Oh no, I'm aware it was denied for a legitimate reason, however based on OP's first post, it didn't seem like he made it clear to them that they were denied. Like, I believe he should have flat out told them that they were denied. Thats what I meant by a "soft-core" let down lol

    There was a K-1 case here on VJ last year where the visa was refused and the petition was returned to the Texas Service Center where it was reopened. The poster never followed up on whether the petition was reaffirmed or not. However, at the time of posting, it had been many months since the refusal.
    In any case, a DCF or a new K-1 would likely be quicker and more certain than waiting around for the uncertain outcome at the TSC.
    If I were in your shoes, I would immediately contact the consulate and request that a senior officer review your case. I would also contact your Congress people and have them make the same request. You would need to do this before your petition leaves the consulate.
    I believe that the consular officer had the authority to approve the visa despite the simple clerical error. To add insult to injury, you were refused even though you provided all of your divorce decrees at the interview. We had a situation similar to yours, but with a much different outcome. Instead of a refusal, we received a 221g which we satisfied within a few days. You can click on our signature for details.

    Hi!! Going into the process I had a really complicated history with US visas and overstays, so I was really weary about going in on my own. Turns out, I really didn't need a lawyer all that much. The only thing I needed her for was embassy prep because she made an amazing package to send into the embassy explaining my history and what not. Now that I've completed that part, I intend of completing the rest of the processes on my own without a lawyer. It really isn't that complicated, they're very clear on what they want and what you should send. Don't be scared )) Plus if there are any forums you truly are struggling with, there are thousands of people here on visa journey to help you, people who've asked the same questions as you, and even example forms on how to fill it out as a K-1 visa applicant!

    I've lived in many countries growing up, constantly having to leave my friends and family behind. My fiance also came to live with me for a while in a country that wasn't america, so I'm really well versed from both sides.

    Some people just deal with change better than others. I get agitated by everything that isn't how it is back home, my fiance is enthralled by everything that isn't how it is back home. (For both of us the US is home)
    Also, living in other countries you also gain a lot of expat friends whom also complain about living in another country.

    All I can say is, wait it out. I must say he really is being a little bit selfish, you do seem like you're going the extra mile for him, but there is nothing you can do. He needs to open himself up to the change. He has all his friends, all his family, everything he's ever really known in Cuba. Like another poster said, in Cuba they have a completely different view of what american life is like, so that might be polluting him from fully accepting anything. Think of it this way, would you like to live in North Korea?

    It really just sounds to me like he's throwing a temper tantrum, but hopefully it will all blow over soon. Just remember, this is hard for both of you, not him. Try to make him understand how his obnoxious public tantrums are making you feel.

    South florida has a strong cuban community with AMAZING cuban food Maybe a trip to FL might do y'all some good!

    He is so FUBAR for claiming to be a US citizen to government officials to gain entry into the US. This is NEVER taken lightly. There is no waiver. It's game over.
    Your friend and his wife may have to accept that he will spend the rest of his life here as an illegal immigrant subject to deportation. Will not matter that he has a USC wife or USC babies.
    Google "false claim to US citizenship" and you will find no waiver is possible. Your friend is toast.

    I just wanted to make the point that the person who gave him his passport to use is probably going to be in serious trouble as well. Even if he now tries to claim that he "lost" his passport, I think under the circumstances, they are going to look into it. You initially said he was "working using his friends papers"......that will also get the other person in trouble because if a job Is reporting Social Security wages under someone's social that is not actually working there is going to be a big fraud case with that too. Your biggest question shouldn't be "HOW he managed to go through CBP with someone's passport"....but how is he now going to save himself, the owner of the real passport, and his wife from spending a considerable time in federal prison.
    I feel like this topic is fishing for answers for someone to get away with a serious offense, but believe me, VJ members are not going to help with that. Best of luck to your .....friend?

    Most of it would hinge on his use of the US passport and how his presentation of himself as a US citizen would be perceived. I am of the opinion that he would have a life-time ban for entering the US claiming citizenship.
    He needs to speak to an attorney and tell them everything.
